Thereafter, Councillor Lynn moved that the application for a variation to increase the off-sales capacity from 25.875m2 to 30.2605m2 be refused. As an amendment, Councillor Cruickshank moved that the application for a variation to increase the off-sales capacity from 25.875m2 to 30.2605m2 be approved.
On a division, there voted for the motion - the Convener, Bailie Keenan and Councillors Alexander, Lynn, Smith, McIrvine and Scott (7); and for the amendment - Councillor Cruickshank (1) - whereupon the motion was declared carried and the application refused.

Bailie Keenan declared a non-financial interest in this item of business by virtue of being a member of this establishment and left the meeting during its consideration.
The Board, having heard from the applicant and the Boards Legal Adviser, agreed to grant the above application.
II PREMISES LICENCE - MAJOR VARIATION APPLICATION UPDATE
(i) TAMS BAR, 77 ROSEBANK STREET, DUNDEE
Reference was made to Article I(a) of the minute of meeting of the Licensing Board of 14th February, 2019, wherein it was agreed that an update be given at this Board meeting regarding the removal of the disabled toilet without the necessary Building Warrant having been obtained at Tams Bar.
Having heard from the applicant, a Licensing Standards Officer, a Building Control Officer and the Boards Legal Adviser, it was agreed that no further action be taken by the Board, however, the Board agreed that the owner of the establishment be contacted to ascertain progress regarding the reinstallation of the toilet and that Building Control Officers use their delegated powers to commence any necessary enforcement action in respect of these premises.

The Board, having heard from the applicant, the Chief Constables representative and the Boards Legal Adviser, agreed to refuse the application.
(ii) LESLEY WHYTE
The Board, having heard from the applicant, the Chief Constables representative, a Licensing Standards Officer and the Boards Legal Adviser, agreed to grant the application.
VI PERSONAL LICENCE - REVIEW HEARINGS
(i) HAYLEY BLACKLEY
The Board, having heard from the Chief Constables representative and the Boards Legal Adviser, agreed to endorse the licence.
VII PERSONAL LICENCE - REQUEST FOR A REVIEW
The Board agreed to hold Personal Licence review hearings in respect of Callum Fraser and George Finlay.
