On a division, there voted for the motion - the Convener and Councillors Smith, McIrvine, Malone and Cruickshank (5); and for the amendment - Councillors Lynn, Rome and Scott (3) - whereupon the motion was declared carried and the application approved.

The Board, having heard from the applicant, an agent on behalf of the applicant, the Licensing Standards Officer and the Boards Legal Adviser, agreed to allow a variation; to permit bar meals to be served outwith core hours; to permit recorded music and televised sport outwith core hours; to permit the premises to open from 8.00 am daily for breakfast, coffee and tea etc; to allow children and young persons to be permitted entry to the premises when accompanied by an adult; that children and young persons be permitted entry to the premises when accompanied by an adult two hours prior to and one hour after (not later than 8.00 pm) when attending a football match at Dens Park or Tannadice Park; at all other time children and young persons will be permitted entry until 10.00 pm if consuming a meal or attending a wedding or other pre-booked and ticketed function and accompanied by an adult; and agreed that the permission be given to access to all public parts, toilets and routes to access them, subject to the condition that the transmission of music and televised sport be limited to the hours of 07.00 hours and opening time, 11.00 hours.

 

II PERSONAL LICENCE - NEW APPLICATION

The Board, having heard from the Chief Constables representative and the Boards Legal Adviser, agreed to defer consideration of this item until the October, 2019 meeting of the Board.

 

III PERSONAL LICENCE - RENEWAL APPLICATIONS

 

(i) MARK G J MCGURTY

 

The Convener declared an interest in this item by virtue of knowing the applicant and vacated the Chair. It was agreed that Councillor Lynn be appointed as Chair for this item.

 

The Board, having heard from the Boards Legal Adviser, agreed to defer consideration of this application until the October, 2019 Board meeting.

 

IV PERSONAL LICENCE - REVIEWS

 

(i) HAYLEY BLACKLEY

 

The Board, having heard from the Boards Legal Adviser, agreed to defer consideration of this matter until the October, 2019 meeting of the Board.

 

(ii) MEIFANG CHEN

 

The Board, having heard from the Chief Constables representative and the Boards Legal Adviser, agreed that the grounds for a review had been met.

 

Thereafter, the Convener moved that the licence be endorsed.

 

As an amendment, Councillor Lynn moved that the licence be suspended.

 

On a division, there voted for the motion - the Convener and Councillors Smith, Rome, McIrvine, Malone, Cruickshank and Scott (7); and for the amendment - Councillor Lynn (1) - whereupon the motion was declared carried and the licence endorsed.

 

V PREMISES LICENCE - REVIEWS

 

(i) ABODE, 22 ST ANDREWS STREET, DUNDEE

 

This item was withdrawn.

 

(ii) THE UNDERWORLD CAFE, 204/206 PERTH ROAD, DUNDEE

 

The Board, having heard from the Licensing Standards Officer and the Boards Legal Adviser, agreed that no further action be taken since the Premises Licence had been surrendered.

 

VI PERSONAL LICENCE - REQUEST FOR REVIEW

 

The Board agreed to hold Personal Licence review hearings in respect of Lal Hussain Butt and Dea McGill.

 

VII PREMISES LICENCE - REQUEST FOR REVIEW

 

The Board agreed to hold a Premises Licence review hearing in respect of Sunnys Convenience Store.
