I BOTTLE MARKING SCHEME

There was submitted Report No 216-2011 by the Duncan Project Coordinator requesting that the Board consider supporting a bottle marking scheme in Dundee.

The Board remitted to the Clerk to initiate a consultation under Section 6 of the Licensing (Scotland) Act 2005 on the inclusion of a supplementary statement to the Board's Statement of Licensing Policy.

II LICENSING (SCOTLAND) ACT 2005

The Board agreed to grant the above application.

The Board agreed to grant a variation allowing children access to the premises for the purpose of consuming a meal when accompanied by a responsible adult, and young persons allowed access at the discretion of the bar supervisor for the consumption of a meal or non-alcoholic beverages. Children and young persons allowed access to the premises from opening time to 8.00 pm and allowed in all public areas of the premises but must not be seated at the bar.

The Board heard from an agent on behalf of the applicant, the Chief Constable's representative and the Board's Legal Officer.

 

The Convener moved to grant a variation to 4.30 am on Fridays and Saturdays only, with a report back to the Board in six months. As an amendment, Councillor Fordyce moved to refuse the application.

 

On a division, there voted for the motion - the Convener and Councillor Dick (2); and for the amendment - Bailie Regan and Councillors Bowes, Hunter, Fordyce, Gordon and Keenan (6) - whereupon the amendment was declared carried refusing the variation.

 

The Board further agreed to grant a Direction and provide a statement of reasons.

The Board, having heard from the Chief Constable's representative, an Officer from Environmental Health and Trading Standards, the licence holder on their own behalf and the Board's Legal Officer, agreed to endorse the above licence.

 

IV PREMISES LICENCES - REQUEST FOR HEARING
