The minute of meeting of this Committee of 20th June 2005 was held as read.

I BROOMFIELD ROAD AND KINNOULL STREET - PROHIBITION OF DRIVING

 

There was submitted Report No 426-2005 by the Director of Planning and Transportation relative to the proposed closure to vehicular traffic of lengths of Broomfield Road and Kinnoull Road.

 

The Committee approved the preparation of an Order to prohibit driving on a length of Broomfield Road and Kinnoull Road.

 

II TOLLED BRIDGES REVIEW - PHASE TWO CONSULTATION

 

There was submitted Report No 448-2005 by the Director of Planning and Transportation outlining the purpose of the Scottish Executive's Tolled Bridges Review - Phase Two Consultation and Dundee City Council's response thereto.

 

The Committee agreed that:-

 

(i) the purpose of the consultation be noted; and

 

(ii) Dundee City Council's response as detailed in Appendix A to the report be approved.

 

III DUNDEE CITY COUNCIL (BROOK STREET AREA AND FISHER STREET, BROUGHTY FERRY, DUNDEE)(VARIATION OF TRAFFIC REGULATIONS) ORDER 2005

 

Councillor Webster declared a non-financial interest in the part of this item that related to Fisher Street, by virtue of living in close proximity to Fisher Street.

 

The Committee acceded to a request which had been received for a deputation to address the Committee relative to objections to the Traffic Order. After the deputation had stated its case and answered questions from members it was thanked for its attendance and withdrew.

 

Thereafter, there was submitted Agenda Note AN303-2005 making reference to Article VI of the minute of meeting of this Committee of 25th October 2004, instructing and authorising the preparation of an Order to (1) allow more parking spaces both for general use and for the disabled in Brook Street between Fort Street and Gray Street at the expense of loading and unloading facilities, (2) adjust the waiting restrictions in Brook Street between Fort Street and Lawrence Street following the relocation of the police station, (3) convert the underused taxi rank east of Brown Street to limited waiting, (4) remove the underused taxi rank in Gray Street south of Queen Street, and (5) improve traffic circulation by reopening Fisher Street.

 

It was reported that the proposed Order was duly drafted and during the statutory consultation period no adverse comments were received.

 

Thereafter the Order was duly advertised and seven objections were received, all of which related to the reopening of Fisher Street.

 

It was now recommended that Fisher Street remain closed but the bollards made removable so that in the event of a temporary closure in King Street they could be removed to provide an alternative route.

 

The Committee agreed to make the Order with reference to the reopening of Fisher Street detailed above.

 

IV DUNDEE CITY COUNCIL (JAMAICA STREET, DUNDEE) (STOPPING-UP) ORDER 2005

 

There was submitted Agenda Note AN304-2005 making reference to Article XI of the minute of meeting of this Committee of 21st March 2005 wherein it was agreed to stop up lengths of roads and footpaths at Jamaica Street, Dundee to facilitate a new housing development on the site.

 

It was reported that the Order was duly prepared and advertised in the Dundee Courier and Advertiser and the Edinburgh Gazette, and the relevant statutory undertakers consulted. No objections were received.

 

The Committee therefore agreed to authorise and confirm the Stopping-Up Order, and authorise formal publication of the confirmation after which the Order would become operative.

 

V VACANT AND DERELICT LAND FUND 2005/06 - SITE OF FORMER JAMAICA WORKS AND LAND ATCARNEGIE STREET

 

There was submitted Agenda Note AN292-2005 making reference to Article VII of the minute of meeting of this Committee of 16th May 2005 which approved the overall programme for the Vacant and Derelict Land Fund (VDLF) for 2005/06 including land at Carnegie Street. It was reported that part of the site had been cleared by the Council and disposed to Hillcrest, but recent subsoil investigation had revealed unexpected contamination in several places which would cost an extra 75,000. In addition, the planning brief required a narrow treed green space along Carnegie Street to act as a barrier with the adjacent factory, set off the listed Church and be a green link with Hilltown Park. A minor widening of Carnegie Street was also required. Altogether, there would be substantial additional cost. Recognising this, a grant from the VDLF had been included in the programme for this year.

