The minute of meeting of this Committee of 15th April, 2013 was held as read.

I DECLARATION OF INTEREST
There were no declarations of interest.
II PLANNING APPLICATIONS
(a) 13-00086-FULL - PARKVIEW SCHOOL, 309 BLACKNESS ROAD - HOUSING DEVELOPMENT TO PROVIDE 45 UNITS FOR WHITBURN PARKVIEW LLP
The Committee acceded to a request for a deputation to address the Committee relative to objections to the above application. After the deputation had stated its case and answered questions from members of the Committee, it was thanked for its attendance and withdrew.
Thereafter, having considered objections received, the Convener, seconded by Councillor Hunter, moved approval of the application, subject to the conditions recommended by the Director of City Development.
As an amendment, Councillor Macpherson, seconded by Bailie Scott, moved refusal of the application on the grounds that:-
(i) the proposals were contrary to Policy 4(b) of the Dundee Local Plan 2005 as the scale and nature of the new build development results in overdevelopment of this site, which is out of character with the surrounding low density residential area. There were no material considerations of sufficient strength to justify the granting of planning permission contrary to the policy; and
(ii) the proposals were contrary to Policy 1 of the Dundee Local Plan 2005 as the design and layout of the development would have an adverse impact on the amenities of local residents by reason of:-
(a) overshadowing, caused by the new build development; and
(b) noise, caused by the location and quantity of car parking in the northern part of the site.
There were no material considerations of sufficient strength to justify the granting of planning permission contrary to the policy.
On a division, there voted for the motion - the Convener, Bailie Sawers and Councillors Alexander, Black, Dawson, Hunter, Lynn, Melville, Murray, Keenan, Brennan, Ferguson, Gordon and McGovern (14); and for the amendment - Depute Lord Provost Roberts, Bailies Wright, Borthwick and Scott and Councillors Guild, Campbell, Cordell, McDonald, Ross, Asif, Bidwell, Cruickshank, McCready and Macpherson (14) - whereupon the Convener gave his casting vote in favour of the motion and the motion was declared carried.
(b) 13-00087-LBC - PARKVIEW SCHOOL, 309 BLACKNESS ROAD - CONVERSION OF EXISTING FORMER SCHOOL BUILDING FOR RESIDENTIAL USE AND ALTERATIONS AND EXTENSION TO EXISTING LODGE TO FORM A HOUSE FOR WHITBURN PARKVIEW LLP
The Committee approved the application, subject to the conditions recommended by the Director of City Development and further agreed that the consent should not be issued unless and until Historic Scotland had formally decided that the Listed Building application would not be called in for determination by Scottish Ministers.
(c) 13-00210-FULL - BARNHILL PRIMARY SCHOOL - ERECTION OF TWO STOREY EXTENSION TO PROVIDE A NURSERY, ADDITIONAL CLASSROOMS AND A GYMNASIUM FOR DUNDEE CITY COUNCIL
After considering objections received, the Committee approved the application, subject to Conditions (i) and (iii) recommended by the Director of City Development and the substitution of Condition (ii) with:-
Details of the arrangements for the construction of the proposed extension including the scheduling of the construction of a temporary site access road, timing for delivery of materials, the positioning of site huts, storage of materials and parking for contractors shall be submitted to the Council for approval before any development is commenced and the development shall be carried out only in full accordance with such approved details.
(d) 13-00058-FULL - HARRIS ACADEMY, 470-472 PERTH ROAD - CONSTRUCTION OF NEW SECONDARY SCHOOL FOR DUNDEE CITY COUNCIL
The Committee approved the application, subject to the conditions recommended by the Director of City Development.
III DELEGATED ITEMS
There was submitted Agenda Note AN45-2013, advising that from 22nd March to 21st April, 2013, 44 applications were decided under delegated powers. Five of these applications attracted objections and, of these, three were approved and two were refused.
The Committee noted accordingly.
