The minute of meeting of this Committee of 9th September, 2019 was held as read.

I DECLARATIONS OF INTEREST

 

Bailie Scott and Councillor Duncan declared non-financial interests in respect of Article VII by virtue of being members of the Friends of Barnhill Rock Garden.

 

II CITY DEVELOPMENT BUDGETARY PRESSURES

 

There was submitted Report No 350-2019 by the Executive Director of City Development updating the Committee on the ongoing challenges facing the revenue budgets managed by City Development and measures being taken by Council Officers to address the areas where a recurring overspend situation had been identified. The report highlighted that a significant proportion of the overspending budgets had limited potential to be corrected in the short term and identified long term approaches that were being developed to deliver a balanced budget in future years.

 

The Convener, seconded by Councillor Flynn, moved that the Committee:-

 

(i) notes that the overall City Development Budget 2019/2020 projected revenue outturn as at July 2019 is projecting an overspend of 3.564m against the adjusted 2019/2020 Revenue Budget;

 

(ii) remits the Executive Director of City Development to continue to review all aspects of operations within the service to minimise overspend within 2019/2020 and avoid any new revenue commitments which cannot be accommodated within existing revenue budgets; and

 

(iii) remits the Executive Directors of City Development and Corporate Services to explore and take all reasonable actions to address these historic overspends, as set out in the report, through the 2020/2021 Revenue Budget setting process.

As an amendment, Councillor McCready, seconded by Councillor Marra, moved, as additional recommendations:-

 

(iv) remits the Chief Executive to prepare a report which outlines the actions being taken to ensure that the information available for elected members for future budget setting processes is based on reasonable estimates and assumptions; and

 

(v) calls for any decisions made relevant to paragraph 8.1 to be subject to widespread consultation with the public, where relevant with Trustees of Leisure & Culture Dundee and with final democratic oversight by the Council.

 

On a division, there voted for the motion - the Convener, Lord Provost Borthwick, Depute Lord Provost Campbell, Bailies Roberts, Sawers, Scott and Macpherson and Councillors Alexander, Cordell, Dawson, Flynn, Hunter, Lynn, Rendall, Rome, Short, Smith, Hay, Scott, Duncan and Murray (21); and for the amendment - Bailies Keenan and Wright and Councillors Cruickshank, McCready, McIrvine, Malone, Marra and Richardson (8) - whereupon the motion was declared carried.

 

III LINLATHEN ROAD AREA - 20MPH ZONE ORDER 2019

 

There was submitted Report No 208-2019 by the Executive Director of City Development proposing the implementation of a new 20mph zone in a new housing development at the north end of Linlathen Road.

 

The Committee approved the preparation of the necessary Traffic Regulation Order to include new roads associated with, or accessing, the new housing development.

 

IV ORLEANS PLACE CAR PARK ORDER 2019

 

There was submitted Report No 347-2019 by the Executive Director of City Development proposing the introduction of a new Traffic Regulation Order to allow for effective management of the existing car park at Orleans Place, Menzieshill. A variation to the existing Dundee City Council (Disabled Persons' Parking Places) (Off-Street) Order 2012 was required to include off-street disabled parking bay provision within the new car park at Orleans Place.

 

The Committee:-

 

(i) approved the preparation of a new Traffic Regulation Order which would allow the effective management of the car park at Orleans Place; and

 

(ii) approved the preparation of a new Traffic Regulation Order to vary the existing Dundee City Council (Disabled Persons' Parking Places) (Off-Street) Order 2012 to include off-street disabled parking bay provision within the existing car park at Orleans Place.

 

V NATIONAL TRANSPORT STRATEGY CONSULTATION

 

The Committee acceded to a request for a deputation to address the Committee relative to this matter. After the deputation had stated their case and answered questions from members of the Committee, they were thanked for their attendance and withdrew.

 

There was submitted Report No 353-2019 by the Executive Director of City Development relative to the above.

 

Councillor McCready, seconded by Councillor Marra, moved that the Committee:-

 

(i) notes that the National Transport Strategy (NTS2), a Draft Strategy for Consultation, was issued by Scottish Government on 31st July, 2019;

 

(ii) approves the proposed response to the consultation questions as detailed in Appendix B to the report and responds;

 

(iii) remits the Executive Director to enter discussions with neighbouring local authorities, TACTRAN, Transport Scotland and Tay Cities Region Joint Committee to investigate Transport Governance for the region;

 

(iv) remits the Executive Director of City Development to prepare a report on the options for setting up a municipal bus company; and

 

(v) remits the Chief Executive to write to the Scottish Government calling for the Scotrail franchise to be operated by a publicly owned organisation.

