Dundee City Licensing Board - 21/11/2002

At an ADJOURNED MEETING of the DUNDEE LICENSING BOARD held at Dundee on 21st November, 2002.

The minute of meeting of the Licensing Board of 24th October, 2002 was held as read.

I REGIONAL SEMINAR FOR LICENSING BOARDS

There was submitted Agenda Note AN301-2002 informing the Board that Servewise Training (formerly Sips) had organised a series of Regional Seminars to discuss the National Plan for Action on Alcohol.

It was recommended that the Chairman attend the Seminar in Perth on 25th November, 2002 at a cost of 45.

The Board agreed the attendance of the Chairman at the above conference on 25th November, 2002 at a cost of 45.

III BETTING, GAMING AND LOTTERIES ACT 1963

(a) BETTING OFFICES

The Board, having heard from an agent on behalf of the applicant and from an agent on behalf of an objector and taking into account written objections, the Chairman moved refusal of the application on the grounds of location.

As an amendment, Councillor Grant moved that the application be granted.

On a division, there voted for the motion - the Chairman and Councillors Wright, Ward, FitzPatrick and Beattie (5); and for the amendment - Councillors Sturrock, Grant, Dawson and Powrie (4); whereby the motion was carried and the application was refused.

Thereafter, the Chairman moved that in addition to the foregoing there was no demand in the locality for a licensed betting office.

As an amendment, Councillor Grant moved that there was demand in the area.

On a division, there voted for the motion - the Chairman and Councillors FitzPatrick, Beattie and Dawson (4); and for the amendment - Councillors Wright, Sturrock, Ward, Grant and Powrie (5); whereby the amendment was carried that there was demand in the area.

III LICENSING (SCOTLAND) ACT 1976

(a) RENEWALS

Applications marked thus * include renewal of Sunday Opening.

Applications marked thus $ include renewal of Children's Certificates.

In the case of the above application the Board, having noted that the appropriate Electrical Certificate had now been received, agreed to grant the application.

(b) REGULAR EXTENSIONS OF PERMITTED HOURS

In the case of the above application, the Board, having heard from an agent on behalf of the applicant, agreed to grant the application to 12 midnight only.

In the case of the above application, the Board, having noted that the objection had been withdrawn, agreed to grant the application.

(c)APPLICATIONS FOR PERMANENT TRANSFER OF LICENCE IN TERMS OF SECTION 25(1)

The Board noted that the above application had been withdrawn.

(d)APPLICATIONS FOR PERMANENT TRANSFER OF LICENCE IN TERMS OF SECTION 25(1)(B)

The Board, having heard from the applicant on his own behalf, agreed to grant the above application.

(e) APPLICATIONS FOR THE GRANT OF CHILDREN'S CERTIFICATES

The Board, having visited the premises and heard from the applicant on his own behalf, agreed to grant the application between 12 - 3 pm and 5 pm ? 7 pm subject to the usual condition that the certificate is not operational on days when football matches were being played at Dens or Tannadice Park.

There being no objections, the Board granted the above application.

(f) SECTIONS 57 - 60

The Board, having visited the above premises and heard from the applicant on their own behalf, agreed to grant the application for the restaurant area only.

(g)APPLICATIONS FOR THE GRANT (INCLUDING THE PROVISIONAL GRANT) OF NEW LICENCES

The Board, having heard from an agent on behalf of the applicant and from agents on behalf of three objectors, Councillor Beattie moved to grant the application.

As an amendment, the Chairman moved that the application be refused.

On a division, there voted for the motion - Councillors Wright, Sturrock, FitzPatrick, Beattie, Dawson and Powrie (6); and for the amendment - the Chairman and Councillor Ward; whereupon the motion was carried granting the application.

The Board noted that the above application had been withdrawn.

(h) CANCELLATION OF CLOSURE ORDER UNDER SECTION 32

The Board, having heard from an agent on behalf of the applicant, agreed to defer the application for two weeks to allow Board members to visit the premises.
