The minute of meeting of this Committee of 27th March, 2000 was held as read.
I PLANNING APPEAL DECISION - 17 ARKLAY STREET - CHANGE OF USE FROM SHOP TO LOUNGE BAR
Reference was made to the minute of meeting of this Committee of 27th September 1999 wherein the above proposal was refused planning permission for the reasons detailed therein.
It was reported that the applicants had subsequently appealed against the foregoing decision and that the appeal had been upheld subject to six conditions relating to noise insulation, restriction on amplified music, restriction on hours of opening and a condition relating to the ownership of the flat above the site remaining the same as that of the site.
Arising from discussion, it was agreed that it be remitted to the Director of Planning and Transportation to write to the Chief Reporter expressing the Council's concern at the foregoing decision and seeking an explanation for the unusual conditions attached to the consent.
II PLANNING APPLICATIONS
(a)D24480 - Stannergate, Lower Broughty Ferry Road, Dundee - Amendments to existing consent D23810 for the construction of above ground stormwater storage tank, control
After considering objections received, the Committee approved the application subject to the conditions recommended by the Building Quality Manager.
(b)D24068 - Area C, Ninewells Avenue, Dundee - Erection of 24 Houses for H & H Properties
After considering objections received, the Committee approved the application subject to the conditions recommended by the Building Quality Manager.
(c)D24412 - Kingsway Leisure Park, formerly Van Leer Site Kingsway West, Dundee - Erection of Restaurant with Drive Thru and Takeaway Facilities for McDonalds Restaurants
After considering objections received, the Committee approved the application subject to the conditions recommended by the Building Quality Manager and subject to the additional conditions that (i) an unclimbable fence of a type and height approved by the Planning Authority in consultation with the Scottish Executive Development Department shall be provided by the developer along the boundary of the site with the trunk road and extending beyond that boundary in generally east and westbound directions to points as indicated on the plan dated 18th April, 2000, received from the applicant, and (ii) that part of the fence referred to in Condition 1 which is located along the boundary of the site with the trunk road shall be maintained by the applicant or subsequent owners in perpetuity.
(d)D24477 - 44 Pitairlie Road, Dundee - Erection of Extension to East Elevation for Mr & Mrs G Anderson
After considering objections received, the Committee refused the application on the grounds that (i) the proposal contravenes Policies H1 and H4 of the Dundee Local Plan 1998 du to its adverse impact on residential amenity resulting from overshadowing, and (ii) the proposal contravenes Policies H1 and H4 of the Dundee Local Plan 1998 due to the scale, massing and overdeveloping of the site.
(e)D24531 - 28-30 Castle Street, Dundee - Change of Use from Class 1 (Shop) to Class 2 (Employment Agency) for Kelly Services (UK)
After considering objections received, the Committee approved the application.

The Committee noted that the above application had been withdrawn by the applicants.