 

The Committee agreed that the grant from the VDLF should be 150,000 towards the cost of the open space, road widening and dealing with the contamination. This would be payable once site works in excess of 400,000 had been achieved and would be required by January 2006.

 

VI VACANT AND DERELICT LAND FUND - FORMER TAY SPINNERS FACTORY, ARBROATH ROAD - GRANT

 

There was submitted Agenda Note AN293-2005 whereby reference was made to Article VII of the minute of meeting of this Committee of 16th May 2005 which outlined the basic programme for utilising the Vacant and Derelict Land Fund in 2005/6 and included the above site identified for action in the programme agreed with the Scottish Executive.

It was reported that the tender costs obtained by the developer for the demolition and fagade retention had been 300,000. There had been costs associated with this that would not normally be incurred in respect of the retention of the listed fagade, fagade structural repairs, removal of a suspended floor, repairs to external finishes of the fagade and repair works to existing finishes in the original entrance lobby. The desire for streetscape enhancement added further to this. A development appraisal submitted by the developer indicated a need for support to achieve the desired development of at least 100,000. The development appraisal costs and assumptions are considered fair and reasonable and the costs associated with the listed fagade and the street works are confirmed to be in excess of 100,000.

 

The Committee agreed that a grant towards the abnormal costs associated with the demolition, listed fagade and streetscape works of 100,000 from the Vacant and Derelict Land Fund be made to the redevelopment of the former Tay Spinners factory. The grant would be payable in two instalments, 50,000 four weeks after approval and with evidence of the demolition contract started, and 50,000 payable when demolition works were completed, work to the listed fagade undertaken and development work on the new houses/flats started, all of which would be before March 2006.

 

VII TRANSFER OF CAR PARK, EAST SCOTSCRAIG LANE, DUNDEE

 

There was submitted Agenda Note AN294-2005 asking members to note that the above car park had been recently formed. The cost of these works had been funded from capital received from the sale of land in Ardler which was formerly owned by the City Council.

 

The car park was effectively an overspill car park for the Ardler Complex.

 

The Committee noted the above and agreed to authorise the transfer of this site to the Communities Department.

 

VIII CONFIRMATION OF TREE PRESERVATION ORDER NO 5/2005 - NORTH GRANGE FARM, ARBROATH ROAD,MONIFIETH

 

There was submitted Agenda Note AN295-2005 whereby members were asked to note that on 31st March 2005 the Council had made a provisional Tree Preservation Order on the above mentioned site, to protect two mature trees within the grounds of the property, due to their arboricultural amenity.

 

The Committee agreed to authorise the Depute Chief Executive (Support Services) and the Director of Planning and Transportation to undertake the necessary procedures and confirm the Tree Preservation Order.

 

IX CONFIRMATION OF TREE PRESERVATION ORDER - GROUND TO THE EAST OF KINGS CROSS ROAD, DUNDEE

 

There was submitted Agenda Note AN296-2005 whereby members were asked to note that on 16th March 2005 the Council had made a provisional Tree Preservation Order covering a further six trees at the above mentioned site. The Committee noted that these trees had been omitted from the original Tree Preservation Order 1/2005 that was made in relation to this site in January of this year. These Tree Preservation Orders had been made in response to the owner proceeding to implement an expired planning consent and at that time it was unclear from the survey if these six additional trees were contained within the boundaries of the site. A further inspection by the Council's Forestry Officer had confirmed these trees were within the boundaries and the Council considered these trees also merited protection due to their arboreal and visual amenity.

 

The Committee agreed to authorise the Depute Chief Executive (Support Services) and the Director of Planning and Transportation to undertake the necessary procedures and confirm the above Tree Preservation Order.

