I CONSULTATION DRAFT OF NATIONAL PLANNING POLICY GUIDELINE 2 "ECONOMIC DEVELOPMENT"

 

There was submitted Report No. 241-2002 by the Director of Planning and Transportation advising the Committee of the comments proposed to be forwarded to the Scottish Executive in relation to the proposed revision of National Planning Policy Guideline 2 (NPPG 2) - Economic Development.

 

The Committee approved the comments of the Director of Planning and Transportation as detailed in the report and agreed that they be submitted to the Scottish Executive as the City Council's response to the consultation draft National Planning Policy Guideline 2.

 

II BROUGHTY FERRY STUDY - PROPOSED TRAFFIC ORDERS - PRELIMINARY CONSULTATIONS

 

There was submitted Report No. 244-2002 by the Director of Planning and Transportation advising the Committee on the outcome of preliminary consultations on the proposed Broughty Ferry Traffic Orders and making recommendations on the next stage of the Traffic Order process.

 

The Committee agreed that:-

 

(a) the comments of the various user groups be noted;

 

(b) the various Draft Traffic Orders be amended as follows -

 

?                         permit taxis to travel in a west-east direction in Brook Street between Fort Street and Gray Street and in a north-south direction in Union Street,

 

?                         leave the Brook Street (east) taxi rank as at present,

 

?                         provide an additional bus stop at Brook Street (north side) opposite Brown Street,

 

?                         provide a replacement bus stop at Fort Street (west side) near Long Lane,

 

?                         provide a replacement bus stop in Gray Street (east side) near Long Lane,

 

?                         provide additional dedicated disabled spaces as practicable,

 

?                         provide additional "loading only" bays as determined through ongoing discussions with traders,

 

?                         resolve minor drafting issues as necessary; and

 

(c)the various Draft Traffic Orders be advertised for public objection.

 

III STREET PARTIES FOR QUEEN'S GOLDEN JUBILEE - PUBLIC HOLIDAY, 3RD JUNE 2002

 

There was submitted Report No. 233-2002 by Director of Planning and Transportation recommending arrangements for considering applications to hold street parties in connection with the Queen's Golden Jubilee celebrations.

 

The Committee agreed:-

 

(a)that street parties may be held on minor roads without the need to make a formal temporary road closure in the circumstances detailed in the report; and

 

(b)to authorise the Director of Planning and Transportation, in consultation with the Director of Support Services and the Chief Constable, to approve such requests for street parties.

 

IV TRAFFIC MANAGEMENT - CENTRAL AREA - INTRODUCTION OF FOURTH ZONE - CONSULTATION UPDATE

 

There was submitted Report No. 251-2002 by the Director of Planning and Transportation advising the Committee of the outcome of the initial consultation exercise in respect of the above and recommending amendments to the original proposals.

 

The Committee agreed that the Traffic Regulation Order process proceeds to the next stage on the basis of the undernoted proposals which have been reviewed following consultation:-

 

(a)Bell Street prohibition of driving over the entire day reduced to the length of street from the University car park access to Euclid Crescent West;

 

(b)this restriction is to be relaxed overnight (6 pm - 8 am) and all day Sunday to allow movement by all vehicles;

 

(c)exception between 6 pm - 8 am and all day Sunday is to be introduced into Commercial Street to allow taxis to cross Murraygate at these times; and

 

(d)private hire cars to share the same traffic movement exemptions as taxis throughout the City.

 

V BLACKNESS ROAD - PROPOSED PUFFIN PEDESTRIAN CROSSING

 

There was submitted Report No. 260-2002 by the Director of Planning and Transportation recommending the installation of a Puffin crossing on Blackness Road at Rosefield Street and associated traffic management.

 

The Committee approved:-

 

(a)the installation of a Puffin crossing on Blackness Road in close proximity to the Post Office at Rosefield Street; and

 

(b)promotion of a Traffic Regulation Order to make Blackness Street one way south to eliminate a turning manoeuvre at this junction therefore improving road safety at the new crossing together with minor necessary adjustments to the waiting restrictions in Blackness Street at Blackness Road.

 

VI DRAFT NATIONAL PLANNING POLICY GUIDELINE 17 ADDENDUM: TRANSPORTAND PLANNING MAXIMUM CAR PARKING STANDARDS DRAFT REGULATORY IMPACT

 

There was submitted Report No. 257-2002 by the Director of Planning and Transportation advising the Committee of the proposal by the Scottish Executive to introduce national maximum car parking standards for a small range of significant travel generating land use types and seeking its agreement to returning a response to the Regulatory Impact Assessment.

