The Sub-Committee resolved under Section 50(A)(4) of the Local Government (Scotland) Act 1973 that the press and public be excluded from the meeting for the undernoted item of business on the grounds that it involved the likely disclosure of exempt information as defined in paragraph 1 of Part I of Schedule 7A of the Act.

 

SOCIAL WORK DEPARTMENT - APPEAL AGAINST DISMISSAL (PA66)

 

It was reported that an appeal against dismissal had been submitted from an employee of the Social Work Department.

 

The Sub-Committee heard the Council's representative and witnesses and thereafter, the Appellant and her representative.

 

After questions had been put and answers given by both parties to each other and the witnesses, and by members of the Sub-Committee, the parties withdrew.

 

Thereafter, following careful consideration of all the information, the Sub-Committee agreed that the grounds of the appeal had not been substantiated and that the appeal be not upheld.

I MATTERS ARISING

 

(i) UPDATE ON ASSET MANAGEMENT PLAN

 

The Head of Finance advised the Sub-Committee that following discussions with the Convener, relevant Officers and External Auditor, the Asset Management Plan had been finalised. Thereafter, the Plan was approved by the Policy and Resources Committee on 10th December, 2007.

 

The Sub-Committee noted that Officers were now working to the actions contained within the approved Plan.

 

II MEMBERSHIP OF AUDIT AND RISK MANAGEMENT SUB-COMMITTEE

 

It was reported that Councillor Lynn had resigned from the Audit and Risk Management Sub-Committee and that the SNP Group had proposed that the vacancy be filled by Councillor Black.

 

The Sub-Committee agreed to suspend Standing Order No 45(2) to enable the proposed change to take place with immediate effect.

 

III INTERNAL AUDIT ANNUAL PLAN 2008/2009 AND UPDATE ON INTERNAL AUDIT ANNUAL PLAN 2007/2008

 

There was submitted Report No 74-2008 by the Chief Internal Auditor advising the Sub-Committee of the Internal Audit Annual Plan for the 2008/2009 financial year as detailed at Appendix A to the report and providing an update on the Internal Audit Annual Plan 2007/2008.

 

The Sub-Committee noted the information contained within the report.

 

IV INTERNAL AUDIT REPORTS

 

There was submitted Report No 75-2008 enclosed by the Chief Internal Auditor providing the Sub-Committee with a summary of the Internal Audit Reports finalised since the last Sub-Committee.

 

The Sub-Committee noted the information contained within the report.

V INTERNAL BENCHMARKING OF INSURANCE LOSSES

 

There was submitted Report No 68-2008 by the Risk and Business Continuity Manager providing the Sub-Committee with comparative claims figures for the financial years 2004/2005, 2005/2006, 2006/2007 and 2007/2008 to date.

 

The Sub-Committee agreed to:-

 

(i) note the claims data provided;

 

(ii) continue to monitor the progress of the claims data presented; and

 

(iii) continue to support Risk Management activity to control self-insured losses.
