Dundee City Licensing Board - 06/02/2003

At a MEETING of DUNDEE CITY ADJOURNED LICENSING BOARD held at Dundee on 6th February 2003.

The minute of meeting of the Licensing Board of 16th January, 2003 was held as read.

I LICENSING (SCOTLAND) ACT 1976

(a) APPLICATION FOR RENEWAL OF LICENCES

Applications marked thus * include renewal of Sunday Opening.

Applications marked thus $ include Renewal of Children's Certificates.

There being no objections, the Board agreed to grant the above application.

The Board having heard from an agent on behalf of the applicant, agreed to grant the application and substitution of employee.

(b) APPLICATIONS FOR PERMANENT TRANSFER OF LICENCE IN TERMS OF SECTION 25(1)

The Board, having noted a letter of observation from the Chief Constable, agreed to grant the application.

Before the next item was dealt with the Chairman stated that it was the Board's intention to return to the position as at October 2001 ie hotel bars would not be subject to the same policy as public houses. This will allow a wider public consultation exercise to take place on opening hours.

(c) APPLICATIONS FOR REGULAR EXTENSION OF PERMITTED HOURS

The Board agreed to grant the above application from 11 pm to 1 am Mondays to Sundays and 2.30 pm to 6.30 pm Sundays for the provision of service for tourists, shift workers and patrons attending fund raising and social events.

11 pm to 1 am Monday to Sunday and 2.30 pm to 6.30 pm Sunday for shift workers, tourists, local demand and charity events.

Having heard from the applicant on his own behalf, who amended the application to 12.30 am, the Chairman moved to grant the application to 12 midnight only.

As an amendment, Councillor FitzPatrick moved to grant the application to 12.30 am.

On a division, there voted for the motion, the Chairman, Lord Provost and Councillors Wright, Ward, Sawers and Dawson (6); and for the amendment Councillors FitzPatrick, Beattie, Mackie and Powrie (4), whereupon the motion was declared carried, granting the application to 12 midnight only. The Board further agreed to grant a request for a direction in terms of Section 64(a).

From 11 pm to 12 midnight Sundays to Thursdays, 11 pm to 1 am Friday and Saturday and 2.30 pm to 6.30 pm Sunday for the benefit of local residents, visitors and shift workers.

The Board, having heard from an agent on behalf of the applicant who had amended the application to 12.30 am, agreed to grant the application to 12 midnight only and also agreed to grant a request for a direction in terms of Section 64(a).

The Board agreed to grant the application from 11 pm to 12 midnight Sunday to Thursday, 11 pm to 1 am Friday and Saturday and 2.30 pm to 6.30 pm Sundays for the provision of refreshments for the benefit of patrons and generally for local demand.

From 11 pm to 1 am Mondays to Sundays and 2.30 pm to 6.30 pm Sundays to meet demand for shift workers, residents, students and patrons viewing late night events on Sky.

The Board, having heard from an agent on behalf of the applicant, agreed to grant the application to 12 midnight only.

The Board agreed to grant the application from 11 pm to 1 am Mondays to Sundays and 2.30 pm to 6.30 pm Sundays for the benefit of the community, tourists and visitors.

From 11 pm to 12 midnight Sundays to Thursday, 11 pm to 1 am Fridays and Saturdays and 2.30 pm to 6.30 pm Sundays for shoppers, tourists, shift workers and 11 pm to 1 am Mondays to Sundays and 2.30 pm to 6.30 pm Sundays in the Function Suite for private functions.

The Board agreed to grant the application to 12 midnight only in the Lounge and to 1 am in the Function Suite for private functions only.

The Board agreed to grant the application from 11 pm to 1 am Mondays to Sundays and 2.30 pm to 6.30 pm Sundays for tourists, visitors, shift workers and general demand.

The Board agreed to grant the application from 11 pm to 12 midnight Sunday to Thursday, 11 pm to 1 am Friday and Saturday and 2.30 pm to 6.30 pm Sunday for the benefit of the community, local demand and private functions.

(d) APPLICATION FOR MUSICAL ENTERTAINMENT CONSENT

TV set and juke box during permitted hours Mondays to Sundays and karaoke and live entertainment 8 pm to 11.30 pm on Thursday to Saturday and from 8 pm to 10.45 pm Sundays.

The Board, having heard from an agent on behalf of the applicant and from an officer of the Environmental and Consumer Protection Department, agreed that the application be confirmed at the March Board and that Environmental and Consumer Protection Department liaise with the applicant regarding the effectiveness of sound proofing works which had been carried out.

(e) APPLICATIONS FOR THE GRANT (INCLUDING THE PROVISIONAL GRANT) OF NEW LICENCES

The Board noted that the above application had been withdrawn.

(f) APPLICATIONS FOR CHILDRENS CERTIFICATES

The Board, having heard from an agent on behalf of the applicant, agreed to refuse the application.
