In the case of Application No 1 by Dean Entertainments Limited in respect of The Old Post Office Public House, 4 Meadowside, the Board gave consideration to objections which had been received.
After hearing an agent on behalf of the objectors and an agent on behalf of the applicant, the Board agreed that the application was not competent as the public notice had not been properly displayed.
In the case of Application No 2 by Dean Entertainments Limited, the Board noted the application had been withdrawn.
In the case of Application No 6 by Barry McDernott in respect of Kings Cross Road, the Board were advised that late objections to the application had been received which included an allegation that the public notice had not been properly displayed.
After hearing an agent on behalf of the applicant, the Chairman moved that consideration of the application be deferred to the Adjourned Board and that the notices be redisplayed on the site.
As an amendment, Councillor Ward moved that consideration of the application be not deferred.
On a division, there voted for the motion - the Chairman and Councillors Grant, Letford, Beattie, Fordyce and Powrie (6); and for the amendment - Councillors Ward and Dawson (2) - whereupon the motion was declared carried.
In the case of Application No 7 by Jacqueline Milne in respect of 1 Heron Rise, the Board were advised that the applicant had appealed against a previous refusal of this application and that the Sheriff had remitted consideration of the application back to the Board.
The Board gave consideration to objections which had been received from members of the public and thereafter heard an agent on behalf of the applicant.
After discussion, the Chairman moved that the application be granted.
As an amendment, Councillor Dawson moved that the application be refused.
On a division, there voted for the motion - the Chairman and Councillors Beattie and Powrie (3); and for the amendment - Councillors Letford, Fordyce and Dawson (3); Councillors Ward and Grant being absent when the vote was taken - whereupon there being a parity of votes the Chairman gave her casting vote in favour of the motion which was duly declared carried.
There being no objections, the Board granted the remaining applications.
(j) Castaways, 98/100 Nethergate
Reference was made to the minute of meeting of this Board of 19th June 2000 wherein the Board agreed that a report by the Environmental and Consumer Protection Department relative to the above premises be submitted to this meeting.
After hearing an officer from the Environmental and Consumer Protection Department, the Board agreed that the Section 32 Hearing be convened.
