The minute of meeting of this Committee of 16th February, 2009 was held as read.

I PLANNING APPLICATIONS

 

(a)                                       09-00067-FUL - LAND ADJACENT TO WHITTON PARK, ARBROATH ROAD - ERECTION OF TWO PORTACABINS TO BE USED AS CHANGING FACILITIES - FOR DUNDEE EAST COMMUNITY SPORTS CLUB

 

Councillor McCready declared a non-financial interest in this item by virtue of having been present at meetings wherein the project was discussed, in his capacity as Chair of Dundee City Sports Council and Convener of Leisure, Arts and Communities Committee.

 

The Committee acceded to requests which had been received for deputations to address the Committee both in support of and relative to objections to the above application. After both deputations had stated their case and answered questions from members of the Committee, they were thanked for their attendance and withdrew.

 

Thereafter, having considered objections received, the Committee approved the application subject to the conditions recommended by the Director of Planning and Transportation.

 

(b)                                       09-00093-FUL - MONYMUSK PARK, ARBROATH ROAD - ERECTION OF TWO PORTACABIN CHANGING UNITS - FOR DUNDEE UNITED SPORTS CLUB

After considering objections received, the Committee approved the application subject to the conditions recommended by the Director of Planning and Transportation.

 

(d)                                        08-00894-FUL - 6 ADELAIDE PLACE - ERECTION OF REPLACEMENT PORCH, CONSTRUCTION OF ACCESS RAMP, INSTALLATION OF TWO ROOF WINDOWS AND ERECTION OF FENCE - FOR THE CONGREGATIONAL BOARD OF ST DAVID'S HIGH KIRK

 

After considering objections received, the Committee approved the application subject to the conditions recommended by the Director of Planning and Transportation.

 

(e)                                        09-00015-FUL - TIVOLI, 20 BONNYBANK ROAD - DEMOLITION OF SNOOKER CLUB - ERECTION OF EIGHT TOWN HOUSES WITH ASSOCIATED CAR PARKING AND LANDSCAPING - FOR MR J CARROLL

 

It was reported that a request had been received for a deputation to address the Committee in support of the above application.

 

After considering objections received, the Committee approved the application subject to the conditions recommended by the Director of Planning and Transportation, and in the circumstances, declined to hear the deputation.

 

(f) 09-00020-ADV - 68-69 HIGH STREET - INSTALLATION OF ILLUMINATED SIGNAGE - FOR REDWOOD LEISURE

 

The Committee acceded to a request which had been received for a deputation to address the Committee in support of the above application. After the deputation had stated its case and answered questions from members of the Committee, it was thanked for its attendance and withdrew.

 

Thereafter, having considered objections received, the Committee refused the application on the grounds that the sign detracts from the character and appearance of the listed building on which it has been erected and from the character and appearance of the Central Area Conservation Area by reason of its design, materials and method of illumination and its location directly above another projecting sign, resulting in visual clutter on this prominent listed building.

 

(g) 09-00032-COU - GULISTAN TANDOORI RESTAURANT, QUEEN STREET, BROUGHTY FERRY - CHANGE OF USE FROM SNOOKER CLUB TO RESTAURANT - FOR MR MOHAMMED

 

It was reported that a request had been received for a deputation to address the Committee in support of the above application.

 

After considering objections received, the Committee approved the application subject to the conditions recommended by the Director of Planning and Transportation, and in the circumstances, declined to hear the deputation.

 

(h)                                       09-00056-FUL - 49 GOTTERSTONE DRIVE - ALTERATION/EXTENSIONS TO DWELLINGHOUSE - FOR MR AND MRS SAEED

 

It was reported that a request had been received for a deputation to address the Committee in support of the above application.

 

After considering objections received, the Committee approved the application subject to the conditions recommended by the Director of Planning and Transportation, and in the circumstances, declined to hear the deputation.

 

(i) 08-00856-FUL - 48 THOMSON STREET - CHANGE OF USE FROM OFFICE TO DWELLINGHOUSE - FOR ARCHID

 

It was reported that a request had been received for a deputation to address the Committee in support of the above application. After the deputation had stated its case and answered questions from members of the Committee, it was thanked for its attendance and withdrew.

 

Thereafter, having considered objections received, the Committee refused the application on the grounds that:-

 

(i) the proposal fails to comply with Policy 4 of the Dundee Local Plan Review 2005 as it fails to provide sufficient garden or amenity space which would result in a poor standard of development. There are no material considerations that would justify a decision contrary to the provisions of the Development Plan; and

 

(ii) the proposal fails to comply with Policy 4 of the Dundee Local Plan Review 2005 as in mitigating the potential for overlooking to the east by the use of obscure glass, this results in a poor standard of amenity for the proposed dwelling. There are no material considerations that would justify a decision contrary to the provisions of the Development Plan.

 

(j) 08-00597-COU - UNIT 5A, KINGSWAY PARK, WHITTLE PLACE - CHANGE OF USE FROM WAREHOUSE/LIGHT INDUSTRIAL UNIT TO CAR HIRE OFFICE - FOR HERTZ EUROPE LTD

 

The Committee approved the application subject to the conditions recommended by the Director of Planning and Transportation.

 

(k) 08-00853-FUL - LAND TO NORTH AND SOUTH OF DONALD'S LANE - CHANGE OF HOUSE TYPE AND LEVELS AT PLOTS 17, 70 AND 22 - FOR H & H PROPERTIES (UK) LTD

 

The Committee approved the application subject to the conditions recommended by the Director of Planning and Transportation.

 

(l) 09-00089-FUL - 11 ALBANY PLACE, BROUGHTY FERRY - PROPOSED EXTENSION TO SIDE/REAR OF EXISTING BUILDING - FOR CLIVE GORDON AND ALLISON HONEYMAN

 

After considering objections received, the Committee approved the application subject to the conditions recommended by the Director of Planning and Transportation.

 

II AMENDMENTS TO THE SCHEME OF DELEGATION ON DEVELOPMENT QUALITY MATTERS

 

On a reference to Article VIII of the minute of meeting of the Policy and Resources Committee of 9th February, 2009, there was submitted and noted Report No 101-2009 by the Director of Planning and Transportation.

 

III REVISION OF CIRCULAR 12/1996 - PLANNING AGREEMENTS

 

There was submitted Report No 66-2009 by the Director of Planning and Transportation seeking the views of the Council in response to the consultation paper "Revision of Circular 12/1996, Planning Agreements" issued by the Scottish Government in December, 2008.

 

The Committee agreed to:-

 

(a) endorse the recommendations contained in Appendix A to the report as the Council's formal response to the consultation paper; and

 

(b) authorise the Director of Planning and Transportation to issue the formal response to the Scottish Government by 27th March, 2009.
