The minute of meeting of this Committee of 1st December 2003 was held as read.

I PLANNING AND TRANSPORTATION DEPARTMENTAL SERVICE PLAN 2003-07

 

There was submitted Report No 5-2004 by the Director of Planning and Transportation relative to the Department's new Service Plan for 2003-07.

 

The Committee noted and approved the new Service Plan together with performance targets.

 

II DUNTRUNE DEMONSTRATION GARDEN - SITE DEVELOPMENT BRIEF

 

There was submitted Report No 17-2004 by the Director of Planning and Transportation advising the Committee of guidelines for the development of the above site and seeking approval of the draft development brief as the basis of consultation with adjacent site owners and interested parties.

 

The Committee agreed to:-

 

(a) approve the brief for the purposes of consultation with adjacent residents and interested parties; and

 

(b) remit the Director of Planning and Transportation to report back on the results of the consultation exercise within a period of two months.

 

III PITALPIN VILLAGE - DRAFT SITE PLANNING BRIEF

 

There was submitted Report No 23-2004 by the Director of Planning and Transportation seeking approval of a draft site planning brief for the above site as the basis of consultation with the local community and interested parties.

 

The Committee agreed to:-

 

(a) approve the draft site planning brief for the purposes of consultation;

(b) remit the Director of Planning and Transportation to consult with the local community and interested parties on the terms and content of the draft site planning brief; and

 

(c) remit the Director of Planning and Transportation to report back on the result of the consultation exercise.

 

IV ARMISTEAD HOUSE - DRAFT SITE PLANNING BRIEF

 

There was submitted Report No 29-2004 by the Director of Planning and Transportation seeking approval of a draft site planning brief for the above site as the basis of consultation with the local community and interested parties.

 

The Committee agreed to:-

 

(a) approve the draft site planning brief for the purposes of consultation;

 

(b) remit the Director of Planning and Transportation to consult with the local community and interested parties on the terms and content of the draft site planning brief;

 

(c) remit the Director of Planning and Transportation to report back on the result of the consultation exercise; and

 

(d) remit the Director of Planning and Transportation to promote a Tree Preservation Order for those trees not already protected by the powers of the Conservation Area.

 

V DTZ PIEDA RETAIL STUDY 2003

 

There was submitted Report No 45-2004 by the Director of Planning and Transportation outlining the findings and implications of the City of Dundee Retail Review 2003.

 

The Committee agreed to:-

 

(a) accept the key findings of the Dundee Retail Review 2003; and

 

(b) remit the Director of Planning and Transportation to report back to the February Committee with views as to how the identified comparison floor space requirements should be accommodated.

 

VI FLOOD PREVENTION AND LAND DRAINAGE (SCOTLAND) ACT 1997

 

There was submitted Report No 50-2004 by the Director of Planning and Transportation advising the Committee of the completion of the fourth biannual report on flooding and seeking approval for the publication of this report as required by the Flood Prevention and Land Drainage (Scotland) Act 197.

 

The Committee agreed to note the content of the fourth biannual report on flooding and authorise its publication.

 

VII GRANT OFFER FOR PUBLIC TRANSPORT PROJECTS IN 2003/2004

 

There was submitted Report No 76-2004 by the Director of Planning and Transportation seeking approval for the implementation of public transport projects arising from extra funding made available by the Scottish Executive in 2003/2004.

 

The Committee approved the implementation of public transport projects as detailed in the report.

 

VIII CITY FACADE ENHANCEMENT GRANT SCHEME

 

There was submitted Report No 8-2004 by the Director of Planning and Transportation advising the Committee of the progress being made to date on implementing the Facade Enhancement Grant Scheme in the City Centre.

IX IMPLEMENTATION OF 20 MPH SPEED LIMITS AROUND SCHOOLS

 

There was submitted Report No 75-2004 by the Director of Planning and Transportation advising the Committee that Dundee City Council had received a grant of 813,000 from the Scottish Executive for capital costs incurred in works to improve road safety.

 

The Committee approved the implementation of 20 mph speed limits around all primary and secondary schools in Dundee on the basis detailed in the report, having noted that Forthill Primary School and St John's High School would also be considered in the early action category.

 

The Committee also authorised the Director of Planning and Transportation to invite tenders for the works, and to accept the most advantageous offer, following consultation with the appropriate elected members.

 

X DECRIMINALISATION OF PARKING TRAFFIC ORDERS IMPLICATIONS

 

There was submitted Report No 38-2004 by the Director of Planning and Transportation seeking approval to vary the necessary Traffic Regulation Orders to meet the legislative requirements for decriminalised parking enforcement.

 

The Committee approved a Traffic Regulation Variation Order to amend all the Orders controlling parking throughout the city in order to permit decriminalised parking enforcement.

 

XI BELL STREET, DUNDEE - PROHIBITION OF DRIVING

 

There was submitted Report No 1-2004 by the Director of Planning and Transportation proposing an amendment to the Traffic Regulation Order in place in Bell Street (east of Constitution Road).

 

The Committee approved the promotion of a Traffic regulation Order to close Bell Street to through traffic with the only exemption being to retain provision for cyclists as detailed in the report.

 

XII BALUNIE DRIVE STOPPING-UP ORDER

 

There was submitted Report No 42-2004 proposing the stopping-up of footpaths in Balunie Drive.

 

The Committee approved the preparation of a Stopping-Up Order under the powers of the Town and Country Planning (Scotland) Act 1997 to allow for new lockable gates to be installed over Balunie Drive footpaths which have received planning consent.

