The minute of meeting of the Board of 21st April 2005 was held as read.

I APPOINTMENT OF CHAIRMAN

 

Councillor Shimi moved that Bailie Powrie be appointed Chairman for the forthcoming year.

 

As an amendment, Councillor Fordyce moved that Bailie Corrigan be appointed Chairman.

 

On a division, there voted for the motion - the Lord Provost, Bailies Wright, Powrie and Mackie and Councillors Shimi, Grant and Wallace (7); and for the amendment - Bailie Corrigan and Councillors Dawson and Fordyce (3) - Councillor FitzPatrick being absent when the vote was taken - whereupon the motion was declared carried appointing Bailie Powrie as Chairman.

 

II NATIONAL LICENSING CONFERENCE 2005

 

It was reported that the above conference would be held in the Apex Hotel, Dundee on 31st August and 1st September 2005 at a cost per delegate of 199 and the Board's instructions were requested as to attendance.

 

The Board agreed that three members and the Clerk attend the National Licensing Conference on 31st August and 1st September 2005.

 

III AMENDMENT TO REGULATIONS

 

The Board were informed that since 1st May 2004 responsibilities under the Control of Asbestos Regulations 2002 had been placed on those who occupy or have responsibilities for non-domestic premises which may contain asbestos. This responsibility meant that they had a duty to manage the risk from that material. From that date the responsible persons must have a management plan in place to:-

 

7                                             take reasonable steps to determine the location and condition of materials likely to contain asbestos (ACM);

7                                             make and keep an up-to-date record of the location and condition of the ACM or presumed ACM in the premises;

7                                             make a determination of the risk from the materials;

7                                             prepare a written plan setting out how the risks from the materials are to be managed;

7                                             take the necessary steps to put the plan into action;

7                                             review and monitor the plan periodically; and

7                                             provide information on the location and condition of the materials to anyone who is liable to work on or disturb them.

 

Prior to the commencement of this part of the Regulations the Environmental Health and Trading Standards Department wrote to all licensees and all other businesses under their regulatory remit.

 

To further assist the Environmental Health Department, it was recommended that the Board's Regulations be amended as undernoted:-

 

"Any applicant for a new licence or any existing licensee carrying out alterations must comply with the terms of the Control of Asbestos Regulations 2002 and submit a management plan and where appropriate, any asbestos survey to the Environmental Health and Trading Standards Department setting out how the risks from materials are to be managed. Such plan to be submitted at the time the application is made".

 

The Board agreed accordingly.

 

IV REQUEST FOR SUSPENSION HEARING IN TERMS OF SECTION 31

 

(i)There was submitted a letter from the Chief Constable dated 9th June 2005 requesting a Suspension Hearing.

 

The Board agreed to hold a Suspension Hearing in respect of the above.
