I APPOINTMENT OF CONVENER

The Board unanimously agreed that Councillor Stewart Hunter be appointed as Convener of Dundee City Licensing Board.

II LICENSING (SCOTLAND) ACT 2005

(a) NEW GRANT

The Board, having heard from the agent on behalf of the applicant and the Boards Legal Adviser, agreed to approve the application.

(b) VARIATIONS (MAJOR)

The Board, having heard from the applicant, the Licensing Standards Officer and the Boards Legal Adviser, agreed to approve the variation to allow the rear of the car park area to be used as a beer garden, subject to the conditions that all patrons remain seated whilst eating and drinking to prevent the overspill of people into the adjacent pend to prevent public noise and overcrowding.

The Board, having heard from the agent on behalf of the applicant and the Boards Legal Adviser, agreed to approve the variation to increase capacity for alcohol sales from 16m2 to 25.975m2 at this location and to decrease the capacity for alcohol sales at the undernoted premises which would give an overall decrease of 4.2675m:

(i) Glamis Road - decrease of 5.5275m2

(ii) Hilltown Road - decrease of 4.42m2

(iii) Macalpine Road - decrease of 0.78m2

(iv) Orleans Place - decrease of 2.53 m2

(v) Perth Road - decrease of 0.76m2

The Board, having heard from the agent on behalf of the applicant, the Licensing Standards Officer and the Boards Legal Adviser, agreed to approve the variation to allow off-sales from 10am to 10pm, to allow home delivery and hampers, to allow live performances (acoustic/piano - max 2 persons) in the basement of the premises where restaurant is located during core hours, to a change in description of premises to "We operate as a fish/seafood restaurant on the basement level and a takeaway (chip shop) on the ground level. The basement level is where you will find the WC facilities. The ordering and consumption of food and drinks in the restaurant will be via table service only, subject to the condition that all amplified music and vocals would be inaudible in the nearest residential accommodation.

The Board, having heard from the applicant, the Chief Constables representative, the Licensing Standards Officer and the Boards Legal Adviser, agreed to approve the variation to allow the rear of the property to be used as a beer garden and a variation to the operating plan to provide an extension to the area already approved for outside drinking, to allow the live televised sports to be shown indoors, to show live televised sports outdoors for significant events with amplified sound and to host local music festival events outside with amplified sound in line with normal operating times, subject to the conditions that all amplified music and vocals would be inaudible in the nearest residential accommodation and must cease at 19:00hrs each day and that the outdoor drinking area terminate operation at 22:00hrs in the months of July and August and thereafter at 21:00hrs from September onwards in accordance with the Board policy.

The Board, having heard from the Licensing Standards Officer and the Boards Legal Adviser, agreed to approve the variation to allow alcohol to be sold for consumption from 11am on a Sunday, off-sales 10am to 10pm and a change to the description of the premises.

The Board, having heard from the Licensing Standards Officer and the Boards Legal Adviser, agreed to defer this application to the August Board meeting.

II OCCASIONAL LICENCE - NEW APPLICATION

(i) HOLY GOAT, 5 MID WYND, DUNDEE, DD1 4JG

The Board, having heard from the Boards Legal Adviser, and noting that objections from the Licensing Standards Officer had now been withdrawn, noted that this application would be dealt with under delegated powers.

(ii) DAVID R BRUCE, STALL P3, OVERGATE SHOPPING CENTRE, DUNDEE

The Board, having heard from the Boards Legal Adviser, and noting that objections from the Licensing Standards Officer had now been withdrawn, noted that this application would be dealt with under delegated powers.

(iii) PAUL GALLACHER, URBAN BEACH, THE ESPLANADE, BROUGHTY FERRY, DUNDEE, DD5 2EP

The Board, having heard from the Boards Legal Adviser, noted that the application be deferred and dealt with under delegated powers.

IV GAMBLING - NEW APPLICATION

(i) LADBROKES CORAL GROUP, UNIT 3, 82 HIGH STREET, DUNDEE, DD1 1SD

The Board, having heard from an agent on behalf of the applicant and the Boards Legal Adviser, agreed to approve the application.

V PREMISES LICENCE - REQUESTS FOR REVIEW

(i) CLEP BAR

The Board agreed to hold Premises Licence review hearings in respect of the Clep Bar.

VI PERSONAL LICENCE - REQUESTS FOR REVIEW

The Board agreed to hold a Personal Licence Review Hearing in respect of David Charles Evans.
