After considering objections received, the Committee approved the application subject to the conditions recommended by the Director of Planning and Transportation.
(h) 08-00168-FUL - 227 ARBROATH ROAD - FORMATION OF DRIVEWAY AND PAVEMENT CROSSING - FOR MRS A BURNS
Councillors McCready, Andrew Dawson and Will Dawson declared a non-financial interest in this item by virtue of knowing the applicant, and Councillor Morrow declared a non-financial interest by virtue of knowing one of the objectors, and they took no part in the discussion thereof.
The Committee acceded to a request which had been received for a deputation to address the Committee relative to objections to the above application. After the deputation had stated its case and answered questions from members of the Committee, it was thanked for its attendance and withdrew.
Thereafter, having considered objections received, the Committee approved the application subject to the conditions recommended by the Director of Planning and Transportation.
(i) 08-00082-FUL - 409 BROOK STREET, BROUGHTY FERRY - ERECTION OF A PIGEON LOFT - FOR A DUNCAN
The Committee acceded to a request which had been received for a deputation to address the Committee relative to objections to the above application. After the deputation had stated its case and answered questions from members of the Committee, it was thanked for its attendance and withdrew.
Thereafter, the Committee refused the application on the grounds that:-
(i) the development, because of the size of the structure and the keeping of such a large number of birds in a confined area, adversely impacts on the amenities of the occupiers of neighbouring dwellings by reason of noise and disturbance from flying pigeons and the overshadowing of adjoining gardens to the north and east. For these reasons, the development contravenes Policy 1 of the adopted Dundee Local Plan Review 2005 and there are no material considerations that would lead to the approval of the development contrary to this policy; and
(ii) the development dominates the garden area attached to the dwelling at 409 Brook Street and is of an excessive size for the area of land available, and is therefore contrary to Policy 1 of the adopted Dundee Local Plan Review 2005 and there are no material considerations that would lead to the approval of the development contrary to this policy.
II PERFORMANCE INDICATORS FOR DEVELOPMENT QUALITY 2007/2008
There was submitted Report No 234-2008 by the Director of Planning and Transportation outlining aspects of Development Quality performance for the year 2007/2008 in relation to Scottish Government targets and Key Performance Indicators from the Planning and Transportation Service Plan 2007-2011.
The Committee agreed to:-
(a) note the trends in performance of the Development Quality service;
(b) reaffirm the approach to quality of planning decision making as its predominant requirement while at the same time seeking the adoption of any measures which will increase the speed of decision and further improve the standard of service to customers;
(c) acknowledge the major challenge which the Development Quality service faces in the future in maintaining levels of performance in the face of the issues raised in this report and, in particular, the present and projected increase in the complexity of the development management process as introduced by the Planning etc (Scotland) Act 2006; and
(d) authorise the Director of Planning and Transportation to review the levels and management of resources for development management when further details relating to the implementation of the Act are known following the current period of consultation and to report to Committee with recommendations in due course.
III PLANNING APPEALS PERFORMANCE 2007/2008
There was submitted Report No 236-2008 by the Director of Planning and Transportation advising the Committee of the Council's planning appeals performance for the year 2007/2008.
The Committee noted the contents of the report.
IV PLANNING ENFORCEMENT AND TREE PROTECTION PERFORMANCE 2007/2008
There was submitted Report No 238-2008 by the Director of Planning and Transportation advising the Committee of the nature and extent of planning enforcement activity for the year 2007/2008, together with information for the same period on tree preservation work.
The Committee noted the contents of the report and reaffirmed its approach to planning enforcement and tree preservation.
V PLANNING APPEAL DECISION - 2-4 HIGH STREET, ADVERTISEMENT CONSENT FOR ONE DOUBLE SIDED FREE STANDINGADVERTISEMENT UNIT
There was submitted Agenda Note AN92-2008 making reference to Article 1(q) of the minute of meeting of this Committee of 15th October, 2007, wherein the above proposal was refused Advertisement Consent because members considered that the proposal would have an adverse impact on the amenity of the locality and the structure would be likely to have an adverse impact on public safety given the heavily trafficked road and traffic conditions, contrary to Policy 63 of the Dundee Local Plan Review 2005.
It is reported that the decision was subsequently appealed by the applicant under the provisions of Regulation 21 of the Town and Country (Control of Advertisements) (Scotland) Regulations 1984, and had been upheld subject to the standard conditions for advertisement consent set out in the regulations plus other conditions relating to the precise positioning of the unit and its glazing and reglazing.
VI BUILDING (SCOTLAND) ACT 2003 - SECTION 29-30 - DANGEROUS BUILDINGS
There was submitted Report No 233-2008 by the Director of Planning and Transportation advising the Committee of action taken in dealing with dangerous buildings during the month of March 2008.
The Committee noted the contents of the report.
