The minute of meeting of this Committee of 10th March, 2008 was held as read.

 

Unless marked thus * all items stand delegated.

 

Prior to the commencement of business, the Convener made reference to the imminent retirement of Alan Lewis, Assistant Head of Transportation and thanked him for his many years of service.

 

I DUNDEE LOCAL PLAN REVIEW - PLANNING ADVICE ON WASTE MANAGEMENT

 

There was submitted Report No 196-2008 by the Director of Planning and Transportation seeking agreement to the Local Plan Planning Advice on Waste Management detailed in the report.

 

The Committee agreed:-

 

(a) to adopt the Local Plan Planning Advice on Waste Management contained in the Appendix to the report;

 

(b) to remit the Director of Planning and Transportation to circulate copies of the Planning Advice to developers, architects and other relevant parties; and

 

(c) to refer the Planning Advice to the Development Quality Committee as a material consideration in the determination of future planning applications.

 

II MACALPINE PRIMARY SCHOOL - SITE PLANNING BRIEF

 

There was submitted Report No 194-2008 by the Director of Planning and Transportation seeking approval of a Draft Site Planning Brief for part of the site of the former Macalpine Primary School, St Leonard Place, as the basis of consultation with the local community and interested parties.

 

The Committee agreed:-

 

(a) to approve the Draft Site Planning Brief for consultation purposes, subject to the deletion of all reference to private housing in the first bullet point of Section 4.5, in the main report and in Appendix 1, Introduction, paragraph 3, and reference to owner/occupied in the Housing Type/Mix paragraph on Page 4, and their replacement by:-

"Promoting a mix of house type and size including some terraced and semi-detached houses".

"Housing is the prevailing use in the surrounding area and is the preferred use for this site. The opportunity exists to provide a mix of house types and sizes which will create affordability, choice and in an appropriate layout, add interest to the development as a whole".

"the site is located within a Suburban area in the Dundee Local Plan Review 2005 and in accordance with the Local Plan Appendix 1 standards it should be developed with houses only. To create a diverse environment and to add further choice to the City's housing market the development will provide a mix of house types and sizes with a minimum of 40% semi-detached and/or terraced houses. Appendix 1 of the Local Plan requires 75% of housing in new developments to contain, as a minimum, three or more bedrooms or to have a minimum gross internal floor area of 100 square metres".

 

(b) to remit the Director of Planning and Transportation to consult with the local communities and interested parties on the Draft Site Planning Brief; and

 

(c) to remit the Director of Planning and Transportation to report back on the results of the consultation at the August Committee meeting.

 

III CAPITAL PLAN 2008/2011 - HOUSING FOOTPATH REPAIRS

 

There was submitted Joint Report No 203-2008 by the Director of Planning and Transportation and Director of Housing updating the Committee on progress with the City-wide project to improve the condition of Housing footpaths through the implementation of various repair programmes, and to seek authority to carry out further programmes of footpath repairs over the period 2008/2011.

 

The Committee agreed:-

 

(a) to note the content of the report and agree the proposed prioritisation of Housing areas to be targeted for footpath upgrading as detailed in the report; and

 

(b) to authorise the City Engineer to have this work undertaken under the Maintenance Partnership Agreement with Tayside Contracts.

 

IV PROPOSED MULTI-STOREY CAR PARK, ALLAN STREET

 

There was submitted Report No 201-2008 by the Director of Planning and Transportation, outlining proposals to design and construct a multi-storey car parking facility at Allan Street to replace the current surface level parking facility which would be lost due to the redevelopment proposals at the site.

 

The Committee approved the provision of a circa 500 space, secure multi-storey car park including infrastructure for a single 7,000 sq ft retail unit to be completed to coincide with the opening of the new Olympia leisure facility.

 

V CONFIRMATION OF TREE PRESERVATION ORDERS

 

There was submitted Agenda Note AN60-2008 relative to the undernoted proposed Tree Preservation Orders:-

 

(a) 14/2007 - LAND AT 15 AND 19 DUDHOPE TERRACE (DUDHOPE HOUSE), DUNDEE

 

It was reported that on 14th December, 2007, the Council had made a provisional Tree Preservation Order on the above-mentioned site in order to protect and preserve the arboreal amenity of the area, and no objections had been received against this Order.

 

(b) 11/2007 - LAND AT 2-14 BROOK CLOSE AND 1-20 BROOK GARDENS, DUNDEE

 

It was reported that on 17th December, 2007, the Council had made a provisional Tree Preservation Order on the above-mentioned site in order to enhance and protect the existing and future treescape of the area, and no objections had been received against this Order.

