I PLANNING APPLICATIONS
(a) 09-00413-FUL - LAND TO THE WEST OF SMITH STREET - DEMOLITION OF INDUSTRIAL UNIT AND ERECTION OF NINETEEN FLATS - FOR BAKER BRADLEY
It was reported that a request had been received for a deputation to address the Committee relative to objections to the above-mentioned application.
After considering objections received, the Committee refused the application on the grounds that:-
(i) the proposed flatted development by virtue of scale, design and massing will give rise to significant issues of overlooking and overshadowing to the detriment of residential amenity. Therefore the proposals will not make a position or sustainable contribution to the quality of housing available in the local area. The proposals are contrary to the provisions of Policy 4 (Design of New Housing) and consequently Criteria (a) and (b) of Policy 2 (Housing Land Release) of the Dundee Local Plan Review 2005. There are no material considerations that would justify approval of the application contrary to the provisions of Policy 2 and Policy 4 of the Dundee Local Plan Review 2005; and
(ii) the six flats accommodated in the northern wing of the proposed building will have a poor outlook over the existing General Economic Development area which bounds the application site to the north. These flats will also significantly overlook the garden grounds of 6 Smith Street and 199 Strathmartine Road. The six flats accommodated in the northern wing of the proposed building are therefore an overdevelopment of the application site as they are afforded a poor quality outlook to the north and give rise to significant issues of overlooking and overshadowing to the detriment of residential amenity. The proposed development is therefore contrary to the requirements of Policy 4 (Design of New Housing) of the Dundee Local Plan Review 2005.
In the circumstances, the Committee declined to hear the deputation.
(b) 09-00398-COU - LAND AT BALLINDEAN TERRACE - CONSTRUCTION OF NEW CAR PARK - FOR HOUSING DEPARTMENT, DUNDEE CITY COUNCIL
After considering objections received, the Committee approved the above-mentioned application subject to the conditions recommended by the Director of City Development.
(c) 09-00436-FUL - MOYNESS, 76 GROVE ROAD, BROUGHTY FERRY - DEMOLITION AND REBUILDING OF BOUNDARY WALL - FOR MOYNESS NURSING HOME
Councillor Scott declared a non-financial interest in the above-mentioned application by virtue of having been involved in previous discussions relative to the application.
Thereafter, having considered objections received, the Committee approved the application subject to the conditions recommended by the Director of City Development.
(d) 09-00468-FUL - 3 MAUCHLINE AVENUE - INSTALLATION OF REPLACEMENT SHOPFRONT - FOR CITY DEVELOPMENT DEPARTMENT, DUNDEE CITY COUNCIL
The Committee approved the application subject to the conditions recommended by the Director of City Development.
II PLANNING APPEAL DECISIONS
There was submitted Agenda Note AN195-2009 advising of the undernoted planning appeal decisions:-
(a) 68-69 HIGH STREET, DUNDEE - INSTALLATION OF ILLUMINATED SIGNAGE
Reference was made to Article I(f) of the minute of meeting of this Committee of 16th March, 2009, wherein the above proposal was refused advertisement consent because the Council considered that the design and appearance of the sign detracted from the listed building on which it had been erected and from the conservation area.
It was reported that the decision was subsequently appealed by the applicant under the provisions of Section 182 of the Town and Country Planning (Scotland) Act 1997 and Regulation 21 of the Town and Country Planning (Control of Advertisements) (Scotland) Regulations 1984, and had been dismissed.
(b) 13 FAIRFIELD ROAD, BROUGHTY FERRY, DUNDEE - PROPOSED NEW SINGLE STOREY DWELLINGHOUSE
Reference was made to Article I(e) of the minute of meeting of this Committee of 15th December, 2008, wherein the above proposal was refused planning permission because the Council considered that:-
(i) the design and finishing materials of the house would detract from the conservation area and surrounding listed buildings bounding the application site contrary to Local Plan policies and the statutory duties set out in Sections 59 and 64 of the Planning (Listed Buildings and Conservation Areas) (Scotland) Act 1997; and
(ii) the development would adversely impact on trees which contribute to the setting of the conservation area and the grounds of the listed building contrary to Local Plan policies and the statutory duties set out in Sections 59 and 64 of the Planning (Listed Buildings and Conservation Areas) (Scotland) Act 1997.
It was reported that the decision was subsequently appealed by the applicant under the provisions of Section 47 and Schedule 4 of the Town and Country Planning (Scotland) Act 1997, and had been dismissed.
(c) 48 THOMSON STREET, DUNDEE - CHANGE OF USE FROM OFFICE TO DWELLINGHOUSE
Reference was made to Article I(i) of the minute of meeting of this Committee of 16th March, 2009, wherein the above proposal was refused planning permission because the Council considered that:-
(i) it failed to provide sufficient garden or amenity space which would result in a poor standard of development (Policy 4); and
(ii) the extensive use of obscure glass to avoid overlooking provided a poor standard of amenity for the proposed dwelling (Policy 4).
It was reported that the decision was appealed by the applicant under the provisions of Section 47 and Schedule 4 of the Town and Country Planning (Scotland) Act 1997, and had been dismissed.
