I PLANNING APPLICATIONS
(a) 11-00556-FULL - WHITE HORSE INN, HAREFIELD ROAD, DUNDEE - CHANGE OF USE FROM VACANT PUBLIC HOUSE TO BISTRO RESTAURANT WITH TAKEAWAY - FOR WILLIAM BROWN FOOD
The Committee acceded to requests which had been received for deputations to address the Committee both in support of, and relative to, objections to the application.
After the deputations had stated their cases and answered questions from members of the Committee, they were thanked for their attendance and withdraw.
Thereafter, having considered objections received, the Committee refused the application on the grounds that:-
(i) the application fails to comply with Policy 1 of the Dundee Local Plan Review 2005 in terms of road safety and traffic issues resulting from the short-stay nature of takeaway customers at peak traffic times of the day and there are no material considerations to justify a decision contrary to this; and
(ii) the application is in breach of the distances to residential property under the terms of Policy 53 of the Dundee Local Plan Review 2005 and there are no material considerations to justify a decision contrary to this.
(b) 11-00553-FULL - ERECTION OF TWO HOUSES (CHANGE OF HOUSE TYPES) FOR HOME IN SCOTLAND
The Committee approved the application subject to the conditions recommended by the Director of City Development.
(c) 11-00603-FULL - ERECTION OF 17.5 TALL STREETWORKS MONOPOLE ACCOMMODATING VODAFONE AND TELEFONICA ANTENNA WITHIN GRP SHROUD PLUS GROUND LEVEL CABINET - FOR VODAFONE/TELEFONICA THE CONNECTION
After considering objections received, the Committee approved the application, subject to the conditions recommended by the Director of City Development.
II APPEAL DECISIONS
There was submitted Agenda Note AN178-2011 advising of the undernoted planning appeal decision.
LOCATION: ST FRANCIS AMATEUR BOXING AND SPORTING CLUB, KING'S CROSS ROAD, DUNDEE
Reference was made to Article I(g) of the minute of meeting of the Development Management Committee of 18th April, 2011, wherein the above proposal was refused planning permission because the Council considered that:-
(i) the proposed development was contrary to Policy 1 of Dundee City Council's adopted non-statutory Planning Policies in relation to Telecommunications Masts and Other Apparatus as the applicant had failed to provide sufficient justification in support of the application by investigating all alternative sites and designs in order to minimise the visual impact of the proposals; and
(ii) the proposed development was contrary to Policy 15 of Dundee City Council's adopted non-statutory Planning Policies in relation to Telecommunications Masts and Other Apparatus, as although the applicant had provided a mast share solution, it fails to meet the required site location and design controls required elsewhere in these policies.
The decision was appealed by the applicant under the provisions of Section 47 and Schedule 4 of the Town and Country Planning (Scotland) Act 1997.
The Reporter allowed the appeal and granted planning permission, subject to a condition that the mast be removed if it became obsolete or redundant.
III DELEGATED ITEMS
There was submitted Agenda Note AN179-2011 advising the Committee that, from 22nd September, 2011 to 21st October, 2011, 58 applications were decided under delegated powers. Six of these applications attracted objections, five of these were approved, and one was refused.