 

The Committee agreed to:-

 

(a)note the contents of the report with regard to the proposed introduction of national maximum car parking standards; and

 

(b)respond to the Scottish Executive on the content of the draft NPPG17 Addendum and the Draft Regulatory Impact Assessment on the basis of the contents of the report and its appendix.

 

VII FUNDING OF OFF-SITE INFRASTRUCTURE

 

There was submitted Report No. 133-2002 by the Director of Planning and Transportation seeking approval from the Committee to allow financial contributions received from developers for off-site infrastructure improvements to be used in future years in order to finance improvements or replacement of infrastructure beyond a development site in response to the concerns and expectations of users and occupiers of the development which have been generated as a result of the development.

 

The Committee agreed to:-

 

(a)instruct the Director of Finance to incorporate the capital receipts from developers into the capital resources of the Council and to make provision in future capital programmes for off-site infrastructure improvements;

 

(b)instruct the Director of Planning and Transportation to include a policy statement on the use and intention of such capital receipts in the revised Dundee Local Plan and to prepare supplementary guidance thereafter; and

 

(c)instruct the Director of Planning and Transportation to consider the requirements for potential off-site works and therefore to seek developer contributions as part of the consideration of planning applications.

 

VIII AMUSEMENT ARCADES AND CENTRES

 

There was submitted Agenda Note AN36-2002 relative to Policy S26 within the adopted Dundee Local Plan relating to Amusement Arcades. It was reported that a recent planning application had highlighted that case law indicated that there was legal distinction between an "Amusement Arcade" and an "Amusement Centre" in that the former is primarily associated with the provision of "entertainment" machines while the latter relates to "gaming" equipment, the primary function of which is gambling.

The principal difference between the two operations is that the latter is more similar to a betting office with the operations fairly well contained internally and entrance strictly limited to the over 18 age group. The land use planning considerations would, therefore, be similar to those for a betting office. As a result, they would be likely to be considered acceptable within Policy S5, Secondary Retailing Areas. NPPG8 (Town Centres and Retailing, revised 1998) addresses both types of development under the heading of Amusement Centres (paragraphs 78-82) and only draws the distinction that amusements with prizes also need a licence under the Gaming Act 1968.

 

The Policy in the current Local Plan (S26) was specifically designed to apply to the circumstances pertaining to Amusement Arcades rather than Amusement Centres and is due for review as part of the overall review of the Local Plan currently underway. In the meantime, whilst the difference between the two operations and the nature of their clientele is recognised, the Committee agreed that it was still appropriate to continue to apply the existing policy to both operations and that its title should be amended accordingly to "Amusement Arcades and Centres".

 

Ix ardler village centre - pitches

 

Reference was made to Article No IX of the minute of meeting of this Committee of 13th December 1999 when offers were accepted for Phases 1 and 3 of the above project and authority to negotiate offers for future phases was given to the City Engineer.

 

There was submitted Agenda Note AN37-2002 advising that, as a continuation of this project, three sports pitches required construction, the first of them being a 7 a-side football pitch to serve the primary schools as well as the new housing.

 

The Committee approved acceptance of an offer from the appointed contractor, T N Gilmartin, in the sum of 43,000, together with allowances for professional fees and contingencies of 5,850, giving an overall expenditure of 48,850.

 

X ARDLER REGENERATION - PROVISION OF TEMPORARY ACCOMMODATION - TURNBERRY AVENUE, DUNDEE

 

Reference was made to Article VIII of the minute of meeting of this Committee of 25th September 2000 wherein it was reported that the Compulsory Purchase Order covering the shopping precinct and flats above at Turnberry Avenue had been confirmed by the Scottish Ministers.

 

There was submitted Agenda Note AN38-2002 advising that to progress the redevelopment, maintain service provision and health and safety for the public, a temporary shop unit required to be provided for an initial two year period until the new shops are completed.

 

It was reported that tenders had been invited and, in view of the timescales involved, the Director of Economic Development, in consultation with the Convener and spokespersons from the Major and Minority Opposition Groups, had approved the lowest offer by Knapp Farm Buildings in the sum of 58,767.68.

 

The Committee noted accordingly.

XII PARTICIPATION OF DUNDEE CITY COUNCIL IN 2002 CIVIC TRUST AWARDS

 

Reference was made to Article XII of the minute of meeting of this Committee of 25th June 2001 wherein participation in the abovementioned award scheme was approved.

 

There was submitted Agenda Note AN40-2002 advising that the awards had been announced on 18th April 2002 and Dundee had been successful in receiving an award in respect of McIntyres Hairdressing Salon, Union Street, designed by AIM Architects of Castle Street, Dundee.

 

The Committee extended its congratulations to McIntyres and AIM Architects.

