At an ADJOURNED MEETING of the DUNDEE CITY LICENSING BOARD held at Dundee on 16th February 2006.

The minute of meeting of the Licensing Board of 19th January 2006 was held as read.

I PROHIBITION OF SMOKING IN CERTAIN PREMISES (SCOTLAND) REGULATIONS 2006

Reference was made to Article III of the minute of the meeting of this Board of 19th January 2006.

There was submitted Report No 155-2006 by the Clerk seeking to formulate a policy on external drinking/smoking areas following the introduction of the above regulations on 26th March 2006.

The Board agreed that:-

(i) occasional licences for pavement cafes be restricted to the period March to October as at present,

(ii) pavement cafe licences be extended to 9 pm and,

(iii) a further report in conjunction with the Planning and Transportation Department taking into account any further changes in pavement cafe policy be submitted to a future meeting.

II BETTING GAMING AND LOTTERIES ACT 1963

(a) APPLICATION FOR BETTING OFFICE LICENCE

The Board, having heard from an agent on behalf of an objector and from an agent on behalf of the applicant, agreed to refuse the application on the grounds of demand and location.

III LICENSING (SCOTLAND) ACT 1976

(a) APPLICATIONS FOR RENEWAL OF LICENCES

The Board agreed to grant the above application subject to the following conditions:-

(i) a minimum charge for entry to the premises, applicable to persons eighteen years of age and over, should be charged; this charge shall be fixed by the Licensing Board at its meeting in June of each year for the year beginning 1st July and ending 30th June; and

(ii) the above minimum charge shall not be offset in any way; for the avoidance of doubt offsetting the minimum charge includes, but is not limited to (a) the issue of complimentary tickets or vouchers, and (b) the advance purchase of tickets granting entry on more than one evening.

The Board agreed to grant the above application.

The Board, having heard from an agent on behalf of the applicant, agreed to grant the above application subject to an inspection by Environmental Health and Consumer Protection.

(b) APPLICATION FOR CONFIRMATION

The Board agreed to grant the above application.

(c) APPLICATION FOR PERMANENT TRANSFER - SECTION 25(1)

The Board noted that the above application had been withdrawn.

(d) APPLICATION FOR PERMANENT TRANSFER - SECTION 25(1)(B)

The Lord Provost declared a non-financial interest by virtue of being a member of the Board of Dundee Ice Arena.

The Board agreed to grant the above application.

(e) APPLICATION FOR REGULAR EXTENSION OF PERMITTED HOURS

The Board, having heard from the applicant on their own behalf, agreed to grant the above application from 11pm to 3.30am Mondays to Sundays for the provision of late night entertainment subject to the attachment of the standard conditions.

(f) APPLICATION FOR MUSICAL CONSENT

The Board noted that the above application had been withdrawn.

(g) APPLICATIONS FOR THE GRANT OF CHILDREN'S CERTIFICATES

The Board, having heard from the applicant on their own behalf, agreed to grant the above application from 5 pm to 8 pm Mondays to Thursdays from 12 pm to 8 pm Fridays and Saturdays and from 12.30 pm to 8 pm Sundays in part of the lounge only subject to the following condition:-

During the hours when this Certificate is in force, smoking shall be prohibited in all parts of the licensed premises of which the premises specified in the application for the Certificate forms part.

The Board, having heard from the applicant on their own behalf, agreed to grant the above application from 11 am to 8 pm Mondays to Saturdays and 12.30 pm to 8 pm Sundays in the restaurant subject to the following condition:-

During the hours when this Certificate is in force, smoking shall be prohibited in all parts of the licensed premises of which the premises specified in the application for the Certificate forms part.

(h) APPLICATION OF GRANT (INCLUDING PROVISIONAL GRANT) OF LICENCE

The Board noted that the above application had been withdrawn.
