Local Review Body - 29/05/2018
At a MEETING of the LOCAL REVIEW BODY held at Dundee on 29th May, 2018.

The Chairman welcomed those present to the meeting and briefly outlined the role of the Local Review Body and officers, in particular, advising that, although the Planning Adviser was an employee of the Planning Authority, he had not been involved in the determination of the case under review and was present to provide factual information and guidance only.

III LOCAL PLANNING REVIEW LRB3/18 - LAND TO THE SOUTH OF 5 KIRKTON ROAD, DUNDEE
There was submitted Agenda Note AN29-2018, giving details of a request for a review of the refusal of planning permission for the erection of 3 No Eco Houses.
The Planning Adviser gave a brief outline of the application and the reasons for refusal.
Thereafter, the Legal Adviser advised of the procedural/legal issues which required to be considered by the Local Review Body.
The applicant had intimated in the Notice of Review that he had not introduced any new material which was not before the Appointed Officer at the time of reaching her decision. In addition to the appeal statement, the applicant had submitted the planning delivery advice: Build to Rent and also a Build to Rent in Scotland marketing brief. These latter documents were not included with the original application and were therefore not before the Appointed Officer when she determined the application. The Local Review Body agreed that in so far as these documents contained material considerations they should be taken into account in reaching a decision.
Thereafter, the Local Review Body considered whether it felt that it had sufficient information before it to determine the review at that time, or whether it required any further information.
The Local Review Body considered the documentation submitted and, after discussion, agreed to hold an accompanied site visit (subsequently arranged for 7th June, 2018). The Local Review Body further requested that details of finishings/materials/eco components be identified, and information regarding the marketing of the site for property development be made available to the Local Review Body and that all boundaries of the proposed dwellings and communal parking areas be marked out.
