At a MEETING of the DUNDEE CITY LICENSING BOARD held at Dundee on 17th January, 2019.

I LICENSING (SCOTLAND) ACT 2005

(a) NEW GRANTS

The Board, having heard from an agent on behalf of the applicant and the Boards Legal Adviser, agreed to grant the application, subject to the condition that agreement be reached with Building Control with regards to maximum occupant capacity.

The Board, having heard from an agent on behalf of the applicant and the Boards Legal Adviser, agreed to grant the application.

(b) VARIATIONS (MAJOR)

The Board, having heard from the applicant and the Boards Legal Adviser, agreed to grant the application, subject to the conditions of Planning Approval 18/00/594/FULL relating to the outdoor beer garden as follows:-

The beer garden hereby approved shall only operate during the following hours - September to June - open 11:00 hours Monday to Saturday and 12:30 hours on Sundays: closing at 2100 hours - July and August - open 11:00 hours Monday to Saturday and 12:30 on Sundays: closing at 22:00 hours.

The Board, having heard from the agent on behalf of the applicant and the Boards Legal Adviser, agreed to grant a variation to sell alcohol on the premises from 11am to 1am Monday to Sunday, and off-sales from 11am to 10pm Monday to Sunday; remove the activities of conference facilities, bar meals, club or other group meetings and films; add the activity of outdoor drinking; food and non‑alcoholic beverages may be available outwith licensed hours; restaurant facilities and recorded music may be available during all opening hours; receptions including weddings, funerals, birthdays, retirements etc, may also be available during all opening hours according to demand; no alcohol would be sold outwith core licensed hours except where additional licensed hours were permitted by virtue of an extension of hours granted in terms of Sections 67 or 68 of the Licensing (Scotland) Act 2005; takeaways and deliveries be added as an activity; children and young persons be permitted entry for the purpose of having a meal or light refreshment, or for ordering or collecting takeaways; children 0-13 years of age require to be supervised by a person aged 18 or over at all times; children and young persons 14-17 years require to be accompanied by a person aged 18 or over from 10pm; children would be allowed entry to all public areas; the internal capacity of the premises would be 106 and the external capacity of 12, giving the premises a total capacity of 118; the layout plan be changed to layout plan number 219 A 020 Rev P4 and the general layout plan changed following internal refurbishment and addition of external area; the name of the premises be changed to Nandos, subject to the condition that all relevant building works being completed.

(c) TRANSFERS

The Board, having heard from an agent on behalf of the applicant, the Boards Legal Adviser, the Chief Constables representative and the Licensing Standards Officer, agreed to grant the application for transfer of the premises licence to Dentana Ltd.

II GAMBLING ACT 2005 STATEMENT OF LICENSING POLICY 2019-2022

The Board agreed the final version of the Statement of Licensing Policy for adoption.

III PREMISES LICENCE - REVIEW HEARING

(i) READING ROOMS, BLACKSCROFT

Having heard from the Boards Legal Adviser, the Board agreed to defer consideration of this matter until 14th February, 2019.

IV PREMISES LICENCE UPDATE

(i) NO 1S BAR AND RESTAURANT, 5 WARD ROAD

The Board agreed that no further action be taken in respect of this premises and its licence.

V PERSONAL LICENCE - REVIEW HEARING

(i) GRANT GRIEVE

Having heard from the Boards Legal Adviser, the Board agreed to defer consideration of this matter until 14th February, 2019.

VI PERSONAL LICENCE - NEW APPLICATION

(i) SCOTT TAYLOR

The Board, having heard from the Boards Legal Adviser and the Licensing Standards Officer, noted that the application had been withdrawn.

(ii) ALESSANDRO DISANTO

The Board, having heard from the Chief Constables representative and the Boards Legal Adviser, agreed to defer this application until 14th February, 2019 to allow the applicant to attend.

VII PREMISES LICENCE - REQUEST FOR REVIEW

The Board agreed to hold Premises Licence Reviews in respect of Haldane Stores and Lifestyle Grocers.

VIII PREMISES LICENCE - NOTIFICATION OF CONVICTION

The Board agreed to note the information provided in relation to the undernoted premises licences and that no further action be taken in the meantime:-

IX PERSONAL LICENCE - REQUEST FOR REVIEW

The Board agreed to hold a personal licence review in respect of Aydin Dag.
