At a HEARING of the DUNDEE CITY LICENSING BOARD held at Dundee on 12th December, 2006.

The Board heard from the Chief Constable's representative, an agent on behalf of the licensee and the Board's legal adviser.
The Chairman moved that the licensee was no longer fit and proper.
As an amendment, Councillor Fitzpatrick moved that the licensee was fit and proper.
On a division, there voted for the motion the Chairman and Councillors Dick and Wallace (3); and for the amendment - Councillors Hind, Fitzpatrick and Dawson (3) - whereupon there being a parity of votes, the Chairman voted in favour of the motion which was declared carried.
The Chairman moved that the licence be suspended for one year.
As an amendment, Councillor Hind moved that a warning be issued.
On a division, there voted for the motion the Chairman (1); and for the amendment - Councillors Hind, Dick, Fitzpatrick, Dawson and Wallace (5) - whereupon the amendment was declared carried.
