I DECLARATION OF INTEREST
Councillor Alexander declared an interest in Article II(b) by virtue of having met the applicant whilst chair of the Scottish Cities Alliance.
Councillor Coleman declared an interest in Article II(c) by virtue of being a close relative of a person who resides in a neighbouring property, left the meeting for this item, and took no part in the debate.
II PLANNING APPLICATIONS
(a) 22-00379-HAZ - STORAGE OF HAZARDOUS SUBSTANCES TO ALLOW LABELLING AND PACKAGING IN EXISTING INDUSTRIAL UNIT - WAREHOUSE AND LABORATORY, DUNSINANE AVENUE, DUNSINANE INDUSTRIAL ESTATE, DUNDEE - FOR ARGENTA DUNDEE LTD
It was reported that a request had been received for a deputation to address the Committee in support of the application. The Committee approved the application, subject to the conditions recommended by the Head of Planning and Economic Development and, in the circumstances, declined to hear the deputation.
(b) 22-00493-FULM - ERECTION OF PURPOSE-BUILT STUDENT ACCOMMODATION - SITE OF JUMPIN JAKS, SOUTH WARD ROAD, DUNDEE - FOR KR DEVELOPMENTS GROUP LTD
It was reported that a request had been received for a deputation to address the Committee in support of the application. Having considered objections received, the Committee approved the application, subject to the conditions recommended by the Head of Planning and Economic Development and, in the circumstances, declined to hear the deputation.
(c) 22-00535-PPPL - PLANNING PERMISSION IN PRINCIPLE FOR THE ERECTION OF A HOUSE - GARDEN GROUND TO THE SOUTH OF 88 LAUDERDALE AVENUE, DUNDEE - FOR MISS NICOLA MALONE
The Committee acceded to a request for a deputation to address the Committee relative to objections to the above application which was recommended for approval. After the deputation had stated their case and answered questions from members of the Committee, they were thanked for their attendance and withdrew.
Thereafter, having considered objections received, the Committee approved the application subject to the conditions recommended by the Head of Planning and Economic Development, and subject to the additional condition that prior to the commencement of the development hereby approved, details of boundary fencing to be erected around the application site shall be submitted to and approved in writing by the Planning Authority. The approved fence shall thereafter be installed, retained and maintained as such thereafter, in the interests of visual amenity and road safety.
(d) 22-00559-FULL - ERECTION OF GARDEN POD WITH RAISED DECKING (RETROSPECTIVE) - 49 ALBANY TERRACE, DUNDEE - FOR MR DANIEL CHADWICK
The Committee acceded to a request for a deputation to address the Committee relative to objections to the above application which was recommended for approval. After the deputation had stated their case and answered questions from members of the Committee, they were thanked for their attendance and withdrew.
Thereafter, having considered objections received, the Convener, seconded by Councillor Lynn, moved that the application be approved subject to the conditions recommended by the Head of Planning and Economic Development and subject to the additional condition that the existing hedge along the southern boundary of the application site shall be retained and maintained to the satisfaction of this Planning Authority. Any parts of the hedge removed, dying, being severely damaged or becoming seriously diseased shall be replaced by hedge planting of a similar size and species to the existing hedge to ensure the garden building hereby approved remains appropriately screened from Douglas Terrace in the interests of preserving the character of the surrounding conservation area.
As an amendment, Councillor McHugh, seconded by Bailie Roberts, moved that the application be refused on the grounds that the proposal would fail to preserve or enhance the character of the conservation area and the application was contrary to Policy 51 of the Dundee Local Development Plan, 2019.
On a division, there voted for the motion - the Convener, Lord Provost Campbell, Bailie Sawers and Councillors Alexander, Hunter, Lynn, Rome, Smith, Tolland, Cruickshank, Finnegan, Scullin and Coleman (13); and for the amendment - Depute Lord Provost Cordell, Bailies Roberts, Keenan, Wright, Macpherson and Scott and Councillors Anderson, El-Nakla, McHugh, McIrvine, Malone, Crichton and Duncan (13) - whereupon the Convener gave his casting vote in favour of the motion and the application was duly approved.
