I CIVIC GOVERNMENT (SCOTLAND) ACT 1982
(a) LATE HOURS CATERING - CONSULTATION EXERCISE - DISCUSSION PAPER
Reference was made to Article II(b) of the minute of meeting of the Licensing Committee of 1st October, 2003, wherein it was agreed that consideration be given to the introduction of a policy for late hours catering licences having regard to concerns raised by Tayside Police as to public order offences in the vicinity of some establishments in the early hours of the morning and litter problems caused by the incorrect disposal of trade waste from some outlets.
There was submitted a discussion paper by the Depute Chief Executive (Support Services) advising of the outcome of the consultation exercise with existing licensees and Tayside Police and outlining options which the Committee may wish to consider in relation to the establishment of a policy on Late Hours Catering Licences.
The Committee heard the observations of the representative of Tayside Police, the representatives of Clark's Bakery, Corfu Kebabs, Pizza de Roma, Cafe de Roma, Marmaris Kebab and the Environmental Health Officer.
The Committee thanked the representatives of the Trade and Tayside Police for their attendance and contribution to the meeting.
The Committee resolved under Section 50(A) of the Local Government (Scotland) Act 1973 that the press and public be excluded from the meeting for the undernoted item of business on the grounds that this would involve the likely disclosure of exempt information as defined in paragraphs 3, 6 and 9 of Part 1 of Schedule 7A to the above Act.
II LATE HOURS CATERING - CONSULTATION EXERCISE
The Committee, after consideration of the content of the discussion paper, the observations of the representatives of the late hours catering premises who had been present and Tayside Police agreed:-
(i) that further consultation be undertaken with other departments of the Council and outside agencies in relation to the establishment of a policy in light of the views expressed by Tayside Police, Licence Holders and Environmental Health;
(ii) that further consultation meetings be convened as necessary; and
(iii) that a report be submitted to a meeting of the Licensing Committee to be held in November 2004 for decision on the establishment of a policy for late hours catering.