 

As an amendment, Bailie Macpherson, seconded by Councillor Scott, moved approval of (i) to (iii) above only.

 

On a division, there voted for the motion - the Convener, Lord Provost Borthwick, Depute Lord Provost Campbell, Bailies Roberts, Sawers, Keenan and Wright and Councillors Alexander, Cordell, Dawson, Flynn, Hunter, Lynn, Rendall, Rome, Short, Smith, Cruickshank, McCready, McIrvine, Malone, Marra, Richardson and Murray (24); and for the amendment - Bailies Scott and Macpherson and Councillors Hay, Scott and Duncan (5) - whereupon the motion was declared carried.

 

VI OUR FUTURE CITY CENTRE

 

There was submitted Report No 267-2019 by the Executive Director of City Development seeking to establish the Council's approach to future development and investment in the city centre.

 

The Committee:-

 

(i) remitted the Executive Director of City Development to develop an improvement plan for the city centre and report back to the elected members for approval in due course;

 

(ii) approved the proposed Town Centre Fund programme of capital expenditure, as set out in Appendix 1 of the report;

 

(iii) delegated the Executive Director of City Development to deliver the Town Centre Fund programme of capital expenditure, following appropriate procurement processes, in order to meet the tight timescales associated with this fund; and

 

(iv) remitted the Executive Director of City Development to develop a cross departmental caretaking and maintenance strategy and report back to the elected members for approval in due course.

 

VII TENDERS RECEIVED BY HEAD OF DESIGN AND PROPERTY

 

There was submitted Report No 301-2019 by the Head of Design and Property detailing tenders received and requesting a decision thereon:-

 

(i) TURRIFF HOUSE OFFICE - DEMOLITION

 

The Committee agreed to accept the lowest offer from Dem-master Ltd, Bathgate in the sum of 29,731, to which required to be added allowances amounting to 16,573.10, giving a total expenditure of 46,304.10.

 

(ii) 20 STRATHCARRON PLACE - DEMOLITION

 

The Committee agreed to accept the lowest offer from Gowrie Contacts Ltd, Dundee in the sum of 54,480, to which required to be added allowances amounting to 32,790.09, giving a total expenditure of 87,270.09.

 

(iii) WELLGATE CENTRAL LIBRARY - REPLACEMENT CHILLER PLANT

 

The Committee agreed to accept the lowest offer from Taylor and Fraser, Paisley in the sum of 203,336.16, to which required to be added allowances amounting to 35,000, giving a total expenditure of 238,336.16.

 

(iv) BALGAY HILL CEMETERY - WELFARE UPGRADE

 

The Committee agreed to accept a negotiated contract with Construction Services in the sum of 36,078.02, to which required to be added allowances amounting to 7,000, giving a total expenditure of 43,078.02.

 

(v) BARNHILL ROCK GARDENS - REPLACE EXISTING ACCOMMODATION AND STORAGE CONTAINERS

 

The Committee agreed to accept a negotiated contract with Construction Services in the sum of 133,102.01, to which required to be added allowances amounting to 25,000, giving a total expenditure of 158,102.01.

 

(vi) DICK McTAGGART SPORTS CENTRE - INSULATION AND RADIANT PANEL HEATING WORKS

 

The Committee agreed to accept an offer from Scan Building Services in the sum of 111,102.03, together with allowances amounting to 20,000, giving a total expenditure of 131,102.03.

 

VIII CIVIC GOVERNMENT (SCOTLAND) ACT 1982 - STREET NAMES

 

There was submitted Agenda Note AN69-2019 advising of the results of consultations for street names at various locations across Dundee.

