I UNIVERSITY OF DUNDEE CAMPUS PLAN
On a reference to Article I of the minute of meeting of the Planning and Transportation Committee of 2nd December 2002 there was submitted Agenda Note AN44-2003 advising the Committee that it had been agreed to commend the abovementioned Plan to this Committee as a material consideration for development purposes.
The Committee noted accordingly.
II PERCENT FOR PUBLIC ART
On a reference to Article IX of the minute of meeting of the Planning and Transportation Committee of 2nd December 2002 there was submitted Agenda Note AN45-2003 advising the Committee that it had been agreed to commend the Percent for Public Art Policy and Guidelines to this Committee as a material consideration for development purposes.
The Committee noted accordingly.
III CONSERVATION AREA CONSENT - DEMOLITION OF BALLINARD HOUSE HOTEL AND ASSOCIATED OUTBUILDINGSAT 26 CLAYPOTTS ROAD, DUNDEE
There was submitted Agenda Note AN29-2003 making reference to Article III(d) of the minute of meeting of this Committee of 27th May 2002 whereby the above application for Conservation Consent for the demolition of the Ballinard House Hotel and associated outbuildings was considered. The report approved by the Committee contained two recommendations. The first was that consent would not be issued unless and until Historic Scotland made a formal determination to call-in the application. The second recommendation was to grant consent subject to conditions.
It was reported that Historic Scotland had advised that they had no objection to the demolition of the main house and bedroom accommodation but considered that the coach-house should be retained and in response to this the applicants had submitted a further planning application amending the site layout and retaining the coach-house, which was approved under delegated powers on 15th November 2002.
In light of Historic Scotland's comments, the Committee approved a further condition to the Conservation Area Consent requiring the retention of the coach-house building.
IV ENFORCEMENT NOTICE APPEAL: 45 TRAQUAIR GARDENS,WHITEHAZEL PARK, DUNDEE: UNAUTHORISED
There was submitted Agenda Note AN30-2003 making reference to Article 1(h) of the minute of meeting of this Committee of 25th February 2002 wherein a proposal for a porch was refused planning permission because the Council considered that the proposal would have an adverse impact on the appearance of the house and the surrounding area due to its poor design, contrary to Policy H4 of the Dundee Local Plan 1998. The porch had already been erected without planning permission as had a conservatory and boundary fencing.
Under powers delegated to the Director of Planning and Transportation an Enforcement Notice was served in respect of all the unauthorised developments.
It was reported that the Notice had been appealed by the applicant under the provisions of Section 130 and Schedule 4 of the Town and Country Planning (Scotland) Act 1997 and certain aspects of the Enforcement Notice were upheld and others deleted with planning permission being granted for the conservatory and porch.
V APPEAL DECISION - OLD POLICE STATION, FINTRY, DUNDEE
There was submitted Report No 82-2003 by the Director of Planning and Transportation advising the Committee of the outcome of the abovementioned planning appeal.
The Committee noted that the appeal had been upheld with conditions, and authorised the Director of Support Services to draw the statements made by the Reporter to the Scottish Executive Inquiry Reporters Unit seeking an explanation for the inclusion of his report remarks concerning the Council's alleged attitude to the potential use of Compulsory Purchase Order powers.
VI ENFORCEMENT QUARTERLY UPDATE STATEMENT FOR PERIOD JULY - DECEMBER 2002
There was submitted Agenda Note AN31-2003 providing a statistical update for the period from July to December 2002 and advising the Committee of the nature and extent of enforcement activity for that period.
The Committee noted the information detailed therein.
VII RESTORATION AND DEVELOPMENT OF BROUGHTY FERRY RAILWAY STATION
There was submitted Report No 46-2003 by the Director of Planning and Transportation updating the Committee regarding the proposal to develop Broughty Ferry Railway Station and in particular in respect of the applicant's failure to comply with Condition 4 of Planning Permission and Condition 2 of Listed Building Consent issued on 29th June 2002 and 2nd August 2000 respectively.
The Committee agreed that, in view of the fact that new planning and listed building consent applications had been lodged in respect of the existing south platform buildings, no enforcement action be taken at present in respect of the breach of these conditions.
VIII BUILDING (SCOTLAND) ACT 1959 - SECTION 13 - DANGEROUS BUILDINGS
There was submitted Report No 47-2003 by the Director of Planning and Transportation advising the Committee of the action taken in dealing with dangerous buildings during the month of October 2002.
The Committee noted the contents of the report.
IX PLANNING APPLICATIONS
(a) 02-00552-COU - 31 SOUTH TAY STREET - CHANGE OF USE FROM OFFICES TO BAR/RESTAURANT WITH ELEVATIONAL ALTERATIONS FOR ANDY LOTHIAN
After considering objections received, the Committee approved the application, subject to the conditions recommended by the Building Quality Manager.
(b) 02-00652-FUL - ARNOTTS, 80 HIGH STREET, DUNDEE - PART REDEVELOPMENT/REFURBISHMENT TO INCLUDE FACADE RETENTION TO FORM RETAIL FLOORSPACE FOR DAWN DEVELOPMENTS
The Committee approved the application, subject to the conditions recommended by the Building Quality Manager.
(c) 02-00653-LBC - ARNOTTS, 80 HIGH STREET, DUNDEE - PART REDEVELOPMENT/REFURBISHMENT TO INCLUDE FACADE RETENTION TO FORM RETAIL FLOORSPACE FOR DAWN DEVELOPMENTS
The Committee approved the application, subject to the conditions recommended by the Building Quality Manager.
(d) 02-00654-FUL - 42 TO 44 REFORM STREET - ALTERATIONS TO EXISTING SHOP FRONT FOR TOTE BOOKMAKERS LIMITED
After considering objections received, the Committee approved the application, subject to the conditions recommended by the Building Quality Manager.
(e) 02-00708-FUL - 85C DUNDEE ROAD, BROUGHTY FERRY - ERECTION OF A NEW CONSERVATORY TO THE SOUTH ELEVATION FOR MR R DIPPIE
After considering objections received, the Committee approved the application, subject to the conditions recommended by the Building Quality Manager.
(f) 02-00789-COU - CHANGE OF USE FROM CLASS 1 (RETAIL) TO CLASS 10 (IT TRAINING AND JOB SEARCH CENTRE) FOR INSTEP COMMUNITIES LIMITED
After considering objections received, the Committee approved the application, subject to the conditions recommended by the Building Quality Manager.
Councillor Rolfe declared an interest in this item and took no part in the discussion thereof.
(g) land to the north of 1 castleroy road, broughty ferry - approval of reserved matters for previous consent for the erection of one dwellinghouse with new vehicle access for b s design
The Committee acceded to requests which had been received for deputations to address the Committee in support of and relative to objections to the above application.
Thereafter, having considered objections received, the Committee agreed to defer the application.
(h) 02-00828-FUL - 8 BREWERY LANE, DUNDEE - TWO STOREY EXTENSION TO FORM ADDITIONAL OFFICE AND STORAGE SPACE FOR STEWART SMALL & SON
After considering objections received, the Committee approved the application, subject to the conditions recommended by the Building Quality Manager.
