I DECLARATION OF INTEREST
There were no declarations of interest.
II ROAD CONSTRUCTION CONSENTS
There was submitted Agenda Note AN80-2018 where reference was made to Article VI of the minute of meeting of the Policy and Resources Committee of 27th April, 2009, which delegated the grant of Road Construction Consent to the Executive Director of City Development, with the proviso that any consents granted be reported to the City Development Committee as soon as practicable thereafter.
The undernoted applications had been submitted and the Executive Director of City Development had approved the applications subject to conditions which had been agreed with the applicants:-

III DUNDEE CITY COUNCIL (VARIATION OF WAITING RESTRICTIONS) ORDER 2018
There was submitted Agenda Note AN78-2018 where reference was made to Article VI of the minute of meeting of this Committee of 25th June, 2018, wherein the Committee authorised the preparation of an Order for the purpose of varying the provisions of several existing Waiting Restrictions Orders affecting Dundee.
It was reported that the proposed Order was duly drafted and, during the statutory consultation period, no objections were received.
The Order was duly advertised in the Evening Telegraph and one objection was received in respect of Kinloch Park.
The Committee agreed to make the Order despite the objection.
IV TENDERS RECEIVED BY HEAD OF DESIGN AND PROPERTY
There was submitted Report No 336-2018 by the Head of Design and Property detailing tenders received and requesting a decision thereon:-
(i) SCIENTIFIC SERVICES DEMOLITION
The Committee agreed to accept an offer from Central Demolition in the sum of 57,400, to which required to be added allowances of 40,700, making a total expenditure of 98,100.
(ii) OUR LADY'S PRIMARY SCHOOL DEMOLITION
The Committee agreed to accept an offer from Gowrie Contracts in the sum of 62,790, to which required to be added allowances of 64,500, making a total expenditure of 127,290.
(iii) DUNDEE GO ULTRA LOW MULTI-STOREY WORKS, GREENMARKET
The Committee agreed to accept an offer from Swarco UK Ltd in the sum of 520,259, to which required to be added allowances of 56,670, making a total expenditure of 576,929.
(iv) CLAYPOTTS CASTLE SCHOOL - PLAYGROUND
The Committee agreed to accept an offer from Construction Services in the sum of 6,980, to which required to be added allowances of 1,200, making a total expenditure of 8,180.
V ADOPTION OF DUNDEE LOCAL DEVELOPMENT PLAN 2
There was submitted Report No 371-2018 by the Executive Director of City Development presenting the Examination Report on the Proposed Dundee Local Development Plan 2, the modifications recommended in the Examination Report and the Proposed Local Development Plan 2 as modified for adoption. In addition, it presented the updated Environmental Report and Habitats Regulation Appraisal Record which had taken into account the modifications made to the Proposed Dundee Local Development Plan 2.
The Committee agreed to:-
(a) note the contents of the Examination Report on the Proposed Dundee Local Development Plan 2;
(b) approve the modifications recommended in the Examination Report to the Proposed Dundee Local Development Plan 2, as set out in Appendix 1 to the report;
(c) adopt the updated Environmental Report and Habitats Regulation Appraisal record;
(d) remit the Executive Director of City Development to notify the Scottish Ministers of the Council's intention to adopt the Proposed Dundee Local Development Plan 2 as modified;
(e) remit the Executive Director of City Development to complete the statutory pre‑adoption procedures as set out in Appendix 2; and agree to the adoption of the Proposed Dundee Local Development Plan 2 following completion of these procedures; and
(f) approve the updated Action Programme and agree to its publication on the adoption of the Dundee Local Development Plan 2.
VI DUNDEE LOCAL DEVELOPMENT PLAN 2 SUPPLEMENTARY GUIDANCE
There was submitted Report No 370-2018 by the Executive Director of City Development summarising the representations received to the three proposed items of supplementary guidance on air quality, developer contributions and householder development from the period of public consultation and seeking approval of the proposed modifications to the wording of the guidance in response to the representations.
The Committee agreed to:-
(a) note the summary of the issues raised in the representations received to the proposed supplementary guidance on air quality; developer contributions; and householder development; the response to these by the Council; those modifications required by the Reporters in the Examination Report on the Proposed Dundee Local Development Plan 2, and approved the proposed modifications as set out in Appendix 1 of the report;
(b) adopt the supplementary guidance as modified following completion of the required pre-adoption procedures; and
(c) remit the Executive Director of City Development to submit a copy of the supplementary guidance to Scottish Ministers, together with the relevant statements as required by the Town and Country (Development Planning) (Scotland) Regulations 2008 and to complete the required pre-adoption procedures.
VII HADDINGTON AVENUE AREA, DUNDEE - STOPPING-UP ORDER 2018
There was submitted Report No 373-2018 by the Executive Director of City Development which considered the necessity to stop up lengths of carriageway, associated footways, parking areas and lengths of footpath in the Haddington Avenue area of Whitfield, utilising the powers of the Town and Country Planning (Scotland) Act 1997 to accommodate a new housing development following planning consent.
The Committee approved the Stopping Up Order for the Haddington Avenue area.
VIII PENALTY CHARGE NOTICES
It was reported that this item had been placed on the agenda at the request of Bailie Macpherson who asked the Committee to approve a change to the Fixed Penalty Notice procedure to allow the Registered Keeper of a motor vehicle who had been subject to a Notice a further period of 14 days to pay at the discounted rate of 30 in the event that their formal representation against a Penalty Charge Notice was unsuccessful.
Following discussion, the Committee agreed to defer this item for further investigation.
The Committee resolved under Section 50(A)(4) of the Local Government (Scotland) Act 1973 that the press and public be excluded from the meeting for the undernoted items of business on the grounds that they involved the likely disclosure of exempt information as defined in paragraphs 6 and 9 of Part I of Schedule 7A of the Act.
IX PROPOSED ASSIGNATION OF LEASE
There was submitted Report No 395-2018 by the Executive Director of City Development relative to the above.
Following a division, the Committee agreed to defer this item for further information.
X SALE OF LAND, DONALD STREET, DUNDEE
There was submitted Report No 380-2018 by the Executive Director of City Development seeking approval for the sale of land at Donald Street, Dundee.
The Committee approved the sale of land on the terms and conditions detailed in the report.
XI SALE OF GARDEN GROUND
There was submitted Report No 356-2018 by the Executive Director of City Development seeking approval for the sale of land, to be utilised as additional garden ground, in respect of the undernoted properties:-

The Committee approved accordingly.
XII GRANT OF SERVITUDE RIGHT OF ACCESS OVER LAND AT GREENMARKET, DUNDEE
There was submitted Report No 382-2018 by the Executive Director of City Development seeking approval to enter into negotiations with Scottish Enterprise to grant an extension of a servitude right of access over an area of ground at Greenmarket, Dundee.
The Committee approved accordingly.