 

(c) 13/2007 - 91 DUNDEE ROAD, BROUGHTY FERRY

 

It was reported that on 12th December, 2007, the Council had made a provisional Tree Preservation Order on the above-mentioned site in order to protect trees from future development of the site and to protect and preserve the arboreal amenity of the area, and no objections had been received against this Order.

 

(d) 01/2008 - LAND AT THE FRIARY, 8-18 TULLIDEPH ROAD, DUNDEE

 

It was reported that on 8th January, 2008, the Council made a provisional Tree Preservation Order on the above-mentioned site in order to protect and preserve the arboreal amenity of the area.

 

The Committee noted the terms of the one objection received, and the Council's response thereto.

 

The Committee authorised the Depute Chief Executive (Support Services) and the Director of Planning and Transportation to undertake the necessary procedures and confirm the Tree Preservation Orders detailed above.

 

VI DUNDEE STATION FOOTBRIDGE REMOVAL

 

There was submitted Agenda Note AN61-2008, making reference to Article V of the minute of meeting of this Committee of 13th August, 2007, wherein the Committee agreed that the Council enter into a Basic Asset Protection Agreement with Network Rail for the removal of the final section of the footbridge and offers be sought for the works.

 

It was reported that an offer of 68,154 had been negotiated with AMCO who were currently on site completing the Dock Street tunnel works. A comparison of costs was undertaken and shown to be in line with previous costs obtained in competition and the City Engineer recommended that the offer be accepted. In addition to the works costs, an allowance of 11,846 for landscaping and lighting works was required. A contingency allowance of 10,000 plus supervision by Network Rail, and professional fees by the City Engineer of 5,000 gave an overall project total of 95,000.

 

The Committee approved acceptance of this offer and this expenditure.

The Committee approved the applications subject to conditions agreed with the applicants, and further agreed that on satisfactory completion of these roads and, if so requested by the applicants, they be entered on the List of Public Roads for the purposes of management and maintenance in terms of the Roads (Scotland) Act 1984.

 

VIII TRAFFIC ORDERS

 

There was submitted Agenda Note AN63-2008 detailing the undernoted proposed Traffic Orders:-

 

(a) DUNDEE CITY COUNCIL (CITY QUAY AREA, DUNDEE) (VARIATION OF WAITING RESTRICTIONS) ORDER 2008

 

Reference was made to Article IV of the minute of meeting of this Committee of 12th November, 2007, wherein the Committee authorised the preparation of an Order to relieve congestion by controlling parking to safe areas, to restrict the length of stay in the available parking spaces to deter commuter parking, to provide an opportunity for visitor parking to residents and to the Frigate Unicorn, and to give the residents the opportunity to purchase a resident's parking permit for the pay and display spaces.

 

It was reported that the proposed Order was duly drafted and during the statutory consultation period, no adverse comments were received.

 

The Committee therefore authorised publication of the Order.

 

(b) DUNDEE CITY COUNCIL (TOM McDONALD AVENUE AND KIRSTY SEMPLE WAY, DUNDEE) (BUS ONLY FACILITIES) ORDER 2008

 

Reference was made to Article V of the minute of meeting of this Committee of 12th November, 2007, wherein the Committee authorised the preparation of an Order to create a bus facility whilst still protecting access for emergency vehicles to the Accident and Emergency Unit at Ninewells Hospital.

 

It was reported that the proposed Order was duly drafted and during the statutory consultation period, no adverse comments were received. Comments were received from the Chief Constable who agreed with the proposals, in principle, but had also noted his concerns.

 

The Committee therefore authorised publication of the Order.

 

The Committee resolved under Section 50(A)(4) of the Local Government (Scotland) Act 1973 that the press and public be excluded from the meeting for the undernoted item of business on the grounds that it involved the likely disclosure of exempt information as defined in paragraphs 6, 8 and 9 of Part I of Schedule 7A of the Act.

 

IX PROPOSED IMPROVEMENTS TO DYKES OF GRAY ROAD

 

There was submitted Report No 206-2008 by the Director of Planning and Transportation outlining proposals to improve the road infrastructure in the Western Gateway at Dykes of Gray Road, in order to accommodate the strategic physical Western Village development and the proposed new housing.

 

The Committee agreed:-

 

(a) to approve the delivery of a road improvement scheme at Dykes of Gray Road through a partnership with Tayside Contracts and to incorporate within the adjacent design and construction phase the improved service infrastructure necessary to service the proposed developments; and

 

(b) to authorise the Director of Planning and Transportation to seek agreements under Section 31 and Section 48 of the Roads (Scotland) Act 1984, these agreements to be between the roads authority and adjacent land owners for the purposes of the road improvements and associated drainage.
