I BUILDING (SCOTLAND) ACT 1959 - SECTION 13 - DANGEROUS BUILDINGS

 

There was submitted Report No. 335-2002 by the Director of Planning and Transportation advising the Committee of the action taken in dealing with dangerous buildings during the month of April 2002.

 

Councillor Allan Petrie declared an interest in this item and took no part in the discussion thereof.

 

The Committee noted the terms of the report.

 

II PLANNING APPLICATIONS

 

(a) 02-00044-COU - 1A HIGH STREET, DUNDEE DD1 1SX - CHANGE OF USE FROM CLASS 1 RETAIL TO CLASS 3 RESTAURANT FOR TRICORN RESTAURANTS

 

After considering objections received, Councillor Macpherson, seconded by Councillor Borthwick, moved refusal of the application on the grounds that the proposed development is contrary to Built Environment Policy BE11 of the Dundee Local Plan in that the proposal would have an adverse visual impact on the appearance of the property and that the proposed change of use and elevational alterations would not be in accordance with Leisure and Tourism Policy LT8 of the Dundee Local Plan and that there were no material considerations that would justify departing from the policies of the Development Plan in this instance.

 

As an amendment, the Convener, seconded by Councillor Petrie, moved approval of the application subject to the conditions recommended by the Building Quality Manager.

 

On a division, there voted for the motion - Councillors de Gernier, Wright, Rolfe, Sawers, FitzPatrick, Bowes, Scott, Macpherson and Borthwick (9); and for the amendment - the Convener and Councillors Ward, Shimi, Farquhar, Glen, Barrie, Richard Beattie, Dawson, Petrie, Guild, Dave Beattie, Fordyce, Mackie and Wallace (14); whereupon the amendment was declared carried.

 

(b) 02-00142-FUL - 3 HAREFIELD ROAD, DUNDEE DD3 6TA - EXTENSION TO DWELLINGHOUSE, FORMATION OF VEHICULAR ACCESS AND ERECTION OF GATES AND RAILINGS FOR MR & MRS CARTLIDGE

 

After considering representations received, the Committee approved the application subject to the conditions recommended by the Building Quality Manager.

 

(c) 02-00195-COU - STATHMORE HOUSE, 296A STRATHMORE AVENUE, DUNDEE - CHANGE OF USE FROM RESIDENTIAL HOME FOR THE ELDERLY TO FULLY LICENSED HOTEL WITH MINOR EXTENSION TO SOUTH ELEVATION AND FACADE ENHANCEMENTS FOR PYGMALION PROPERTIES LIMITED

 

The Committee acceded to a request which had been received for a deputation to address the Committee in support of the application. After the deputation had stated its case, it was thanked for its attendance and withdrew.

 

Thereafter, having considered objections received, Councillor Ward, seconded by Councillor Bowes, moved refusal of the application on the grounds that the proposed development is contrary to Policies H1 and LT8 of the Dundee Local Plan in that it is within close proximity of residential properties and a respite care unit and that there would be increased volumes of traffic in the evenings and weekends.

 

As an amendment, the Convener, seconded by Councillor Wright, moved approval of the application, subject to the change of Conditions 2 and 3 that all noise be inaudible to the respite care unit and subject to the other conditions recommended by the Building Quality Manager.

 

On a division, there voted for the motion - Councillors de Gernier, Ward, Farquhar, Barrie, Dawson, Dave Beattie, Fordyce, Bowes, Scott and Macpherson (10); and for the amendment - the Convener and Councillors Wright, Shimi, Glen, Rolfe, Richard Beattie, Sawers, FitzPatrick, Petrie, Guild, Mackie, Wallace and Borthwick (13); whereupon the amendment was declared carried.

 

(d) 02-00205-FUL - BALDRAGON FARM - STRATHMARTINE ROAD, DUNDEE - PROPOSED ERECTION OF 19 RESIDENTIAL DWELLINGS WITH GARAGES WITH ASSOCIATED WORKS FOR BETT HOMES LTD

 

After considering objections received, the Committee approved the application subject to the conditions recommended by the Building Quality Manager.

 

(e)OLD POLICE STATION, FINTRY ROAD, DUNDEE DD4 9HA - ERECTION OF EXTENISON TO BETTING SHOP FOR W INKSTER

 

It was noted that this application had been deferred for further information.

 

(f) 02-00273-FUL - TELEPHONE EXCHANGE, QUEEN STREET, BROUGHTY FERRY, DUNDEE DD5 1AD - PROPOSED INSTALLATION OF 3 ANTENNAE, 1 EQUIPMENT CABIN AND ANCILLARY DEVELOPMENT FOR CROWN CASTLE

 

After considering objections received, the Committee approved the application subject to the conditions recommended by the Building Quality Manager.

 

(g) 02-00284-FUL - LAND TO NORTH OF NINEWELLS AVENUE, DUNDEE - CHANGE OF HOUSE TYPES ON PLOTS 1-8 AND ERECTION OF ADDITIONAL DWELLINGHOUSES FOR STEWART MILNE HOMES

 

After considering objections received, the Committee refused the application on the grounds that proposed change of house types is contrary to Policy H10 by virtue of the scale and massing of the proposed development being inappropriate in the local area.

 

(h) 02-00291-FUL - 5 EAST HOME STREET/GARDEN GROUND OF 8 DOUGLAS TERRACE, BROUGHTY FERRY, DUNDEE DD5 1EA

 

After considering objections received, the Committee refused the application on the grounds that the development was contrary to Policies BE11 and BE4 in terms of detraction from the visual amenity and character of the Broughty Ferry Conservation Area.

 

(i) 02-00287-COU - 263 OLD GLAMIS ROAD, DUNDEE DD3 0NR - CHANGE OF USE AND EXTENSION TO DWELLINGHOUSE TO FORM CHILDREN'S NURSERY FOR MRS L WATT

 

The Committee approved the applications subject to conditions recommended by the Building Quality Manager.

 

(j) 02-00300-FUL - 9 LAW CRESCENT, DUNDEE DD3 6TN - ERECTION OF A SINGLE ATTACHED GARAGE TO EAST ELEVATION OF DWELLINGHOUSE FOR MR W GRAY

 

After considering objections received, the Committee approved the application subject to the conditions recommended by the Building Quality Manager.
