I DECLARATION OF INTEREST

 

There were no declarations of interest.

 

II PLANNING APPLICATIONS

 

19-00799-FULM - LINLATHEN VILLAGE, LINLATHEN ROAD, BROUGHTY FERRY, DUNDEE - PROPOSED RESIDENTIAL DEVELOPMENT OF 100 DWELLINGS WITH ASSOCIATED INFRASTRUCTURE, LANDSCAPING, DRAINAGE AND OPEN SPACE - FOR KIRKWOOD HOMES LTD

 

The Committee acceded to a request for a deputation to address the Committee in support of the above application which was recommended for approval. After the deputation had stated their case and answered questions from members of the Committee, they were thanked for their attendance and withdrew.

 

Thereafter, having considered objections received, the Convener moved that the application be approved, subject to the conditions recommended by the Executive Director of City Development, and subject to the additional condition that the footpath and cycle link paths from the application site to the wider area illustrated on the site plan hereby approved, shall be implemented in full prior to the completion of the 99th house hereby approved and be maintained as such thereafter.

 

As an amendment, Councillor Duncan, seconded by Bailie Scott, moved that the application be refused on the grounds that:-

 

(i) The proposed development would exacerbate existing capacity issues within local infrastructure and community facilities such as health care and education.

 

The applicant has also failed to provide adequate public transport provision and community shops and services in the immediate area for use by the residents of the proposed houses.

 

The proposed development would therefore not integrate with any existing community infrastructure and fails to provide new community infrastructure.

 

The application fails to comply with Policy 2 of TAYplan 2016-2036.

 

(ii) The proposed residential development is in excess of 400 metres from existing public transport provision and would not provide convenient links to services such as schools and shops.

 

The proposal therefore fails to minimise the need to travel by private car.

 

The associated increase in vehicle movements to and from the site would have an adverse impact on the capacity of the local road network, result in additional congestion and be to the detriment of road, cyclist and pedestrian safety.

 

The application therefore fails to comply with Policy 54 of the Dundee Local Development Plan 2019.

 

There are no material considerations of sufficient weight to justify approval of the application.

 

On a division, there voted for the motion - the Convener, Bailies Roberts, Sawers and Keenan and Councillors Alexander and Murray (6); and for the amendment - Lord Provost Borthwick, Bailies Scott and Macpherson and Councillors Cordell, Flynn, Hunter, Rendall, Rome, Ross, McCready, McIrvine, Malone, Marra, Richardson, Hay, Scott and Duncan (17) - whereupon the amendment was declared carried and the application refused.

 

III REQUEST FOR DIRECT ACTION TO REDUCE THE HIGH HEDGE TO THE REQUIRED HEIGHT AT 23 STRATHERN ROAD, BROUGHTY FERRY,DUNDEE DD5 1PP

IV APPEAL DECISION - LAND AT FORMER TAY ROPE WORKS, MAGDALEN YARD ROAD, DUNDEE DD2 1BA

 

There was submitted Agenda Note AN2-2020 advising the Committee that Planning application reference 19/00297/FULL sought planning permission for the demolition of the existing buildings and erection of 5 no houses and 4 no flats within the site of the former Tay Rope Works. The application was approved by the Planning Committee, following a vote, at its meeting on 12th August, 2019.

 

The associated application for Listed Building Consent reference 19/00299/LBC sought consent for the demolition of the Category C Listed former Tay Rope Works facade. The application was refused by the Planning Committee following a vote at the same meeting. The reason for refusal was the applicants failure to demonstrate that the stonework of the existing listed facade was beyond retention or reuse within the associated residential development. The loss of fabric within the prominent listed facade was considered to have a detrimental impact on the aesthetic integrity of the local streetscape and the West End Lanes Conservation Area. The application was therefore considered to be contrary to the requirements of Policy 50 (Demolition of Listed Buildings and Buildings with Conservation Areas) and Policy 51 (Development in Conservation Areas) of the Dundee Local Development Plan 2019. The application also failed to satisfy the requirements of the relevant provisions of the Planning (Listed Buildings and Conservation Areas) (Scotland) Act 1997.

 

The applicant appealed the decision to refuse listed building consent to the DPEA on 24th September, 2019. Following review, the appointed Reporter upheld the appeal and GRANTED PLANNING PERMISSION subject to a condition on 9th December, 2019. The Reporter concluded that the condition of the facade, including the pilasters, would prevent reasonable repair but that the retention of the signage was achievable and important in preserving a link to the sites industrial, heritage. The Reporter therefore allowed the appeal subject to a condition ensuring that the signage be effectively incorporated into future redevelopment of the site.

 

V DELEGATED ITEMS

 

There was submitted Agenda Note AN1-2020 advising the Committee that from 1st December to 31st December, 2019, the Planning Team determined 40 applications under delegated powers. Thirty nine of those were approved and one was refused. Three of the 40 applications attracted objections and all three of those were approved.