 

XIII DUNDEE NETHERGATE ENVIRONMENTAL IMPROVEMENTS - NETHERGATE NORTH AND HIGH STREET: EXTENSION FOR NETHERGATE ENVIRONMENTALIMPROVEMENTS - SOUTH FOOTWAY: CRICHTON STREET TO UNION STREET

 

Reference was made to Article II of the minute of meeting of the Recess Sub-Committee of 16th July 2001 when approval was given for expenditure on the second phase of work on footways in Nethergate adjacent to Littlewoods and in High Street.

 

There was submitted Agenda Note AN41-2002 advising that this contract, undertaken by Tayside Contracts, was nearing completion and proposals had been prepared for the next phase of work on the south footway between Crichton Street and Union Street, replacing the existing surfaces with new Caithness slabs and that Scottish Enterprise Tayside, who were funding this phase of works, had suggested that the current contract be extended to encompass the south footway works to ensure an early start on site and continuity of workmanship.

 

It was proposed that the work be instructed as a variation order on the current contract and a price had been obtained from Tayside Contracts based on the current bill rates amounting to 79,796.95, together with allowances for fees and contingencies of 11,000 bringing the total expenditure to 90,796.95.

 

The Committee approved the extension of the current contract to encompass the South Footway works between Crichton Street and Union Street and approved the overall expenditure of 90,796.95.

 

XIV SCOTTISH ROAD MAINTENANCE CONDITION SURVEY - AGREEMENT

 

There was submitted Agenda Note AN42-2002 advising that, in view of the timescales involved, the Director of Planning and Transportation, after consultation with the Convener and the Major and Minor Opposition Groups' spokespersons, had agreed to the signing of an Agreement in respect of a Survey to be carried out by the Society for Chief Officers of Transportation in Scotland (SCOTS) and the Scottish Executive to determine the condition of the Scottish Road Network (local roads).

 

The Committee noted that Dundee's contribution would be 3,575 in the first year and 7,562 annually for years two to five.

 

XV CIVIC GOVERNMENT (SCOTLAND) ACT 1982 - PROPOSED NEW STREET NAMES

 

There was submitted Agenda Note AN43-2002 detailing proposed new street names.

XVII DUNDEE CITY COUNCIL (VARIATION OF WAITING RESTRICTIONS) (NO 2) ORDER 2002

 

Reference was made to Article I of the minute of meeting of this Committee of 29th October 2001 wherein authority was given for the preparation of an Order introducing further measures to vary the provisions of numerous existing Waiting Restrictions Orders affecting Dundee.

 

There was submitted Agenda Note AN45-2002 advising that the proposed Order was duly drafted and during the statutory consultation period no adverse comments received.

 

The Committee accordingly authorised publication of the Order as drafted.

 

XVIII DUNDEE CITY COUNCIL (NINEWELLS AVENUE, DUNDEE) (WAITING RESTRICTIONS) ORDER 2002

 

Reference was made to Article I of the minute of meeting of this Committee of 28th January wherein the Committee authorised the preparation of an Order to relieve congestion and facilitate the free flow of traffic on Ninewells Avenue.

 

There was submitted Agenda Note AN46-2002 advising that the proposed Order was duly drafted and during the statutory consultation period no adverse comments were received.

 

The Committee accordingly authorised formal publication of the Order as drafted.

 

XIX DUNDEE CITY COUNCIL (ROSEMOUNT ROAD AND TURNBERRY AVENUE, DUNDEE) (PHASE 3) (STOPPING UP) ORDER2002

 

Reference was made to Article VIII of the minute of meeting of this Committee of 24th April 2000 wherein it was agreed to stop up the sections of roads and footpaths at Rosemount Road and Turnberry Avenue to allow for the redevelopment of Ardler Housing Estate.

 

There was submitted Agenda Note AN47-2002 advising that the Order was duly prepared and advertised in the Dundee Courier and Advertiser and the Edinburgh Gazette and the relevant statutory undertakers consulted and no objections were received.

 

The Committee therefore agreed to authorise and confirm the Stopping Up Order, and authorise formal publication of the confirmation, after which, the Order will become operative.

 

XX BRINGING CONFIDENCE INTO PUBLIC TRANSPORT

 

Reference was made to the minute of meeting of this Committee of 25th March 2002 wherein an update on this project and the process for tendering for Project Management Services was reported.

 

There was submitted Agenda Note AN48-2002 advising that the successful tenderer was JMP Consultants Ltd with a score of 95 points, determined from the 80% quality and 20% price assessment applicable to this submission.

 

The Committee noted that the works were programmed for the next three financial years with the bulk of the works to be completed in the first two years.
