I BUILDING (SCOTLAND) ACT 1959 - SECTION 13 - DANGEROUS BUILDINGS
There was submitted Report No 287-2003 by the Director of Planning and Transportation advising the Committee of the action taken in dealing with dangerous buildings during the month of February 2003.
The Committee noted the contents of the report.
II ENFORCEMENT NOTICE APPEAL DECISION - 5 ESPLANADE, BROUGHTY FERRY, DUNDEE - ALLEGED UNAUTHORISEDERECTION OF A PLASTIC VENTILATION PIPE ON THE ROOF ELEVATION
There was submitted Agenda Note AN196-2003 making reference to the terms of an Enforcement Notice served on Links Building and Development Company on 1st October 2002 under powers delegated to the Director of Planning and Transportation relative to the alleged unauthorised erection of a plastic ventilation pipe on the roof elevation at the above address.
It was reported that the Enforcement Notice was subsequently appealed by the applicant under the provisions of Section 130 and Schedule 4 of the Town and Country Planning (Scotland) Act 1997 and the appeal had been dismissed and the Enforcement Notice upheld.
The Committee noted accordingly and agreed that, should the Notice not be fully complied with by the end of the prescribed period, a further report be lodged with the Procurator Fiscal.
III APPEAL DECISION - WESTBAY NURSING HOME, 34 ALBERT ROAD, BROUGHTY FERRY, DUNDEE - ATTICEXTENSION TO NURSING HOME TO PROVIDE SIX BEDROOMS AND ANCILLARY ACCOMMODATION
There was submitted Agenda Note AN197-2003 making reference to Article VII(i) of the minute of meeting of this Committee of 29th April 2002 wherein the above proposal was refused planning permission because the Council considered that the design of the extension would detract from the character and appearance of the Grove Conservation Area contrary to the relevant legislation and Policy BE11 of the adopted Dundee Local Plan 1998.
It was reported that the decision was subsequently appealed by the applicant under the provisions of Section 47 and Schedule 4 of the Town and Country Planning (Scotland) Act 1997 and the appeal was upheld with conditions relating to the submission of window and roof light detailing.
IV PLANNING APPLICATIONS
(a) 02-00489-HAZ - LAND TO THE SOUTH OF STANNERGATE ROAD AND WEST OF SHED 16, R & M ENGINEERING, STANNERGATE ROAD - STORAGE OF HAZARDOUS SUBSTANCES FOR ANGUS HORTICULTURE LIMITED
The Committee refused the application on the grounds that the risks to the surrounding population arising from the proposed operations are sufficiently high to justify the refusal of consent. This view is based on the advice offered by the Health and Safety Executive.
(b) 03-00059-FUL - 9 COX STREET - ERECTION OF 81 DWELLINGS AND ASSOCIATED PARKING FOR BETT PARTNERSHIPS LIMITED
After considering representations received, the Committee approved the application, subject to conditions recommended by the Director of Planning and Transportation.
(c) 03-00120-FUL - GJ'S BAR, 36 MAINS ROAD - FORMATION OF NEW CELLAR AT REAR OVER EXISTING YARD AND EXTENDING PUBLIC BAR INTO EXISTING CELLAR FOR CARTPLAN LIMITED
After considering objections received, the Committee approved the application, subject to conditions recommended by the Director of Planning and Transportation.
(d) 03-00124-FUL - 3/3A GORDON STREET, BROUGHTY FERRY - CONVERSION OF 3/3A GORDON STREET TO SINGLE DWELLINGHOUSE AND REMOVAL OF EXTERNAL STAIRCASE FOR MRS J M KEARSLEY
After considering objections received, the Committee approved the application, subject to conditions recommended by the Director of Planning and Transportation.
(e) 03-00132-FUL - 61 EAST HADDON ROAD - EXTENSION ON TWO FLOORS TO THE SOUTH ELEVATION FOR MR AND MRS C McALPINE
After considering objections received, the Committee approved the application, subject to conditions recommended by the Director of Planning and Transportation.
(f) 03-00162-OUT - barnhill primary school, falkland crescent, broughty ferry - OUTLINE APPLICATION FOR EXTENSION TO EXISTING SCHOOL WITH CLASSROOMS AND COMMUNITY PROVISION, REPLACEMENT OF EXISTING TEMPORARY NURSERY UNIT AND FORMATION OF NEW MAIN ACCESS FOR DIRECTOR OF EDUCATION, DUNDEE CITY COUNCIL

After considering objections received, the Committee approved the application, subject to conditions recommended by the Director of Planning and Transportation.
(h) 03-00165-OUT - MACALPINE PRIMARY SCHOOL, ST LEONARD ROAD -DEVELOPMENT OF TWO SEPARATE PRIMARY/NURSERY SCHOOLS AND ASSOCIATED FACILITIES FOR DIRECTOR OF EDUCATION, DUNDEE CITY COUNCIL
After considering objections received, the Committee approved the application, subject to conditions recommended by the Director of Planning and Transportation.
(i) 03-00177-FUL - 50 WALKERS MILL - ERECTION OF DORMER TO REAR FOR A CAMERON
After consideration objections received, the Committee refused the application on the grounds that -
(i) the proposal is contrary to Policy H4 of the Dundee Local Plan 1998 due to the adverse visual impact on the property and surrounding area; there are no material considerations that would justify approval in these circumstances; and
(ii) the proposal is contrary to Policy 14 of the Finalised Dundee Local Plan Review 2003 due to the adverse visual impact on the property and surrounding area; there are no material considerations that would justify approval in these circumstances.
(j) 03-00178-FUL - 28 CAMPERDOWN STREET, BROUGHTY FERRY - INSTALLATION OF SATELLITE DISH FOR MR S BRUCE
After considering objections received, the Committee approved the application, subject to conditions recommended by the Director of Planning and Transportation.