 

(a) NEW RESIDENTIAL DEVELOPMENT AT BALLUMBIE ROAD, DUNDEE

 

The Committee approved the undernoted street names:-

 

- Ballumbie Rise Walk

- Ballumbie Rise Avenue

- Ballumbie Rise Mews

- Ballumbie Rise Crescent

- Ballumbie Rise Gardens

 

(b) NEW RESIDENTIAL DEVELOPMENT AT LINLATHEN ROAD, BROUGHTY FERRY, DUNDEE

 

The Committee approved the undernoted street names:-

IX TREE PRESERVATION ORDER, NETHERGATE HOUSE, 158 NETHERGATE, DUNDEE

 

There was submitted Agenda Note AN70-2019 reporting that on 22nd August, 2019 the Council made a Tree Preservation Order (TPO) on the above-mentioned site which was located within the University Conservation Area. The property had been marketed for lease and planning permission had been granted for change of use from Class 2 to Class 3 and public house and formation of external dining areas and external bar. A tree work application had been submitted to the Council to fell and remove three trees which were situated within the grounds of a Category A Listed Building. The tree work application had received comments from 17 residents who were all against the removal of these trees.

 

Subsequently, the tree work application was refused under Section 160 of the Town and Country Planning (Scotland) Act 1997. The TPO was required on the trees which had been refused permission to have works undertaken to them.

 

The Assistant Forestry Officer did not support the removal of the trees as they were prominent and highly visual within the City Centre and University Conservation Area.

 

No objections had been received.

 

The Committee authorised the Head of Democratic and Legal Services and Executive Director of City Development to undertake the necessary procedures and confirm the above Tree Preservation Order.

 

X DUNDEE CITY COUNCIL (VARIATION OF WAITING RESTRICTIONS) ORDER 2019

 

There was submitted Agenda Note AN75-2019, where reference was made to Article V of the minute of meeting of this Committee of 28th January, 2019, wherein the Committee authorised the preparation of an Order introducing further measures to vary the provisions of numerous existing Waiting Restrictions Orders affecting Dundee.

 

It was reported that the proposed Order was duly drafted and, during the statutory consultation period, no comments were received.

 

The Order was duly advertised and three objections were received in respect of Monifieth Road at Dundarroch Gardens. After consideration of the objections it was agreed that the proposed waiting restrictions at Monifieth Road at Dundarroch Gardens would be removed from the Order with additional road safety measures being considered as an alternative.

 

The Committee agreed to make the Order as amended.

 

The Committee resolved under Section 50(A)(4) of the Local Government (Scotland) Act 1973 that the press and public be excluded from the meeting for the undernoted items of business on the grounds that they involved the likely disclosure of exempt information as defined in paragraphs 6 and 9 of Part I of Schedule 7A of the Act.

 

XI ACQUISITION AND SALE OF LAND, HEBRIDES DRIVE, MILL O MAINS, DUNDEE (MILL O MAINS REGENERATION PHASE IV)

 

There was submitted Report No 288-2019 by the Executive Director of City Development seeking approval for the acquisition of a former gas governor site and the subsequent disposal of a larger development site at Hebrides Drive, Mill O'Mains, Dundee.

 

The Committee agreed to the acquisition and disposal of land on the terms and conditions detailed in the report.

 

XII SALE OF LAND, LANGLANDS STREET, DUNDEE

 

There was submitted Report No 328-2019 by the Executive Director of City Development seeking approval for the sale of land at Langlands Street, Dundee.

 

The Committee approved the sale of land on the terms and conditions detailed in the report.

 

XIII SALE OF LAND, SMEATON ROAD, DUNDEE

 

There was submitted Report No 354-2019 by the Executive Director of City Development seeking approval for the disposal of land at Smeaton Road, Dundee.

 

The Committee approved the sale of land on the terms and conditions detailed in the report.

 

XIV SALE OF LAND, TRANENT GROVE, WHITFIELD, DUNDEE

 

There was submitted Report No 355-2019 by the Executive Director of City Development seeking approval for the disposal of land at Tranent Grove, Whitfield, Dundee.

 

The Committee approved the sale of land on the terms and conditions detailed in the report.

 

XV SALE OF LAND, HIGH STREET, LOCHEE, DUNDEE

 

There was submitted Report No 356-2019 by the Executive Director of City Development seeking approval for the sale of land at High Street, Lochee, Dundee.

 

The Committee approved the sale of land on the terms and conditions detailed in the report.

 

XVI GARDEN GROUND SALES

 

There was submitted Report No 357-2019 by the Executive Director of City Development seeking approval for the sale of land to be utilised as additional garden ground in respect of the undernoted properties:-

 

130 Hill Street, Dundee

73 Haldane Avenue, Dundee