 

X CONFIRMATION OF TREE PRESERVATION ORDER NO 2/2005 - 26 CEDAR ROAD, DUNDEE

 

There was submitted Agenda Note AN297-2005 whereby members were asked to note that on 23rd March 2005, the Council had made a provisional Tree Preservation Order on the above mentioned site in order to protect thirteen mature trees within the grounds of the property, due to their arboricultural amenity.

 

The Committee agreed to authorise the Depute Chief Executive (Support Services) and the Director of Planning and Transportation to undertake the necessary procedures and confirm the Tree Preservation Order.

 

XI CONFIRMATION OF TREE PRESERVATION ORDER NO 3/2005 - ARMISTEAD HOUSE, 94 MONIFIETH ROAD,BROUGHTY FERRY, DUNDEE

 

There was submitted Agenda Note AN298-2005 whereby members were asked to note that on 23rd March 2005 the Council had made a provisional Tree Preservation Order on the above mentioned site in order to protect forty mature trees within the grounds of the property, due to their arboricultural amenity.

 

The Committee agreed to authorise the Depute Chief Executive (Support Services) and the Director of Planning and Transportation to undertake the necessary procedures and confirm the Tree Preservation Order.

 

XII MARYFIELD DRAFT SITE DEVELOPMENT BRIEF

 

There was submitted Agenda Note AN299-2005 whereby reference was made to Article I of the minute of meeting of this Committee of 20th June 2005, wherein approval was given to the Director of Planning and Transportation to proceed with external consultations on the abovementioned draft brief and to report back to Committee on completion of the consultation exercise.

 

It was reported that a copy of the draft Site Planning Brief and covering letter had been forwarded on the 22nd June 2005, with comments to be returned on or before the 15th August 2005, to the owners of adjacent and neighbouring properties and interested parties and Historic Scotland. In total, 114 letters and accompanying draft briefs were issued, and the response had been as follows:-

 

(a) the agent for Scottish Water had advised that they would make representation in due course;

 

(b) one letter had been received from residents of the area supporting the new garden ground and car parking standards if the site was to be developed with new housing and the use of sandstone as an appropriate cladding material to guard against the use of materials that are "cheap and incongruous": The draft brief encourages the use of high quality materials: the letter also suggested the introduction of a speed camera on the Forfar Road, an issue which was at present outwith the remit of the draft brief;

 

(c) one letter had been received from the National Playing Fields Association requesting that the redundant tennis courts on the site be made good: As the draft brief did not preclude any future use of the site other than retail and given the provision of tennis facilities at Baxter Park, Dalkeith Road and other leisure facilities at Dundee International Sports Complex and Baxter Park no revision has been made to the draft brief; and

 

(d) one email was received requesting clarification on the term of recreational and leisure facilities as a potential use of the site in order to stimulate a range of potential uses of the site, and clarification as to where on Walrond Street vehicular access can be gained.

 

It was noted that following the results of the consultation the draft brief remained unaltered.

The Committee therefore agreed to approve the Maryfield Depot Site Planning Brief to promote and enable the quality of redevelopment expected for the Category B Listed Maryfield Depot and associated site within the context of the Maryfield Conservation Area. Upon approval, the Site Planning Brief would become supplementary planning guidance to the Dundee City Council Finalised Local Plan Review 2005 as a material consideration in determining the planning application for the site.

XIV GREENMARKET MULTI-STOREY CAR PARK - PREPARATORY WORKS

 

There was submitted Agenda Note AN301-2005 advising that preparation of the design of Greenmarket Multi-Storey Car Park was well advanced with construction programmed to commence on site later this year.

 

It was reported that to ensure the main construction works commenced as programmed, preparatory works would be necessary to divert existing sewers and water mains from the footprint of the site. Raynesway Construction Limited were currently working for Scottish Enterprise Tayside providing the necessary infrastructure for the adjacent Digital Media Park.

