Planning Appeals

Where you have made an application for planning permission and want to challenge the decision (or where no decision has been made within the set timescale), you will have the right to appeal. The right to seek an appeal/review lasts for 3 months from the date of the Decision Notice or 3 months from the date of expiry of the period allowed for determining the application. The way in which your application has been determined will influence who undertakes the appeal or review. Please check the information contained within your Decision Notice as this will tell you how to proceed.

Appeals to the Scottish Ministers are only available for those applications determined by Committee, Listed Building Consent, Advert Consent and Conservation Area Consent. Applications determined under the Council’s statutory scheme of delegation are subject to review rather than appeal. The Dundee City Council Planning Local Review Body will determine these reviews. Guidance notes and application forms are available via the following links:

Please do not submit copies of the original application form, plans, decision notice or report of handling - the Local Review Body will have access to the complete set of documents used to determine the original application.

Note only applicants have the right to appeal, if you objected to a planning application which is then approved by the Council you are not able to appeal the decision.
