At a MEETING of the LOCAL REVIEW BODY held at Dundee on 13th November, 2018.

The Chairman welcomed those present to the meeting and briefly outlined the role of the Local Review Body and officers, in particular advising that, although the Planning Adviser was an employee of the Planning Authority, he had not been involved in the determination of the case under review and was present to provide factual information and guidance.

III LOCAL PLANNING REVIEW LRB8/2018 CHANGE OF USE FROM CLASS 5 GENERAL INDUSTRIAL USE TO CLASS 11 PROPOSED GYM ATUNIT 5/6, 20 KILSPINDIE ROAD, DUNDEE
This item was deferred.
IV LOCAL PLANNING REVIEW LRB9/2018 ERECTION OF TWO SINGLE STOREY BUSINESS UNITS (OFFICE SPACE AND HAIR AND BEAUTYSALON) TO THE EAST AND WEST OF AN EXISTING LISTED BUILDING AT INGLESIDE,
There was submitted Agenda Note AN77-2018 giving details of a request for a review of the refusal of planning permission for the erection of two single storey business units (office space and hair and beauty salon) to the east and west of an existing listed building.
Papers had been circulated and the Local Review Body had requested an accompanied site visit, which had taken place on 8th November, 2018.
The Local Review Body noted all of the above, and agreed in terms of the Local Review Procedure Regulations to determine the review without further procedure on the basis of the information before it.
Thereafter, having considered all the information, the Local Review Body, having taken into account the provisions of the Development Plan, all material considerations, the accompanied site visit and all matters raised at the Review, upheld the Appointed Officer's decision to refuse planning permission 18-00431-FULL for the following reasons:-
The proposed development is contrary to Policy 7 (High Quality Design) and Policy 48 (Listed Buildings) of the Dundee Local Development Plan 2014 and Policy 1 (High Quality Design and Placemaking) and Policy 49 (Listed Buildings) of the proposed Dundee Local Development Plan 2017. The proposed development will have a detrimental impact on the character and setting of the B‑listed building due to the massing and scale of the two contemporary styled pavilions. Further, the proposed development will result in the loss of planting and the garden ground within the curtilage of the listed building. The proposal fails to preserve the setting of the listed building as required by Section 59 of the Planning (Listed Buildings and Conservation Areas) (Scotland) Act 1997. There are no material planning considerations of sufficient weight to justify approval of the application contrary to the Development Plan.
The proposed development is contrary to Policy 47 (Environmental Protection) and Policy 29 (Low and Zero Carbon Technology in New Development) of the Dundee Local Development Plan and Policy 39 (Environmental Protection) and Policy 48 (Low and Zero Carbon Technology in New Development) of the proposed Dundee Local Development Plan 2017. The intensification of the commercial use of the site has the potential to have a detrimental effect on the surrounding residential properties given their close proximity. There are no material planning considerations of sufficient weight to justify approval of the application contrary to the Development Plan.