 

XIII CARBERRY CRESCENT - FOOTPATH AND ROADS STOPPING-UP

 

There was submitted Report No 10-2004 by the Director of Planning and Transportation proposing the stopping-up of the above mentioned footpaths and roads.

 

The Committee approved the preparation of a Stopping-Up Order under the powers of the Town and Country Planning (Scotland) Act 1997 to allow for new housing developments over the Carberry Crescent footpaths and roads.

 

XIV TRANENT GROVE/SALTON CRESCENT FOOTPATH - STOPPING-UP

 

This item was withdrawn.

 

XV DUNDEE CITY COUNCIL (BRACKENS/MACALPINE PRIMARY SCHOOL) (LAIRD STREET TO ST COLUMBA GARDENSFOOTPATH, DUNDEE) (STOPPING-UP) ORDER 2003

 

Reference was made to Article IX of the minute of meeting of this Committee of 29th September 2003 where it was agreed to stop-up the entire length of the footpath connecting Laird Street with St Columba Gardens as it would become unnecessary following the construction of a new footpath.

 

There was submitted Agenda Note AN30-2004 advising that the Order had been duly prepared and advertised in the Dundee Courier and Advertiser and the Edinburgh Gazette and the relevant statutory undertakers consulted. No objections had been received.

 

The Committee therefore authorised and confirmed the Stopping-Up Order and authorised formal publication of the confirmation.

 

XVI TOWARDS THE FLEXIBILITY OF MOBILITY AGENCY - WORKSHOP

 

There was submitted Agenda Note AN28-2004 advising the Committee that Angus Transport Forum had organised a workshop on the subject "Towards the Flexibility of Mobility Agency" in Carnoustie at a cost of 90, excluding travel and subsistence.

 

The Committee authorised the attendance of the Convener or her nominee.

 

XVII BROUGHTY FERRY STUDY - CENTRAL BROUGHTY FERRY AREA - VARIATION OF RESTRICTIONS ORDER

 

On a reference to Article IX of the minute of meeting of this Committee of 2nd December 2003 there was submitted Agenda Note AN29-2004 relative to the above.

 

The Committee agreed to confirm the above mentioned Order and remitted to the Director of Planning and Transportation to implement it.

 

XVIII DUNDEE CITY COUNCIL (WHITEHALL STREET, DUNDEE) (BUS SHELTER PROVISION) (VARIATION OF WAITING RESTRICTIONS)ORDER 2004

 

Reference was made to Article II of the minute of meeting of this Committee of 25th August 2003 instructing and authorising the preparation of an Order to improve public transport facilities in the City Centre and to improve servicing facilities for commercial properties within the street.

 

There was submitted Agenda Note AN39-2004 advising that the proposed Order was duly drafted and as a result of the consultation process the Committee was requested to approve the undernoted changes to the parking layout in the street.

 

The original proposal was to provide two pay and display spaces towards the north end and two disabled spaces towards the south end with a "loading only" space between them. After further consideration, it was proposed to provide four pay and display spaces towards the north end and one disabled space towards the south end. An alternative disabled space would be designated in Whitehall Crescent. This is a net increase of one space and also a longer length of "loading only".

 

The Committee approved these changes and authorised formal publication of the Order incorporating the changes.

 

XIX DUNDEE CITY COUNCIL (VARIATION OF WAITING RESTRICTIONS) ORDER 2004

 

Reference was made to Article X of the minute of meeting of this Committee of 29th September 2003 instructing and authorising the preparation of an Order introducing further measures to vary the provisions of numerous existing Waiting Restrictions Orders affecting Dundee.

 

There was submitted Agenda Note AN40-2004 advising that the proposed Order was duly drafted and during the statutory consultation period comments were received regarding Glamis Drive and Hazel Drive. As a result of these comments it was proposed to amend the Order to the extent that the single yellow lines in Glamis Drive and Hazel Drive be effective only from Monday to Friday.

 

The Committee authorised publication of the Order as amended.

 

XX DUNDEE CITY COUNCIL (MURRAY STREET, DUNDEE) (PROHIBITION OF DRIVING) ORDER 2004

 

Reference was made to Article VIII of the minute of meeting of this Committee of 30th June 2003 instructing and authorising the preparation of an Order to improve safety by removing a junction with poor sightlines and a steep gradient.

 

There was submitted Agenda Note AN41-2004 advising that the proposed Order was duly drafted and during the statutory consultation period no adverse comments were received.

 

It was a condition not only of the planning consent but of the Scottish Executive that as part of the Mayfield housing development the junction be closed. The Planning and Transportation Committee granted consent for development on 31st March 2003. This meeting followed advertising of the development proposals and discussed comments received about the development. Only one of the objectors to the development raised points relative to traffic in Murray Street.

 

It was reported the Order was duly advertised and six objections were received.

 

The Committee agreed to make the Order despite the objections.

 

XXI CIVIC GOVERNMENT (SCOTLAND) ACT 1982 - PROPOSED NEW STREET NAMES

The Committee approved the applications, subject to conditions agreed with applicants.

 

It was further agreed that, on satisfactory completion of these roads and, if so requested by the applicants, they be entered on the List of Public Roads for the purposes of management and maintenance in terms of the Roads (Scotland) Act 1984.

 

XXIII TENDERS RECEIVED BY CITY ENGINEER

 

There was submitted Report No 48-2004 by the Director of Planning and Transportation detailing tenders received in respect of remedial works to a retaining wall at Robertson Street.

 

The Committee approved acceptance of the lowest offer from Dundee Plant Co Ltd in the sum of 32,910, together with allowances in the sum of 13,600 for fees and allowances, giving a total expenditure of 46,510.
