I LAND ADJACENT TO THOMSON PARK, LIFF ROAD, DUNDEE - ERECTION OF 17.5M TALL MONOPOLE -FOR VODAFONE/TELEFONICA THE CONNECTION

 

It was reported that a request had been received for a deputation to address the Committee in support of the above application ( 12-00085-FULL).

 

Having considered objections received, the Committee approved the application subject to conditions recommended by the Director of City Development and, in the circumstances, declined to hear the deputation.

 

II LAND AT FORTIES ROAD - S75 AGREEMENT

 

There was submitted Agenda Note AN55-2012 advising that, in 1996, Tayside Regional Council and the City of Dundee District Council had entered into what was then a S50 Agreement (now known as S75 Planning Obligation) in respect of land lying to the east of Forties Road, Dundee. In order to ensure that the land affected would be developed to provide facilities connected with the operation of a waste to energy plant and that within a year of the commissioning of the new plant, the existing incinerator would cease operation as an incinerator.

 

It was reported that the new waste to energy plant had been constructed and was operational and the existing incinerator had ceased operation as an incinerator.

 

Land on the west side of Forties Road was in the process of being sold by the City Council to EMR Ltd, and solicitors for the purchasers considered that the title to this land was affected by the existing S50 Agreement. As the restriction created by the S50 Agreement was no longer relevant or appropriate, the Committee agreed to discharge the S50 Agreement.

 

III APPEAL DECISION - CARLTON HOUSE HOTEL, 2 DALGLEISH ROAD, DUNDEE

 

There was submitted Agenda Note AN56-2012, making reference to the decision of the Council on 13th September, 2011, under powers delegated to the Director of City Development, to refuse advertisement consent for the above proposal on the grounds that the internally illuminated box sign detracted from the appearance and character of the site and surrounding buildings and created a cluttered effect contrary to Policy 63 (Advertising) of the Local Plan.

 

It was reported that the decision was subsequently appealed by the applicant under the provisions of Section 182 of the Town and Country Planning (Scotland) Act 1997 and Regulation 21 of the Town and Country Planning (Control of Advertisements) (Scotland) Regulations 1984, and had been dismissed.

 

It was further noted that the Council had already served an Enforcement Notice in connection with this unauthorised sign and action would now be taken to seek its removal.

 

IV DELEGATED ITEMS

 

There was submitted Agenda Note AN54-2012 advising that from 22nd February to 21st March, 2012, 32 applications had been decided under delegated powers. Seven of these applications had attracted objections and all seven of these applications were approved.

 

The Committee noted accordingly.
