The minute of meeting of this Committee of 27th August 2001 was held as read.

I 3 MONTGOMERIE AVENUE, PROPOSED DORMER EXTENSION

 

Reference was made to Article III(h) of the minute of meeting of this Committee of 26th March 2001 wherein the above proposal was refused planning permission on the grounds detailed therein.

 

The Committee noted that the applicants had subsequently appealed against the foregoing decision and the appeal had been dismissed.

 

II 4 - 6 MURRAYGATE - CHANGE OF USE FROM CLASS 1 RETAIL TO CLASS 2 OFFICE

 

Reference was made to the decision of the City Council on 9th December 2000 under powers delegated to the Director of Planning and Transportation in consultation with the Convener to refuse planning permission because the proposed development would be contrary to Policy S3 of the Dundee Local Plan and establish a Class 2 office use within the retail core frontage area.

 

The Committee noted that the applicants had subsequently appealed against the foregoing decision and the appeal had been dismissed.

 

III UNIT 6, 119 CLEPINGTON ROAD - CHANGE OF USE

 

Reference was made to Article V(a) of the minute of meeting of this Committee of 22nd January 2001 wherein the above proposal was refused planning permission on the grounds detailed therein.

 

The Committee noted that the applicants had subsequently appealed against the foregoing decision and the appeal had been upheld and planning permission granted with conditions relating to restrictions on types of goods to be sold and opening hours.

 

IV 137 PITKERRO ROAD - USE OF PREMISES FOR PREPARATION AND SALE OF HOT FOOD

 

Reference was made to Article III(f) of the minute of meeting of this Committee of 26th March 2001 wherein the above proposal was refused planning permission on the grounds detailed therein.

 

The Committee noted that the applicants had subsequently appealed against the foregoing decision and the appeal had been upheld and planning permission granted subject to conditions relating to hours of opening, litter bin provision, fume extraction and odour control facilities.

V NEW BUILD HOUSING IN DUNDEE - INTERIM REVIEW OF POLICY H10 GUIDELINES

 

Reference was made to Article X of the minute of meeting of the Planning and Transportation Committee of 27th August 2001 wherein it was agreed to refer Report No 462-2001 by the Director of Planning and Transportation to this Committee as a material consideration in the determination of future planning applications.

 

The Committee noted the terms of the report.

 

VI DT2 - PIEDA RETAIL STUDY - IMPLEMENTATION

 

Reference was made to Article XI of the minute of meeting of the Planning and Transportation Committee of 27th August 2001 wherein it was agreed to refer Report No 463-2001 by the Director of Planning and Transportation to this Committee for information.

 

The Committee noted the terms of the report.

 

VII PLANNING APPLICATIONS

 

(a)01/30056/FUL - 34 SEAFORTH ROAD, BROUGHTY FERRY - EXTENSION OF TWO STOREY EXTENSION FOR S G ALIMHOMED

 

After considering objections received, the Committee approved the application subject to the conditions recommended by the Building Quality Manager.

 

(b)00/24952/D - CAR PARK, WILLISON STREET/NORTH LINDSAY STREET - UPGRADING OF SURFACE CAR PARK INCLUDING NEW ACCESS, LANDSCAPING AND SERVICES FOR NATIONAL CAR PARKS LIMITED

 

The Committee approved the application subject to the conditions recommended by the Building Quality Manager.

 

(c)01/30061/FUL - LAND TO THE NORTH AND WEST OF 105 CHARLESTON DRIVE - FORMATION OF CAR SALES YARD FOR SAMNAMIC PROPERTIES LIMITED

 

After considering objections received, the Committee refused the application on the grounds that -

 

(i)the proposed development will adversely impact on the environmental quality of the local area by virtue of the provision of an inappropriate scale of car sales operation and associated works which would not enhance or be compatible with the predominant residential character of the area; and

 

(ii)the proposed new access would lead to further vehicular congestion at a busy section on Charleston Drive, to the detriment of road traffic and pedestrian safety.

 

Councillor Ward declared an interest in this item and took no part in the discussion thereof.

 

(d)01/25218/D - 5 ARNHALL GARDENS - OUTLINE PERMISSION TO ERECT ONE DWELLINGHOUSE IN GARDEN GROUND FOR PROFESSOR S PITTMAN

 

After considering objections received, the Committee approved the application subject to the conditions recommended by the Building Quality Manager.

 

(e)01/25231/D - LAND TO SOUTH OF BEECHWOOD PARK, KINGS CROSS ROAD - FIVE-A-SIDE FOOTBALL FACILITY WITH EIGHT PITCHES, PAVILION, LICENSED BAR AND FLOOD LIGHTING FOR NORTHWIND LEISURE

 

The Committee acceded to requests which had been received for deputations to be heard in relation to objections to the above application. Once the deputations had stated their case, they were thanked for their attendance and withdrew.

