The minute of meeting of the Licensing Board of 17th November, 2005 was held as read.
I MEMBERSHIP
It was reported that at the meeting of Dundee City Council held on 9th January, 2006, Councillors Hind and Dick were appointed to the Licensing Board following the resignations of Bailie Wright and Councillor Grant.
II MEETINGS OF LICENSING BOARD
The Board agreed that the statutory quarterly meetings of the Licensing Board for 2006/2007 take place on the following dates:-
23rd March, 2006
29th June, 2006
19th October, 2006
18th January, 2007
III PROHIBITION OF SMOKING IN CERTAIN PREMISES (SCOTLAND) REGULATIONS 2006
There was submitted Report No 86-2006 by the Clerk formulating policy on external drinking/smoking areas following the introduction of the Prohibition of Smoking in Certain Premises (Scotland) Regulations 2006.
The Chairman moved adoption of Option 1 that applications for such areas be generally not supported and to review this position after six months.
As an amendment, Councillor FitzPatrick moved adoption of Option 4 that there be no policy and that each application be considered on its merits, removal of Section 6.4 on Pavement Cafes and that a report on pavement cafe policy be submitted to a future meeting.
On a division, there voted for the motion - the Chairman, Lord Provost, Bailies Corrigan and Mackie and Councillor Dick (5); and for the amendment, Councillors Hind, Regan, FitzPatrick, Don, Dawson and Wallace (6) - whereupon the amendment was declared carried.
The Chairman reminded licensees that whilst the ban on smoking in public places takes effect on 26th March, 2006, should they wish to have children in their premises, they must still apply for a Children's Certificate.
IV LICENSING BOARD REGULATIONS - AMENDMENT
Following consultation with the Consultative Forum, the Board agreed that Regulation 20 be amended to include a reference to applications for renewal of licence and that this would have effect from the June 2006 meeting of the Licensing Board.
V GAMING BOARD ADVICE FOR 2006
The Board noted the advice from the Gaming Board for 2006.
