I DRAFT SCOTTISH PLANNING POLICY 8 - TOWN CENTRES
There was submitted Report No 706-2005 by the Director of Planning and Transportation seeking the Committee's agreement to a response to the Scottish Executive's consultation on Draft Scottish Planning Policy 8: Town Centres (SPP8).
The Committee agreed that the Appendix to this report be forwarded to the Scottish Executive as the City Council's response to the Scottish Executive's consultation on Draft SPP8.
II FLOOD PREVENTION AND LAND DRAINAGE (SCOTLAND) ACT 1997
There was submitted Report No 702-2005 by the Director of Planning and Transportation advising the Committee on the completion of the fifth biennial report on flooding and seeking approval for the publication of this Report as required by the Flood Prevention and Land Drainage (Scotland) Act 1997.
The Committee agreed to
(i) note the content of the fifth biennial report on flooding; and
(ii) authorise the publication of the report.
III SCOTTISH TRANSPORT AWARDS AND PUBLIC TRANSPORT INITIATIVES
There was submitted Report No 701-2005 by the Director of Planning and Transportation informing the Committee of Dundee City Council's success at the recent Scottish Transport Awards and the implementation of the final phase of "SmartBus" public transport initiatives in the City.
The Committee noted the success of Dundee City Council at the recent Scottish Transport Awards, the positive reaction by the travelling public and approved the continued implementation of "SmartBus" public transport initiatives.
IV VACANT AND DERELICT LAND FUND: DUNSINANE INDUSTRIAL ESTATE
There was submitted Agenda Note AN455-2005 whereby reference was made to Item VIII of this Committee of 16th May, 2005 which outlined the programme of works proposed under the Vacant and Derelict Land Fund 2005/06. This included an allowance to remove some of the dereliction at Dunsinane Industrial Estate.
The revitalisation of Dunsinane Industrial Estate for employment purposes is a key objective of the Dundee Local Plan Review, adopted on 1st August, 2005. To assist with this, the principal land and property owner within the Estate is undertaking works to demolish and clear derelict factories and create sites for potential inward investment opportunities.
Dunsinane Estates Limited tendered the following works:
7 demolition, asbestos removal and clearance of Lindegard factory and ex Samuel Bruce site (contract awarded to Central Demolition Limited - 95,000);
7 demolition, asbestos removal and clearance of ex London Rubber Company factory (contract awarded to Central Demolition Limited - 62,000); and
7 scraping, levelling and disposal of waste from former Valentines site (contract awarded to Delson Contracts Ltd - 38,000)
The total cost of these works would be 195,000. The Committee agreed that a grant of 97,500, equal to 50% of the costs, be awarded to Dunsinane Estates Limited under the Vacant and Derelict Land Fund to assist with the works, to be paid upon completion.
Members also noted that the Director of Planning and Transportation was in discussion with the principal landowner regarding the production of a masterplan for the regeneration of Dunsinane Industrial Estate as required by the Dundee Local Plan Review.
V REGIONAL TRANSPORTATION PARTNERSHIP (ESTABLISHMENT, MEMBERSHIP AND CONSTITUTION) (SCOTLAND) ORDER 2005
There was submitted Agenda Note AN458-2005 making reference to Article VIII of the minute of meeting of this Committee of 20th June, 2005. The Committee confirmed its agreement to appoint the Convener and Vice Convener as this Council's representatives to the Regional Transportation Partnership and noted that subsequently, the Scottish Parliament had approved the Order, including a provision which increased Dundee City Council's representatives to three.
The Convener, seconded by Councillor Keenan moved that Councillor Wallace be appointed as a third representative. As an amendment, Councillor Will Dawson, seconded by Councillor FitzPatrick moved that Councillor Don be appointed as a third representative.
On a division there voted for the motion - the Convener, Lord Provost Letford, Bailies Wright, Powrie and Mackie and Councillors Shimi, Councillor Keenan, Councillor Regan, Bailie Farquhar, Sturrock, Hind, Morrow, Macpherson, Wallace, Webster and Scott (16); and for the amendment - Bailies Corrigan and Borthwick and Councillors Don, Duncan, Beattie, Andrew Dawson, Sawers, FitzPatrick, Roberts, Barrie, Will Dawson (11) - whereupon the motion was declared carried and Councillor Wallace was appointed as a third representative to the Regional Transportation Partnership.
VI CONFIRMATION OF TREE PRESERVATION ORDERS
There was submitted Agenda Note AN459-2005 advising of the undernoted Tree Preservation Orders:-
(i) 08/2005 - Unit 1, Brunel Road, Wester Gourdie Industrial Estate, Dundee
The Committee noted that on 9th August, 2005 the Council had made a provisional Tree Preservation Order on the abovementioned site, due to its arboreal and visual amenity. No objections had been received by the Council to this Tree Preservation Order.
(ii) 09/2005 - Ground to West of Miller's Wynd, Dundee
The Committee noted that on 2nd September 2005 the Council had made a provisional Tree Preservation Order on the above mentioned site, due to its arboreal and visual amenity. No objections had been received by the Council to this Tree Preservation Order.
The Committee authorised the Depute Chief Executive (Support Services) and the Director of Planning and Transportation to undertake the necessary procedures and confirm both Tree Preservation Orders.

VIII NEW ROADS
There were submitted the undernoted applications for road construction consent. The Committee approved the applications subject to conditions which had been agreed with the applicants:-

It was further agreed that, on satisfactory completion of these roads and, if so requested by the applicants, they be entered on the List of Public Roads for the purposes of management and maintenance in terms of the Roads (Scotland) Act 1984.
IX TENDERS RECEIVED
There was submitted Report No 699-2005 by the Director of Planning and Transportation detailing tenders received in respect of the undernoted contracts.
(i) Greenmarket Multi-Storey Car park - New Build
The Committee agreed to accept the lowest offer by Laing O'Rourke Scotland Limited amounting to 5,386,456.13 to which required to be added allowances of 294,630.00 for Non Contract allowances and 662,000.00 for fees, making a total expenditure of 6,343,086.13.
(ii) Dundee City Region Shopping Study
The Committee agreed to accept the offer by Colliers CRE amounting to 55,970.00.
(iii) Broughty Ferry Environmental Improvements
The Committee agreed to accept the lowest offer by Torith Limited amounting to 334,407.00 to which required to be added allowances amounting to 65,593.00 giving a total expenditure of 400,000.00.
X DUNDEE CENTRAL WATERFRONT - DOCK STREET TUNNEL
There was submitted Report No 717-2005 by the Director of Planning and Transportation advising the Committee on progress to date with investigations and design of the Dock Street Tunnel Strengthening project and seeking authority to proceed as recommended.
The Committee agreed to note the contents of this report and;
(i) authorise the Depute Chief Executive (Support Services) to agree the final wording and on behalf of Dundee City Council enter into an Asset Protection Agreement with Network Rail; and
(ii) approve the expenditure of 276,000 required for the Asset Protection Agreement and to complete new investigation and design work to establish the Agreed Maximum Price (AMP).
