At a MEETING of the LOCAL REVIEW BODY held at Dundee on 28th September, 2010.

The Chairman welcomed those present to the meeting and briefly outlined the role of the Local Review Body and officers, in particular advising that, although the Planning Adviser was an employee of the Planning Authority, he had not been involved in the determination of the case under review and was present to provide factual information and guidance only.

The minute of the above meeting was submitted and noted.

 

II REQUEST FOR REVIEW - LR04/10 - GARDEN GROUND AT 9 PARK ROAD, DUNDEE

 

Reference was made to Article II of the minute of meeting of the Local Review Body of 17th August, 2010, wherein details had been submitted of a request for review of the refusal of planning permission for the demolition of a garage and erection of a single storey house in garden ground at 9 Park Road, Dundee, for Mr and Mrs Coats.

 

The Local Review Body had requested further written submissions which had been provided and circulated. It had also requested an accompanied site visit which had taken place on 15th September, 2010.

 

The Local Review Body agreed, in terms of the Local Review Procedure Regulations, to determine the review without further procedure on the basis of this information.

 

Thereafter, having considered all the information, the Local Review Body upheld the decision of the Appointed Officer to refuse planning permission on the following grounds that:-

 

(i) The proposed development contravened Appendix 1, referred to in Policy 4 of the Dundee Local Plan Review 2005, due to having two bedrooms and a floor area of 85 square metres; and as a result of failing to provide a garage or space for a garage. There were no material considerations of sufficient strength to justify the granting of planning permission contrary to the terms of the Policy;

 

(ii) The proposed development contravened Policy 4 of the Dundee Local Plan Review because the erection of a house in the ground of 9 Park Road would be incongruous to the low density appearance of the Elgin Street streetscape. In addition, by virtue of scale and massing, the proposed house would have the appearance of being significantly smaller than neighbouring houses and therefore out of character with the Elgin Street streetscape. As such, the proposal failed to have regard to the Urban Design Guide. There were no material considerations of sufficient strength to justify the granting of planning permission contrary to the terms of the Policy; and

 

(iii) The proposed development contravened Dundee Local Plan Review 2005 Policy 15(a) because the proposed house would be out of character and appear cramped and incongruous to the surrounding low density environment; and Policy 15(d) because the development did not respect the prevailing densities in the area. There were no material considerations of sufficient strength to justify the granting of planning permission contrary to the terms of the Policy.
