I TOWN AND COUNTRY PLANNING (HAZARDOUS SUBSTANCES) (SCOTLAND) REGULATIONS 1993 - APPLICATION (UNDER REGULATION 5(3)) FOR THE CONTINUATION OF DEEMED HAZARDOUS

 

There was submitted Report No. 63-2001 by the Director of Planning and Transportation relative to an application for unconditional consent for the continuation of the existing conditional deemed hazardous substances consent in respect of the Dock Street Holder Station Site, Dock Street.

 

The Committee agreed that permission be granted to continue the existing consent.

 

II COMMERCIAL STREET/EXCHANGE STREET - DESIGN BRIEF

 

Reference was made to the minute of meeting of the Planning and Transportation Committee of 22nd January, 2001 which approved the above brief to encourage the sensitive and appropriate redevelopment of this prominent City Centre site.

 

The Committee agreed that the brief be adopted as a material consideration in the determination of planning applications and the discharge of related responsibilities.

 

III PLANNING APPLICATIONS

 

(a)D24662 - Marchfield Road/Western Cemetery, Dundee - Renewal of Outline Consent for One Dwellinghouse for Mr M McNaught

 

The Committee acceded to requests which had been received for deputations to be heard in support of and relative to objections to the application. Once the deputations had stated their cases, they were thanked for their attendance and withdrew.

 

Thereafter, having considered objections received, Councillor Mackie, seconded by Councillor Luke, moved refusal of the application on the grounds that:-

 

(i)the proposed access arrangements for the development of one house on the application site is unsatisfactory in that the resultant increase in traffic is likely to have a detrimental effect on traffic and pedestrian safety, contrary to Policy H1 of the Dundee Local Plan 1998, and

 

(ii)the access road serving the site is a narrow unmade road which currently serves one house and the proposal to use the road for additional traffic to serve another house would increase vehicular traffic to an unacceptable degree.

 

On a division, there voted for the motion - the Lord Provost and Councillors de Gernier, Farquhar, Luke, Sturrock, Glen, Barrie, Richard Beattie, Corrigan, Fordyce, Mackie, Wallace and Scott (14); and for the amendment - the Convener and Councillors Ward, Shimi, Presswood, Rolfe, Dawson, Sawers, FitzPatrick, Guild and Dave Beattie (10) - whereupon the motion was declared carried.

 

(b)D24824 - Ground at Western Cemetery, Marchfield Road, Dundee - Renewal of Outline Consent for Erection of 3 Dwellinghouses for Murray McNaught

 

The Committee acceded to requests which had been received for deputations to be heard in support of and relative to objections to the above application. Once the deputations had stated their cases, they were thanked for their attendance and withdrew.

 

After considering objections received, the Committee refused the application on the grounds that the proposed access arrangements for the development of three houses on the application site is unsatisfactory in that the resultant increase in vehicular traffic is likely to have a detrimental effect on traffic and pedestrian safety, contrary to Policy H1 of the Dundee Local Plan 1998.

 

(c)D24843 - North Lodge, 4 Grosvenor Road, Dundee - Erection of New Wall for Murray McNaught

 

The Committee approved the application subject to the condition recommended by the Building Quality Manager.

 

(d)DLB01804 - North Lodge, 4 Grosvenor Road, Dundee - Demolition of Section of Boundary Stone and Erection of New Screen Wall and Archway for Murray McNaught

 

After considering objections received, Councillor Mackie, seconded by Councillor Wallace, moved refusal of the application on the grounds that

 

(i)the partial demolition of the wall would detract from the character and setting of this listed building contrary to Policies BE16 and B17 of the Dundee Local Plan 1998, and

 

(ii)the partial demolition of the wall would be contrary to the Council's non-statutory policy and guidelines on Breaches in Boundary Walls and Historic Scotland's Memorandum of Guidance on Listed Buildings and Conservation Areas 1998.

