At a SPECIAL MEETING of the DUNDEE CITY LICENSING BOARD held at Dundee on 17th December, 2003.

The minute of meeting of the Board of 20th November, 2003 was held as read.

Unless marked thus * all items stand delegated.

I MEMBERSHIP

It was reported that Councillor Barrie had resigned as a member of the Licensing Board and that a replacement would be appointed at the meeting of the City Council on 12th January, 2004.

II MINUTE OF MEETING OF LICENSING BOARD SUB-COMMITTEE OF 27TH NOVEMBER, 2003

The minute of the above meeting (Appendix 1) was submitted for information.

III NICHOLSON COMMITTEE - RESPONSE BY DUNDEE CITY LICENSING BOARD

There was submitted Report No 828-2003 by the Principal General Services Officer outlining the Board's response to the Nicholson Committee recommendations.

The Board agreed:-

(i) that the report would form the Board's response to the Nicholson Committee's recommendations and;

(ii) remitted to the Clerk to arrange a presentation by the appropriate medical authority on the dangers of passive smoking to members of the Council and other relevant parties.

IV HEARING IN TERMS OF SECTION 31 - 100/108 COMMERCIAL STREET

It was reported that the Board had agreed to hold a Hearing to consider whether G11 Ltd and Ian Irons were still fit and proper persons to be holders of a Public House Licence.

As the police officers representing the Chief Constables case had been cited to attend the Sheriff Court it was noted that the Hearing would now be held at the January 2004 meeting of the Licensing Board.

V LICENSING (SCOTLAND) ACT 1976

(a) APPLICATION FOR TEMPORARY TRANSFER

The Board having heard that the above application was incompetent agreed not to consider it.

(b) APPLICATION FOR GRANT OF LICENCE

The Board having heard from the Chief Constable's representative and an agent on behalf of the applicant agreed to grant the above application.