 

The Committee agreed that authority be granted for the City Engineer to negotiate, and for the Depute Chief Executive (Support Services) to accept, a contract with Raynesway Construction Limited to undertake the necessary water and sewerage diversion works at a probable cost of 70,000, pending consultations with Scottish Water and completion of the detailed design. This contract would be negotiated on the basis of the tendered rates submitted to Scottish Enterprise Tayside and the cost of these works could be met from allowances within the Planning and Transportation Departments Capital Plan 2005/06.

 

It was noted that details of the negotiated contract would be reported to a future meeting of the Planning and Transportation Committee for information.

 

XV DUNDEE CITY COUNCIL (MENZIESHILL CONTROLLED PARKING ZONE AND DICKSON AVENUE AREA,DUNDEE) (VARIATION OF WAITING RESTRICTIONS) ORDER 2005

 

There was submitted Agenda Note AN311-2005 whereby reference was made to Article IV of the minute of meeting of this Committee of 24th May 2004 instructing and authorising the preparation of an Order to (1) create more visitor and overnight parking in Charleston Drive, (2) adjust the balance of residents and visitor parking in Dickson Avenue and Spey Drive to cater for the respective demands, (3) include Deveron Terrace and Deveron Crescent within the Controlled Parking Zone, (4) cater for long-term visitors to residents by introducing a scheme whereby a parking voucher can be purchased to allow use of the permit holders only spaces, (5) create a passing place in Earn Crescent, (6) relieve congestion in Dickson Avenue, and (7) afford protection for proposed pedestrian refuges in Charleston Drive and Dickson Avenue.

It was reported that the proposed Order was duly drafted and during the statutory consultation period, one objection was received. As a result of the objection, it was recommended that the Order be amended to include Deveron Crescent and Deveron Terrace as streets which qualify for the issue of a residents permit, but the proposed restrictions for these streets be deleted prior to the Order being advertised.

 

The Committee authorised publication of the Order subject to the amendments.

 

XVI DUNDEE CITY COUNCIL (BRIDGE STREET BRIDGE, BARNHILL, DUNDEE) (VARIATION OF WEIGHTLIMIT) ORDER 2005

 

There was submitted Agenda Note AN312-2005 whereby reference was made to Article V of the minute of meeting of this Committee of 21st February 2005 instructing and authorising the preparation of an Order to safeguard the structure of a weak bridge.

 

It was reported that the proposed Order had been duly drafted and during the statutory consultation period no adverse comments were received.

 

Thereafter, the Order was duly advertised and there were no objections.

 

The Committee therefore agreed to make the Order as advertised.

 

XVII DUNDEE CITY COUNCIL (ARDLER AND ST FERGUS PRIMARY SCHOOLS, DUNDEE) (VARIATION OFSCHOOL KEEP CLEAR) ORDER 2005

 

There was submitted Agenda Note AN313-2005 whereby reference was made to Article VII of the minute of meeting of this Committee of 21st March 2004 instructing and authorising the preparation of an Order to improve safety for school children by prohibiting parking at the school gates.

 

It was reported that the proposed Order had been duly drafted and during the statutory consultation period no adverse comments were received.

 

Thereafter, the Order was duly advertised and there were no objections.

 

The Committee therefore agreed to make the Order as advertised.

 

XVIII DUNDEE CITY COUNCIL (HALDANE AVENUE SERVICE ROAD, DUNDEE) (ONE-WAY TRAFFIC) ORDER 2005

 

There was submitted Agenda Note AN314-2005 whereby reference was made to Article X of the minute of meeting of this Committee of 21st March 2005 instructing and authorising the preparation of an Order to improve safety by eliminating vehicular conflicts in this narrow service road.

 

It was reported that the proposed Order had been duly drafted and during the statutory consultation period no adverse comments were received.

 

Thereafter the Order was duly advertised and there were no objections.