 

As an amendment the Convener, seconded by Councillor Presswood moved approval of the application subject to the conditions recommended by the Building Quality Manager.

 

On a division there voted for the motion - the Lord Provost and Councillors de Gernier, Letford, Farquhar, Luke, Glen, Guild, Corrigan, Fordyce, Mackie, Wallace and Scott (12); and for the amendment the Convener and Councillors Ward, Shimi, Presswood, Sturrock, Rolfe, Barrie, Richard Beattie, Dawson, Sawers, FitzPatrick and Dave Beattie (12); whereupon there being a priority of votes - the Convener gave her casting vote in favour of the amendment which was duly declared carried.

 

(e)D24975 - 150B-152 Perth Road, Dundee - Erection of Two Blocks containing 12 and 6 Apartments with the Refurbishment of Two Basement Flats in Adjacent Existing Building for Morrison Homes plc

 

The Committee noted that a request for a deputation to be heard relative to objections to the application had been withdrawn.

 

Thereafter, having considered objections received, the Committee refused the application on the grounds that:-

 

(i)The proposed development is contrary to Policy H1 - Existing Residential Areas, of the Dundee Local Plan 1998 as is likely to adversely affect the environmental quality enjoyed by an adjoining resident by reason of loss of privacy and overlooking and also fails to comply with policies and proposals contained elsewhere in the Local Plan and there are no material considerations of sufficient strength to justify the granting of consent contrary to that policy;

 

(ii)The proposed development is contrary to Policy H10 - Design of New Housing, by reason of the overlooking of an adjoining private rear garden and resulting loss of residential amenity and by reason of the poor quality of the design of Block A relative to neighbouring buildings and the surrounding area. There are no material considerations of sufficient strength to justify the granting of consent contrary to that policy.

 

(iii)The proposed development is contrary to Policy Be 11 - Development in Conservation Areas, of the Dundee Local Plan 1998 by reason of the poor quality of the design of Block A which does not complement or enhance the character of the surrounding Conservation Area or the setting of the adjacent Listed Buildings. There are no material considerations of sufficient strength to justify the granting of consent contrary to that policy.

 

(iv)The proposed development is considered to be premature as the granting consent could compromise the comprehensive development of the larger site which extends along both sides of McVicars Lane from Perth Road to Roseangle. Policy GEN 5 supports Council efforts to ensure the fulfilment of the Local Plan and the proper planning of the district by use of Compulsory Purchase Powers where appropriate.

 

(f)D24979 - Seabraes Mill, Seabraes Lane, Dundee - Change from Industrial to Non Residential Institution to form Extension to University Campus with Elevational Alterations for James Keiller Estates Ltd

 

The Committee noted that the above application had been withdrawn.

 

(g)D24981 - Brook Street/Edward Street, Dundee - Conversion to Mill to 17 Flats and 8 Houses, 10 New Build Houses, 1 Group Living Home and Supported Flats, 4 Flats, 1 Retail Unit for H & H Properties Ltd

 

The Committee approved the application subject to the conditions recommended by the Building Quality Manager.

 

(h)D24988 - 1A Rattray Street, Dundee - Change of Use from Proprietorial Club to Public House for Mr Alex Sweeney

 

After considering objections received, the Committee approved the application subject to the conditions recommended by the Building Quality Manager.

 

(i)D25018 - 93-95 Commercial Street, Dundee - Change of Use from Shop and Staff Accommodation to Printers with Shop including Elevational Alterations for W G Boyle & Co

 

After considering objections received, the Committee approved the application subject to the condition recommended by the Building Quality Manager.

 

(j)D25021 - 11 John Grahame Avenue, Dundee - Erection of Rear Extension for Mr P Martin

 

After considering objections received, the Committee approved the application.

 

(k)D25034 - 11 Reres Road, Broughty Ferry, Dundee - Erection of Two Storey Dwellinghouse for Mr & Mrs Hunter

 

After considering objections received, the Committee approved the application subject to the conditions recommended by the Building Quality Manager.
