The minute of meeting of this Board of 27th August, 2009 was held as read.
I IMPLEMENTATION OF THE LICENSING (SCOTLAND) ACT 2005
The Convener made reference to recent reports in the press of problems associated with the excessive consumption of alcohol in Dundee and how this correlated with the implementation of the Licensing (Scotland) Act 2005 on 1st September, 2009.
Now that the Act was in force, the Board wanted to see how matters had progressed and agreed that the Clerk bring forward a report to the November meeting of the Board on the implementation of the new Act with particular regard to issues such as irresponsible promotions in licensed premises, what types of promotions were being found to be taking place, were staff meeting their training responsibilities, and generally how well licensed premises were complying with the terms of their licences.

The Board, having heard from the applicant on their own behalf, agreed to the inclusion of the Function Suite.
III PERSONAL LICENCE HEARINGS
(i) MR CHARLES DINGWALL
The Board, having noted that the licence holder was not present and having heard from the Chief Constable's representative, agreed to revoke the licence.
(ii) MRS JANE MARONEY
The Board, having heard from the Chief Constable's representative and the licence holder on their own behalf, agreed to endorse the licence.
IV DISABILITY DISCRIMINATION ACT - LICENSED PREMISES
There was submitted Report No 466-2009 by the Clerk updating the Board regarding ongoing complaints from the 5 Digits Disability Issues Group concerning the lack of disabled toilets at three licensed premises in Broughty Ferry.
The Board, having heard from the complainants, agents on behalf of two of the licensees and the remaining licensee on their own behalf, agreed not to call for hearings under Sections 37 and 38 of the Licensing (Scotland) Act 2005 but to refer the matter to the Equality and Human Rights Commission.
