The minute of meeting of the Board of 22nd April, 2004 was held as read.
I MEMBERSHIP
Reference was made to Article I of the meeting of the Adjourned Licensing Board of 22nd April, 2004.
It was reported that Dundee City Council, at its meeting on 10th May, 2004, had appointed Councillor Shimi to the Licensing Board following the resignation of Councillor Macpherson.
The Board noted accordingly.
II APPOINTMENT OF CHAIRMAN
Councillor Shimi moved that Bailie Powrie be appointed Chairman for the forthcoming year.
As an amendment, Councillor Don moved that Councillor Fordyce be appointed Chairman.
On a division, there voted for the motion the Lord Provost, Bailies Wright, Powrie and Mackie and Councillors Grant, Regan and Shimi (7); and for the amendment Bailie Corrigan and Councillors Don and Fordyce (3); whereupon the motion was declared carried appointing Bailie Powrie as Chairman.
III TRAINING FOR APPLICANTS FOR LICENCES
There was submitted Report No 500-2004 by the Clerk to the Board outlining proposals to members regarding the introduction of the need for applicants to provide evidence as to the level of relevant training which they had undertaken.
The Board Agreed that:-
(i)with effect from the October 2004 quarterly meeting applicants for the grant of new licences and permanent transfer under Sections 25(1) and 25(2) and applications for confirmation under Section 25(4) be required to submit certificates to the effect that they have been awarded the Serve Wise Plus certificate or any other relevant certificate of the same SQA standard or above; and
(ii)the Board's regulations be amended as outlined in paragraph 6.10 of the report.
IV REVIEW OF CODE OF CONDUCT AND MINIMUM CHARGE FOR ENTRY
There was submitted Report No 501-2004 by the Clerk to the Board detailing amendments to the terms of (a) the Code of Conduct for Licensed Premises, and (b) the condition attached to Entertainment Licences imposing a minimum charge for entry.
The Board agreed to:-
(i)the amendments to the Code of Conduct and the minimum charge for entry outlined in paragraphs 6.3 and 6.4 of the report; and
(ii)agreed that the minimum charge for entry remain at 2.50 until June 2005.
It was further agreed to approve the condition on touting in principle but to discuss the issue further at the next Liquor Licensing Forum before implementing it.
V DOOR STEWARDS TRAINING
It was reported that the Door Steward Scheme had now been operational for three years and its operation had been reviewed. Currently stewards had to book on to the college course and pay the fee direct and on some occasions training course had to be cancelled owing to a lack of numbers. In other cases stewards had not appeared.
The Board agreed that the application fee, currently 10, be increased to 70 and the renewal fee be fixed at 10.
VI REQUESTS FOR SUSPENSION HEARINGS IN TERMS OF SECTION 31
It was agreed to hold Section 31 Hearings in respect of:-
(a) Partytime, 65-67 Macalpine Road and Reehan Ul-Haq
(b) Occidental Bar, 1 Queen Street, Broughty Ferry and Ian Gibson
