Local Review Body - 28/08/2018

At a MEETING of the LOCAL REVIEW BODY held at Dundee on 28th August, 2018.

The Chairman welcomed those present to the meeting and briefly outlined the role of the Local Review Body and officers, in particular, advising that, although the Planning Adviser was an employee of the Planning Authority, he had not been involved in the determination of the case under review and was present to provide factual information and guidance only.

II MINUTE OF MEETING OF LOCAL REVIEW BODY OF 26TH JUNE, 2018

 

The minute of the above meeting was submitted and noted.

 

III LOCAL PLANNING REVIEW LRB6/2018 - 13A ASH STREET, DUNDEE

 

There was submitted Agenda Note AN50-2018 giving details of a request for a review of planning permission for the retrospective formation of a car park at 13A Ash Street, Dundee.

 

The Planning Adviser gave a brief outline of the application and the reasons for refusal.

 

Thereafter, the Legal Adviser advised of the procedural/legal issues which required to be considered by the Local Review Body.

 

The Local Review Body considered the documentation submitted and, after discussion, agreed in terms of the Local Review Procedure Regulations to determine the review without further procedure on the basis of the information before it.

 

Thereafter, having considered all the information, the Local Review Body, having taken into account the provisions of the Development Plan, all material considerations, and all matters raised at the Review, upheld the Appointed Officer's decision to refuse Planning Permission 18-00023-FULL for the following reasons:-

 

(i) The proposal does not fall within a Class 4, 5 or 6 use, and is not of a wider industrial nature, and therefore the principle of the proposed land use fails to meet the policy requirements of Policy 3: General Economic Development Areas of the adopted Dundee Local Development Plan 2014. There are no material planning considerations which would justify approval of the application.

 

(ii) It has not been demonstrated that the proposal meets the Councils guidance on road standards. The proposal could have a detrimental impact on road safety standards and does not comply with Policies 55 and 57 of the Dundee Local Development Plan 2014. There are no material planning considerations which would justify approval of the application.

 

IV LOCAL PLANNING REVIEW LRB7/2018 - 4 LOCHINVER CRESCENT, DUNDEE

 

There was submitted Agenda Note AN51-2018 giving details of a request for a review of planning permission for the erection of a timber deck and fence at 4 Lochinver Crescent, Dundee.

 

The Planning Adviser gave a brief outline of the application and the reasons for refusal.

 

Thereafter, the Legal Adviser advised of the procedural/legal issues which required to be considered by the Local Review Body.

 

The Local Review Body considered the documentation submitted and, after discussion, agreed in terms of the Local Review Procedure Regulations to determine the review without further procedure on the basis of the information before it.

 

Thereafter, having considered all the information, the Local Review Body, having taken into account the provisions of the Development Plan, all material considerations, and all matters raised at the Review, upheld the Appointed Officer's decision to approve Planning Permission 18‑00111-FULL, subject to the condition detailed below:-

 

(i) The timber fence erected along the west boundary of the front garden ground shall be reduced to 1m high, within two months of the grant of planning permission for the avoidance of doubt, the combined height of the front decking hereby approved and the fence shall be 1m.

 

Reason:

 

(i) In the interest of respecting neighbouring boundary treatments within the streetscape and safeguarding the character and appearance of the area.