 

Thereafter, having considered objections received, Councillor Farquhar, seconded by Councillor Sturrock, moved refusal of the application on the grounds that -

 

(i)the proposed development is contrary to Policy H1 - Existing Residential Areas of the Dundee Local Plan 1998, as it would be likely to generate noise which would adversely affect the environmental quality enjoyed by nearby residents because:-

 

the noise is likely to be disturbing and very vocal,

the site is to be used intensively,

the premises will operate for long hours during most of the week, and

the proposal includes car parking and a licensed pavilion closer to houses that the layout which was previously approved; the material considerations including the lack of a noise impact assessment are not sufficiently strong to support the granting of consent contrary to that Policy; and

 

(ii)the proposed development is contrary to Policy H1 - Existing Residential Areas of the Dundee Local Plan 1998, as it would be likely to adversely affect the environmental quality enjoyed by local residents as it will add to the already high traffic levels now experienced on Kings Cross Road.

 

As an amendment, the Convener, seconded by Councillor Presswood, moved approval of the application subject to the conditions recommended by the Building Quality Manager.

 

On a division, there voted for the motion - Lord Provost Letford, Councillors de Gernier, Wright, Shimi, Regan, Farquhar, Sturrock, Glen, Barrie, FitzPatrick, Petrie, Fordyce, Bowes, Wallace, Scott, Macpherson and Borthwick (17); and for the amendment - the Convener and Councillors Ward, Presswood, Rolfe, Sawers, Guild, Corrigan and Mackie (8) - whereupon the motion was declared carried.

 

(f)01/30024/FUL - 13 - 27 UNION PLACE - FORMATION OF EIGHT ATTIC FLATS FOR SPRINGFIELD PROPERTIES (DUNDEE) LIMITED

 

After considering objections received, the Committee refused the application on the grounds that -

 

(i)the proposed development is contrary to Policy H16 - Roofspace and Basement Development of the Dundee Local Plan 1998 and there are no material considerations of sufficient strength to support the granting of consent contrary to that policy; and

 

(ii)the proposed development is contrary to Policy BE11 - Development in Conservation Areas of the Dundee Local Plan 1998 as the installation of 48 dormer windows in the roofs of this terrace of eight tenements does not complement or enhance the character of the surrounding area and there are no material considerations of sufficient strength to support the granting of consent contrary to that policy.

 

(g)01/30179/FUL - 306 PERTH ROAD - INSTALLATION OF AUTOMATIC TELLER MACHINE FOR THE CLYDESDALE BANK PLC

 

The Committee acceded to a request which had been received for a deputation to be heard relative to objections to the above application. Once the deputation had stated its case it was thanked for its attendance and withdrew.

 

Thereafter, having considered objections received, the Committee, on the motion of Councillor Macpherson, seconded by the Convener, refused the application on the grounds that the proposed installation of an automatic teller machine (ATM) on the front elevation of this property is unacceptable because it would be likely to encourage very short stay parking of vehicles adjacent to the site, to the detriment of traffic safety, pedestrian safety and the free flow of vehicles in this location which is subject to periodic traffic congestion.

 

(h)01/30125/COU - LAND TO EAST OF NOBEL ROAD/ARROL ROAD, WESTER GOURDIE INDUSTRIAL ESTATE FOR CASTLELAW ESTATES LIMITED

 

After considering objections received, the Committee approved the application subject to the conditions recommended by the Building Quality Manager.

 

(i)01/30140/LBC - 21/25 UNION STREET - FAADE RETENTION AND REINSTATEMENT OF FOUR FLATS AND TWO LOFT APARTMENTS AND RETAIL ACCOMMODATION FOR S L DEVELOPMENTS LIMITED

 

After considering objections received, the Committee approved the application subject to the conditions recommended by the Building Quality Manager and subject to the additional condition that the developer shall retain and afford access at all reasonable times to any archaeological organisation acceptable to the planning authority during demolition works, and shall allow them to observe work in progress and record items of interest and finds in order to examine, record and salvage items related to archaeology and history.

 

(j)01/25151/D - ASDA STORES, MILTON OF CRAIGIE, LONGTOWN ROAD - ERECTION OF ONE METRE HIGH ELECTRIFIED SECURITY FENCE FOR ASDA SUPERMARKETS

 

On a reference to Article VIII(g) of the minute of meeting of this Committee of 27th August 2001 the Committee approved the application subject to the conditions recommended by the Building Quality Manager.
