The minute of meeting of this Committee of 21st March 2005 was held as read.

 

Unless marked thus * all items stand delegated.

 

I FIFE DRAFT STRUCTURE PLAN - ST. ANDREWS AND EAST FIFE DRAFT LOCAL PLAN

 

There was submitted Report No 218-2005 by the Director of Planning and Transportation advising the Committee of the publication of the Fife Draft Structure Plan and the St. Andrews and East Fife Draft Local Plan and outlining matters of interest to Dundee City Council as a neighbouring authority.

 

The Committee agreed to:-

 

(i) note the publication of the Fife Draft Structure Plan and the St. Andrews and East Fife Draft Local Plan;

 

(ii) approve the report which highlighted matters of concern to Dundee City Council as neighbouring planning authority;

 

(iii) remit the Director of Planning and Transportation to submit the report to Fife Council as Dundee City Council's formal response to the Draft Plans; and

 

(iv) remit the Director of Planning and Transportation to submit a further report on the Finalised Fife Structure Plan and Finalised St. Andrews and East Fife Local Plan when these documents are published.

 

II ANGUS LOCAL PLAN REVIEW - FINALISED PLAN

 

There was submitted Report No 207-2005 by Director of Planning and Transportation advising the Committee of the publication of the Angus Local Plan - Finalised Plan.

 

The Committee agreed to note the publication of the Angus Local Plan - Finalised Draft and that the deadline for receipt of objections had been 17th March 2005. It further agreed to endorse the objection already submitted to Angus Council by the Director of Planning and Transportation to that plan and remit the Director of Planning and Transportation to pursue the objection through the Local Plan Inquiry process.

III MEMBERSHIP OF THE SCOTTISH ACCESSIBLE TRANSPORT ALLIANCE (SATA)

 

There was submitted Report No 193-2005 by the Director of Planning and Transportation seeking approval for membership of the Scottish Accessible Transport Alliance (SATA).

 

The Committee approved the application for membership as from May 2005.

 

IV A92 DUNDEE-ARBROATH ROAD AT CLAYPOTTS - PROHIBITION OF LEFT HAND TURN

 

There was submitted Report No 114-2005 by the Director of Planning and Transportation seeking approval for the implementation of a Traffic Regulation Order to prohibit the left hand turn for eastbound traffic on Arbroath Road into the service road to Tom Johnston Road east of Baldovie Road.

 

The Committee approved the preparation of the necessary Traffic Regulation Order.

 

V TRAFFIC ORDERS ETC

 

There was submitted Agenda Note AN143-2005 advising of the undernoted Traffic Orders etc:-

 

(a) DUNDEE CITY COUNCIL (MELFORT PLACE FOOTPATH, DUNDEE) (STOPPING UP) ORDER 2004.

 

Reference was made to Article II of the minute of meeting of this Committee of 20th December 2004 wherein it was agreed to prepare an Order to stop up lengths of footpath at Melfort Place, Dundee to facilitate the construction of a new housing development.

 

The Order was duly prepared and advertised in the Dundee Courier and Advertiser and The Edinburgh Gazette and the relevant statutory undertakers were consulted. No objections were received.

 

The Committee therefore agreed to authorise and confirm the Stopping Up Order and authorise formal publication of the confirmation after which the Order would become operative.

 

(b) DUNDEE CITY COUNCIL (TURNBERRY AVENUE BUS FACILITY, DUNDEE) (PROHIBITION OF DRIVING) ORDER 2005

 

Reference was made to Article IV of the minute of meeting of this Committee of 30th August 2004 instructing and authorising the preparation of an Order to improve safety by removing unnecessary traffic from the bus lane, thus protecting bus and pedestrian movements.

 

The proposed Order was duly drafted and during the statutory consultation period no adverse comments were received.

 

The order was duly advertised and there were no objections.

 

The Committee therefore agreed to make the Order as advertised.

 

(c) DUNDEE CITY COUNCIL (DONS ROAD AND ROSEBANK ROAD, DUNDEE) (STOPPING UP) ORDER 2005

 

Reference was made to Article VI of the minute of meeting of this Committee of 15th November 2004 wherein it was agreed to prepare an Order to stop up roads and footways to facilitate the redevelopment of the former Cleansing Depot site at the junction of Dons Road and Rosebank Road.

 

The Order was duly prepared and advertised in the Dundee Courier and Advertiser and The Edinburgh Gazette and the relevant statutory undertakers were consulted. Four objections were received, none of which have been withdrawn.

As there were objections which were not withdrawn only Scottish Ministers may confirm the Order and the Council would now be submitting the Order to Scottish Ministers to confirm it in terms of the relevant legislation. The Scottish Ministers must, before confirming the Order, cause a local inquiry to be held.

 

The Committee noted accordingly.

 

(d) DUNDEE CITY COUNCIL (VARIATION OF WAITING RESTRICTIONS) ORDER 2005

 

Reference was made to Article VI of the minute of meeting of this Committee of 24th May 2004 instructing and authorising the preparation of an Order introducing further measures to vary the provision of numerous existing Waiting Restrictions Orders affecting Dundee.

 

The proposed Order was duly drafted and during the consultation period no adverse comments were received.

 

The Order was duly advertised and four objections were received, all of which had been maintained. They referred to proposals for Montgomerie Crescent/Avenue. As this specific Order related to frontagers amenity and none of the three options considered was acceptable to a clear majority of residents, the Committee agreed to withdraw these proposals.

 

The Committee therefore approved the making of the Order, subject to the above amendment.

 

(e) DUNDEE CITY COUNCIL (RIVERSIDE DRIVE - ESPLANADE WEST, DUNDEE) (PROHIBITION OF HEAVY VEHICLES AND ONE-WAY TRAFFIC) ORDER 2005

 

Reference was made to Article II of the minute of meeting of this Committee of 25th October instructing and authorising the preparation of an Order to enhance the appearance of the Ambassador Route into the west of the city as part of an environmental improvement scheme and to facilitate the upgrading of the service facilities in the area.

 

The proposed Order was duly drafted and during the statutory consultation period no adverse comments were received.

 

The Order was duly advertised and there were no objections.

 

The Committee therefore agreed to make the Order as advertised.
