The Board, having heard from an objector, an agent on behalf of the applicant, the applicant, a Building Control Officer and the Boards Legal Adviser, agreed to allow a variation to incorporate an Asian themed restaurant called North East over the 2nd, 3rd and 4th floors of the building at 36‑38 Nethergate and to allow off-sales from Monday to Sunday 10.00 am to 10.00 pm, subject to the condition that all relevant building works be completed to the satisfaction of Building Control.

The Board, having heard from the applicant, a Building Control Officer and the Boards Legal Adviser, agreed to allow a variation to increase on-sales opening from Sunday to Thursday until midnight and Friday and Saturday until 1.00 am, and to allow live performances, films, and televised sport, during and outwith core hours.

The Board, having heard from an objector, an agent on behalf of the applicant, a Building Control Officer and the Boards Legal Adviser, agreed to refuse the variation to increase non-seasonal off‑sales capacity from 48.78m2 to 63.3m2, and to increase seasonal trading (1st December each year to 2nd January the following year) off-sales capacity from 8.31m2 to 9.59m2, giving a maximum total capacity from 57.09m2 to 72.89m2.
