I DECLARATION OF INTEREST

II PLANNING APPLICATIONS
(a) 12-00770-FULM - DUNDEE RAILWAY STATION, SOUTH UNION STREET, DUNDEE - NEW MIXED USE STATION CONCOURSE BUILDING, INCORPORATING TICKET OFFICE, CAFE/RESTAURANT, NEWSAGENT, RETAIL UNIT AND HOTEL - FOR CITY DEVELOPMENT DEPARTMENT
Councillor Bidwell moved approval of the application subject to the conditions recommended by the Director of City Development, together with the additional condition (vi), that prior to the proposed hotel hereby approved becoming operational, the hotel operator shall submit a comprehensive Travel Plan that sets out proposals for reducing employee dependency on the private car to the Council for written approval. Within one year of opening, the hotel travel plan approved by the Council shall be implemented in full. For the avoidance of doubt, the Travel Plan shall identify measures to be implemented; the system of management, monitoring, review and reporting; and the duration of the plan in the interests of minimising traffic movements and congestion in the Waterfront area of the City.
The Convener, seconded by Councillor Dawson, moved approval of the application subject to the conditions recommended by the Director of City Development.
On a division, there voted for the motion - Bailie Borthwick and Councillors Keenan, Bidwell and Gordon (4); and for the amendment - the Convener, Lord Provost Duncan, Depute Lord Provost Roberts, Bailies Sawers and Scott and Councillors Guild, Alexander, Black, Campbell, Cordell, Dawson, Hunter, Lynn, Melville, Murray, Ross, Brennan, Cruickshank, Ferguson, McCready and Macpherson (21) - whereupon the amendment was declared carried.
(b) 12-00778-FULL - BIRKHILL CEMETERY, TEMPLETON ROAD, DUNDEE - FORMATION OF INTERNAL ROADS, PARKING AREA, DRAINAGE FACILITIES AND ERECTION OF FENCING - FOR ENVIRONMENT DEPARTMENT
The Committee approved the application subject to the conditions recommended by the Director of City Development.
(c) 12-00798-FULL - LAND TO THE WEST OF 166 HIGH STREET, LOCHEE - ERECTION OF TWO NEW RETAIL UNITS FOR FARMFOODS LTD
The Committee approved the application subject to the conditions recommended by the Director of City Development.
III APPEAL DECISION - 31 BUTTARS LOAN, DUNDEE - CHANGE OF USE FROM VACANT PUBLIC HOUSE TOTHREE RETAIL UNITS
There was submitted Agenda Note AN6-2013 making reference to Article I(e) of the minute of meeting of this Committee of 18th June, 2012, wherein the above proposal was refused planning permission contrary to the Director's recommendation because the Council considered that the application was contrary to Policy 45 of the Dundee Local Plan Review 2005 as the applicant had failed to demonstrate that there were no available sites within the City or District Centres and also failed to demonstrate that there was a deficiency in shopping provision that could not be met within or on the edge of the City Centre or a District Centre. It was considered that although Policy 42 of the Dundee Local Plan Review 2005 offers support to the upgrading of existing shopping provision at local shopping parades the contravention of Policy 45 was of significant weight such as to warrant refusal of the application. There were no material considerations that would warrant approval of the application contrary to the terms of Policy 45 of the Dundee Local Plan Review 2005.
It was reported that the decision was subsequently appealed by the applicant under the provisions of Section 47 and Schedule 4 of the Town and Country Planning (Scotland) Act 1997 and was allowed and the application granted planning permission subject to conditions similar to those which had been proposed by the Director of City Development.
IV DELEGATED ITEMS
There was submitted Agenda Note AN5-2013 reporting that from 22nd November to 21st December, 2012, 27 applications were decided under delegated powers. Two of these applications attracted objections and both were refused.
The Committee noted accordingly.
