II DUNDEE TECHNOLOGY PARK - REQUEST FOR WAIVER OF SECTION 50 (NOW SECTION 75)AGREEMENT
There was submitted Agenda Note AN547-2003 advising the Committee that on 1st December, 2003, under delegated powers, planning permission was granted for the erection of a two-storey 1,100m2 Class 4 office development with car park on Explorer Road/Luna Place, Technology Park.
The Technology Park was subject to Section 50 (now Section 75) Agreements between the former Dundee District and Tayside Regional Councils and the former Scottish Development Agency prohibiting certain office uses. To allow the development to proceed without being in breach of these existing planning controls the Council, as statutory successor of Dundee District Council and Tayside Regional Council, would require to grant a formal Waiver of the existing Section 50 Agreements.
The Committee formally agreed to waive the existing Section 50 Agreements to the extent noted above.
