The minute of meeting of the Board of 24th June, 2004 was held as read.
I LICENSING (SCOTLAND) BILL
It was reported that the draft Licensing (Scotland) Bill had been distributed for comment by 31st August 2004.
The Board remitted to the Clerk to submit comments on the proposed new legislation and that prior to submission Board members to be circulated with a copy of the comments.
II CODE OF CONDUCT
The Board were advised that a meeting had taken place on 20th July 2004 attended by various night club operators in the City concerning the practice of touting outside each other's premises.
Agreement was reached regarding exclusion zones within which touting would be prohibited. It was suggested that the wording of the relevant part of the Code of Conduct, as amended by the Board at its meeting on 24th June 2004, be replaced by the following paragraph:-
"There must be no touting by or on behalf of entertainment licence holders by whatever means (excluding within their own premises) within the areas from time to time designated by the Board. Without prejudice to the foregoing generality, there shall be no tickets, leaflets, flyers, vouchers or similar items issued to prospective patrons for the purpose of advertising, or otherwise obtaining custom for, particular entertainment-licensed premises."
The Board agreed that the Code of Conduct be amended accordingly.
III REQUESTS FOR SUSPENSION HEARINGS IN TERMS OF SECTION 31
(i) There was submitted a letter from the Depute Chief Executive (Finance) dated 9th July 2004 requesting a Suspension Hearing.
The Board agreed to take no action in respect of the above.
(ii) There was submitted a letter from the Chief Constable dated 5th July 2004 requesting a Suspension Hearing.
The Board agreed to hold a Suspension Hearing in respect of the above.
