I DECLARATION OF INTEREST

 

Councillor Malone declared a non-financial interest in Article II(b) by virtue of one of the deputations being known to him and left the meeting during consideration of this item.

 

II PLANNING APPLICATIONS

 

(a) 19-00120-MDPO - MODIFICATION OF S75 PLANNING OBLIGATION TO REMOVE PROHIBITED HOUSE IN MULTIPLE OCCUPATION RESTRICTION - 21F PERTH ROAD, DUNDEE - FOR MR D BLYTH

 

The Committee approved the application, subject to the conditions recommended by the Executive Director of City Development.

 

(b) 19-00166-FULL - ERECTION OF A FLAGPOLE - 19 NAVARRE STREET, BROUGHTY FERRY, DUNDEE - FOR MR FRASER MONCUR

 

The Committee acceded to requests for deputations to address the Committee in relation to objections to the above application which was recommended for approval. After the deputations had stated their cases and answered questions from members of the Committee, they were thanked for their attendance and withdrew.

 

Thereafter, the Convener, seconded by Depute Lord Provost Campbell, moved that the application be approved, subject to the conditions recommended by the Executive Director of City Development and subject to the additional condition that:-

 

Prior to the commencement of the development hereby approved, details of noise mitigation measure(s) to be installed to the flagpole should be submitted to the Council for written approval. Thereafter, the approved noise mitigation measure(s) should be implemented prior to the use of the flagpole commencing, and be retained as such for the lifetime of the development, in the interests of residential amenity.

 

As an amendment, Councillor Scott, seconded by Bailie Scott, moved that the application be refused on the grounds that:-

 

The proposal would be contrary to criterion 1 of Policy 11 Householder Development of the Dundee Local Development Plan 2019 as the proposed flagpole in terms of its size and visual appearance would have a detrimental impact on the residential character and appearance of the surrounding area. There are no material considerations of sufficient weight that would justify approval of planning permission.

 

On a division, there voted for the motion - the Convener, Depute Lord Provost Campbell, and Councillors Cordell, Flynn, Short and Smith (6); and for the amendment - Lord Provost Borthwick, Bailies Roberts, Keenan, Wright, Scott and Macpherson and Councillors Hunter, Lynn, Rendall, Rome, McCready, McIrvine, Marra, Richardson, Hay, Scott and Duncan (17) - Councillor Malone being absent when the vote was taken and Councillor Cruickshank being absent during deliberations - whereupon the amendment was declared carried.

 

III DELEGATED ITEMS

 

There was submitted Agenda Note AN33-2019 advising the Committee that from 1st April, 2019 to 30th April, 2019, there were 46 delegated decisions. Two of those applications attracted objections. Of those two, both applications were approved.
