I BOTTLE MARKING SCHEME

There was submitted Report No 573-2010 by the Clerk to the Licensing Board advising members of the Board of a request from Dundee Licensing Forum to introduce a "Bottle Marking Scheme" in the Board's area in order to assist with tracing the sources of alcohol consumed by children and young persons.

The Board agreed to:-

(i) support, in principle, the adoption of a "Bottle Marking Scheme" in its area;

(ii) remit to the Clerk to enter into discussions with all relevant agencies to draw up a specific proposal for such a scheme, to investigate funding for it and to report back to the Board; and

(iii) seek the views of the statutory consultees on the Board's 2011/2014 Statement of Licensing Policy on the inclusion of a "Bottle Marking Scheme" in the policy itself.

II LICENSING (SCOTLAND) ACT 2005

(a) NEW GRANTS

The Board, having heard from an agent on behalf of the applicant and the Chief Constable's representative, agreed to grant the above application.

Bailie Wallace and Councillor Bowes declared a non-financial interest by virtue of having a relative employed by the applicant.

The Board, having heard from an agent on behalf of the applicant and from the Chief Constable's representative, agreed to grant the above application.

The Board, having heard from the applicant on their own behalf and from the Chief Constable's representative, agreed to grant the above application.

(b) VARIATIONS (MAJOR)

The Board agreed to grant the above application for variation to change capacity figure from 290.18m2 to 339.96m2 due to rebranding as 'Extra' branch and associated amendment to layout plan.

The Board, having heard from the applicant on their own behalf, agreed to grant the above application to change core licensing hours, to amend access for children and young persons, and to allow consumption of alcohol in the auditorium.

The Board, having heard from an agent on behalf of the applicant, agreed to grant the above application for variation to remove the requirement for children to consume a meal. Variation to allow children access to the premises until 10pm in July and August and until 9pm for the remainder of the year.

The Board, having heard from an agent and a representative of the applicant, agreed to grant the above application for variation to allow the garden area and smoking area to be used as ancillary to the ballroom for the provision of outdoor drinking. Planning restriction on use of external area.

Councillor Andrew Dawson declared a non-financial interest by virtue of holding membership of the applicants' premises.

The Board, having heard from the applicants on their own behalf, agreed to variations for the core hours and children and young persons. In respect of variation for visitors, the Board deferred the matter to the October meeting of the Board.

The Board, having taken into account objections, heard from the applicants on their own behalf and from the Board's Legal Adviser, agreed to variations in respect of children and young persons and outside drinking area. In respect of the variation to core hours, the Board refused the request.

The Board agreed to grant the above application.

The Board, having heard from an agent and a representative of the applicant, agreed to grant a variation to provide outdoor drinking facilities in the garden and smoking areas of the hotel.

(c) VARIATION (MAJOR) ON TRANSFER

The Board agreed to grant a variation to the layout plan to increase the area of alcohol from 10.56m2 to 25.46m2.
